00-1194Council File # eo -t\q� Presented by Referred To Green Sheet # I 0 G�� Committee Date 1 Whereas, the 1994 Swift Rail Development Act requires the Secretary of Transportarion to prescribe regulations 2 requiring a train whistle to be sounded when a train is approaching and entering a public highway-rail grade 3 crossings; and 4 Whereas, after 6 years, the Federal Railway Administration (FRA) issued a proposed rule that requires train horns 5 to be sounded when a train approaches and enters every public highway rail-grade crossing. This rule is particulazly 6 harmfiil to cities with major rail-hubs, and established train whistle bans like Saint Paul; and 7 Whereas, these whistle-blowing regulations will apply to all grade crossings except those where exlraordinary safety 8 devices have been installed such as: median wa11s to keep motorists from driving around lowered gates, four-quadrant 9 gates that block a11 traffic lanes, grad�crossing surveillance cameras, and vehicle-arresting nets; and 10 Whereas, in order to obtain exemprions from the sounding of these high-decibel train whisfles, the State and local 11 governments will be forced to spend substantial sums of money that could be better spent on other safety-related 12 projects and it is unfair of the federal government to impose costly, unfi�nded mandates of this type; and 13 Whereas, the frequent blowing of train wlustles at at-grade crossings in Saint Paui has caused considerable stress 14 among neighbors and businesses and has handicapped real estate values; and Whereas, the City of Saint Paul has over 25 at-grade raikoad crossings that would be affected by the proposed FRA action. 60 -<<qy 3 Therefoxe, be itresolved tl�at the City of St. Paul supports the proposal of Dennis Hastert, Speaker of the U.S. House 4 of representatives, to prohibit the Secretary of Transportation from issuing a final rule on the sounding of train 5 whistles until Oct. 1, 2001; and Be it fiuther resoived that the City of Saint Paul disputes any need far furtlier federal regulation ofrailroad crossings in the city; and 8 Be it finally resolved that suitable copies of this resolution be sent to the Secretary of the Federal Raikoad 9 Adm'vustrationandthemembersoftheMinnesotaCongressionalDelegation,andthattheCityofSaintPaulrequests 10 that members of the Minnesota Congressional Delegation support and initiate efforts consistent with tUe intent of 11 this resolution.
