An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining
to zoning for the City of Saint Paul and
the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes � 462 .357 and � 64 .210
of the Legislative Code, Anna M. Weston duly •petitioned to rezone
the East 75 ' of West 175 ' of part N. of N.P. right-of-way of Lot 38,
Cottage Homes, located at 520 West Orange, from R-3 to RT-1 to per-
mit retention of existing duplex, the petition having been certified
by the Planning Department on May 21, 1984 as having been consented
to by at least 67$ of the owners of the area of the property to be
rezoned, and further having been consented to by at least two-thirds
of the owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any such contiguous property within one year
preceding the date of the petition; and
WHEREAS, The current Zoning Committee on June 7, 1984 conduct-
ed a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative
Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on June 8, 1984 and recommended that
the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

Dear Sir:
On June 7, 1984, the Zoning Comnittee of the Planning Commission held a
public hearing on this rezoning and reviewed the staff report with a
recomnendation for approval . The petitioner testified on her own behalf. In
addition, four letters were received in support. At the close of the public
hearing the Corrmittee voted 5-0 to recommend approval of the rezoning.
On June 8, 1984, the Planning Commission upheld the Zoning Committee's
recorrmendation on a vote of 19-0.
This rezoning is scheduled to be heard by the City Council on August 2, 1984.
Please notify me by August 1, 1984, if any member of the City Council wishes
to have slides of the site presented at the public hearing.

Residence which permitted duplex occupancy on lots of 7,500 square feet with 75
foot frontage.
G. FI�lDINGS:
1. The applicant requested an inspection f or Certificate of Compliance to
determine if the basement area, ���hich was rented as an apartment, met all
code requirements for habitable space.
2. When certificate of inspection was completed petitioner was informed that the
dwelling could not be occupied as a t�,�o-family dwelling .until all violations
of the Building Code were cured and the zoning was changed from R-3 to RT-1.
3. The applicant sought and received relief from the provisions of the Building
Code �rith respect to minimum ceiling heights through the Saint Paul 8oard of
Appeals and Review, provided that the northeast room was not used as a ,
sleeping room.
4. The applicant appears to either have met, or agreed to meet, all of the
requirements as specified in the P�1arch 21st letter of the building official .
5. The property appears to meet the provisions of the Planning Corranission's
interim guidelines for conversion to duplex occupancy in that:
a. The lot size is more than three times the area recomJnended f or �conversion.
b. Properties to the immediate north and west are currently duplex occupancy,
thus the neighborhood is mixed �ensity.
c. The structure contains 1,040 square feet of floor area at ground level
(v�alk-out basement at grade and equal floor area on the main floor) and
tnus contains more than the required 1,800 square feet of s�ace foiic��ving
conversion. �

d. Adequate parking space is available for two vehicles. Petitioners has
stated that this has always been adequate in the past. A third space
could be constructed if necessary, although the topography makes provision
of additional space difficult at best.
H. STAFF RECOMMENDATION: Based on findings 1 through 5(d), staff recommends approval
of rezon�ng to the requested RT-l.

Dear Ms. Weston:
Pursuant to your request, 520 W. Orange was inspected on March 19, 1984
to determine if the basement area, which is now rented as an apartment ,
met all code requirements for habitable space. The following report is
submitted.
The two most important factors involving code requirements were ceiling
heights (which should be 7 '-6" in at least two thirds af every habitable
room) and light and ventilation (glass area should equal 8� of the floor
area and 5�� of this should be openable) . .

�� Living Room (198 sq. ft.) - Glas area is sufficient but ceiling height
is 7'-1".
2. Northeast room (102 sq. ft .) - This room was being used as a beci�oom at
the time of inspection. Glass area is 2.5 sq. ft . Ceiling height is
6'-10".
3. Southwest room (96 sq. ft .) - This room was bein� used as a bedroom at
the time of inspection. Glass area is more than 8�. Ceiling height is 7'-1"•
Note: Both of the areas which are used as bedrooms would require an escape
window as per code requirements, present windows are considerably different.
4. Kitchen (108 sq. ft.) - Glass area is 2.5 sq. ft . Ceiling height is 6' -9".
5. Bathroom - Ceiling height is 6 '-9" (minimum in bathrooms is 7 feet) . The
mechanical vent for this room did not appear to vent to the exterior.
6. The stairway from the first .floor enters directly into the area now used
as living space. A wall and entrance door would be required near the
lower end of the stairway . The door would need a dead bolt (communicating
hallway requirement) . Note: There is a main exit door on the south
exterior wall .

Dear Ns. Weston:
On April 10 , 1984 , the Board of Appeals met and reviewed
your request for a variance on ceiling height in the lo�er
level apartment at 520 West Orange.
Subject to approval of the St. Paul City Council, the
variance has been granted on the ceiling height re-
quirement to allow for continued use of lower level
apartment with the present ceiling heicxht, provided the
northeast bedroom is not used for a sleeping room.

M WHEREAS, Pursuant to Minnesota Statutes § 462.357 and § 64 .210
� of the Legislative Code, Anna M. Weston duly •petitioned to rezone
� the East 75 ' of West 175 ' of part N. of N.P. right-of-way of Lot 38,
Cottage Homes, located at 520 West Orange, from R-3 to RT-1 to per-
mit retention of existing duplex, the petition having been certified
by the Planning Department on May 21, 1984 as having been consented
to by at least 67� of the owners of the area of the property to be
rezoned, and further having been consented to by at least two-thirds
of the owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any such contiguous property within one year
preceding the date of the petition; and
WHEREAS, The current Zoning Committee on June 7, 1984 conduct-
ed a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative
Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on June 8, 1984 and recommended that
the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

and the Council having considered all the facts and recommendations
concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 4 ,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 520 West Orange,
being more part}cularly described as the
East 75 ' of West 175 ' of part N, of N.P.
right-of-way of Lot 38, Cottage Homes, be
and is hereby rezoned from R-3 to RT-1.
Section 2 .
This ordinance shall take effect and be in force thirty (30)
