An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining
to zoning for the City of Saint Paul
and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462 .357 and � 64.210
of the Legislative Code, Elmhurst Realty, Inc. duly petition to
rezone Lots 4 & 5, Block 1, Belvidere Park Subd. of Lot 2, Bidwell 's
Addition, located on the northeast corner of Oakdale and Winona,
from R-4 to RT-1 to permit construction of twin-home, the petition
having been certified by the Planning Division on May 16, 1984 as
having been consented to by at least 67� of the owners of the area
of the property to be rezoned, and further having been consented
to by at least two-thirds of the owners of the property situated
within 100 feet of the total contiguous descriptions of real estate
held by the same owner or any party purchasing any such contiguous
property within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on June 7, 1984 conduct-
ed a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative
Code, submitted its recommendation to the Planning Commission
that the -petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on June 8, 1984 and recommended that
the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

Dear Sir:
On June 7, 1984, the Zoning Committee of the Planning Comnission held a
public hearing on this rezoning. The petitioner was present and testified.
No correspondence was received on the matter. At the close of the public
hearing the Zoning Committee voted 4-0 to recommend approval of the rezoning.
On June 8, 1984, the Planning Commission upheld the Zoning Comnittee's
recorrunendation on a vote of 19-0.
This rezoning is scheduled to be heard by the City Council on August 2, 1984.
Please notify me by August 1, 1984, if any member of the City Council wishes
to have slides of the site presented at the public hearing.

F. ZONING HISTORY: The property was zoned "B" Residence prior to 1575, when it was
reclassified R-4.
G. FINDINGS:
1 . Applicant proposes combining twro substandard lots (3,825 sq. ft. and
4,740 sq. ft.) and constructing a two family structure.
2. Land Use Plan policy 4.1-4 states: "On scattered vacant sites in existing
neighborhoods, the city will establish criteria which will allow new housing
development at densities somewhat higher than t�e existing zoning but
compatible with the general existing pattern of development."
3. The Housing Policy Plan recorrnnends alternatives to single f amily
construction.
4. A lot size of 6,000 square feet with frontage of 50 feet is required for RT-1
rezonings. Petitioner's lot is 8,334 square feet in area. The lot has 45'
of f rontage on Winona, and 135' of frontage on Oakdale.
5. The property is in a mixed density neighborhood. There is a 3-unit building
adjoining the site on the east, and RT-1 zoned property across Winona.
6. The proposal is consistent with the comprehensive plan.
7. Secause of the site's severe topography, there will be some difficulty in
developing the prc�erty. It is possible that variances will be requ�red, and
the property will have to undergo site plan review prior to the issuance of
building permits.
8. Petitioner states that he may eventually �rant to split the units doarn the
common wall . This may create yard setback problems.

H. STAFF ANALYSIS: The topographical problems associated with this site need to be
a dresse during the site plan review process. However, it appears that this
same topography means that rezoning this property �rould make development of the
lots more feasible.

recorr�nends approval of the rezoning to P.T-1.

� WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and � 64.210
� of the Legislative Code, Elmhurst Realty, Inc. duly petition to
C�j rezone Lots 4 & 5, Block 1, Belvidere Park Subd. of Lot 2 , Bidwell 's
Addition, located on the northeast corner of Oakdale and Winona,
from R-4 to RT-1 to permit construction of twin-home, the petition
having been certified by the Planning Division on May 16, 1984 as
having been consented to by at least 67� of the owners of the area
of the property to be rezoned, and further having been consented
to by at least two-thirds of the owners of the property situated
within 100 feet of the total contiguous descriptions of real estate
held by the same owner or any party purchasing any such contiguous
property within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on June 7, 1984 conduct-
ed a public hearing for tFie purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative
Code, submitted its r�commendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on June 8, 1984 and rec.ommended that
the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
