1 WHEREAS, the Division of Pazks and Recrearion has prepared a Deer Management Pian
2 for removal of deer from the Pig's Eye Site to take place between January i, 2001 and April 1,

WHEREAS, District 1 has approved the plan for the removal of deer from the Pig's Eye
Site; and
WHEREAS, remova7 of deer is done pursuant to a permit from the State of Minnesota,
Department of Natural Resources, which requires that the City of Saint Paul hold the State of
Minnesota, its officers, agents and empioyees hazmiess from any and ail iiability resuiting from
any activities undertaken pursuant to the pernvt; and
WI3EREAS, all participants in the deer removal are required to sign a waiver and hold
insurance to indemnify the City of Saint Paul; and
WHEREAS, the expenditure of public funds, which includes the promise of
indemnification of the State, for such a purpose, serves a legitimate public purpose; now
therefore be it
RESOLVED, that the Council of the City of 5aint Paul on behalf of the City of Saint Paul
hereby agrees ta hold the State of Minnesota, its officers, agents and employees, harmiess from
any and a11 liability or damages resulting from any activities lawfully undertaken pursuant to the
