Jessamine Avenue described as: Parcel 1 : Lot 1 and 2, except the West 36.0 feet thereof, Block 13, Eastville Heights; and Parcel 2: The West 36.0 feet of Lot Z, Block 13, Eastville Heights; and WHEREAS, the proposed lot split meets all of the requirements of Sections 67.304 and 67.406 of the Zoning Code except minimum lot width and area for the second parcel; and WHEREAS, a variance of the required minimum int width and area can be granted without detriment to the intent of the chapter, the public safety, or neighboring property; . � NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves this lot split, with variances of minimum lot area from 5,000 sq. ft. required to 4,746.96 sq. ft. and minimum lot width from 40 ft. required to 36 ft. for parcel 2. These variances become necessary due to encroachments on Lot 2 by the pres- ent residence located on Lot I. The reduction in size from the platted 40 feet to 36 feet will eliminate these encroachments, and, together with our intent to place the residence more than the minimum 4 feet from the new : property line will insure at least the minimum 8 feet between homes. We have reviewed Sec. 67.703 and feel this action will not be detrimental to the neighborhood, but will, in fact, become an asset.
