PAUL February 28, 1984 Victor Tedesco, Chairman License Committee St. Paul City Council City Hall St. Paul , MN 55102 Dear Victor and Members if the Committee, Last December, the District 14 Community Council requested that the License Committee set a public hearing to consider revocation or suspension of the November 9, 1983 extension of the Tower Tap's on-sale beer and wine licenses into their new storage addition. This request was based on Chapter �10 of the City Code which provides for revocation or suspension of licenses when issuance of such licenses violates city law. Last June, an application was made for a building permit to construct a large addition to the Tower Tap. No Site Plan Review was required as the addition was for storage only and would not be displacing parking. The building inspector's notes show that the addition was not completed until December, 1983. However, on October 26 an application was made for extension of the bar's beer and wine licenses into the not-yet-completed storage area. The extension was approved by the License Committee on November 9, 1983. It is our position that the extension of these licenses should not have been approved. We believe that this addition should not be used for anything other than storage for the bar until such time as �arking is provided for the expanded area. Allowing this bar to expand without providing adequate parking simply because the new space was built as a storage area is in direct opposition to the intent and purpose of the Zoning Code. We do not believe that any business should be able to expand without providing adequate parking by "going the storage area route. " It is our hope that the License Committee will not allow the service of beer and wine in the storage addition at 472 South Snelling. Please note the attached "grounds" for revocation of license for the Tower Tap expansion. Thank you for your consideration of this important matter. Sinc ly, Gayle mmers, Chair Housi and Land Use Committee ����-��� GROUNDS FOR REVOCATION OF LICENSE _ FOR TOWER TAP EXPANSION A. Zoning Code Citation � 1. Section 60.101(11) of the Zoning Code states it is the intent and purpose of the Zoning Code "to lessen congestion in the public streets by providing for off-street parking for motor vehicles and for off-street loading and unloading of commercial vehicles". . 2. Section 60.101(13) of the Zoning Code states it is the intent and purpose of the Zoning Code "to provide . . . for the elimination of nonconforming uses of land". 3. Section 62.103 Subdivision 1 states parking spaces are required at the time of erection or enlargement of any main building. 4. Section 62.103 Subdivision 3 states: "When existing buildings are enlarged, off-street parking shall be provided for the additional usable floor space . . . in accordance with the requirements . . . ". 5. Section 62.103 Subdivision 4 states that existing parking spaces which are required for an existing use can't be removed without being replaced. 6. Section 62.103 Subdivision 6(3) (e) states that establishments for sale and consumption on the premises of beverage, food, or refreshments are required to have one off-street parking space for every 100 square feet of usable floor area. 6. Background/Grounds for Cicense Revocation 1. The 1977 Corr�nercial Inventory Map indicates five (5) parking spaces behind the Tower Tap building. Those five (5) spaces are required parking for the old part of the Tower Tap building. If any of those spaces were displaced by the addition, a building permit should not have been issued without providing for parking spaces to replace the spaces displaced. 2. The Zoning Code requires five (5) parking spaces for a bar addition with 500 square feet of usable floor area. With the five (5) spaces which existed behind the building, the Tower Tap should provide at least ten (10) � off-street parking spaces. 3. The Tower Tap claims to provide thirteen ( 13) off-stre�et parking spaces . However, the five (5) spaces rented from the Highland Park Liquor Store can't count toward Tower Tap's required parking because the operating hours of the two businesses overlap. Section 62.103 Subdivision 5(4) of the Zoning Code permits the dual functior� of off-street parking spaces only when operating hours of buildings do not overlap. There is no evidence that there are eight (8) parking spaces along and behind the bar. If they existed prior to the bar addition all eight (8) spaces would be required parking for the old part of the bar. If they were constructed after the - bar addition, there should be an approved site plan and a building permit. _� ���-��d GROUNDS FOR REVOCATION OF LICENSE � FOR TOWER TAP EXPANSION Page Two B. Background/Grounds for License Revocation, continued 4. Allowing a bar to expand without providing adequate parking simply because the expansion is called a storage addition when building permits are issued is in total and direct opposition to the intent and purpose of the Zoning Code to provide for adequate off-street parking and to eliminate non- conforming uses. Such a cynical interpretation of the Zoning Code provides for the creation of nonconforming uses rat�han their elimination. This interpretation b,y the Zoning Administrator is unconscionable. It shows a callous disregard for the Zoning Code and the people it is intended to protect. The neighborhood should be angry, and it is . If this interpre- tation by the zoning administrator is not overturned it opens a gaping loop- hole in the Zoning Code. The parking requirements of the Zoning Code would be severely compromised. Almost any business could expand without pro- viding adequate parking by "going the storage area route". 5. Some reasonable questions shou�d have been asked by the Building Department before permits for the addition were issued: a. What is the "storage addition" going to be used for? With handicapped- accessible restrooms, direct access to the customer area in bar and other features of the plans, it appears it was always intended to be a bar expansion. b. If new storage space is being constructed will existing storaoe space in the bar be converted to "usable floor area"? If so, parking would be required. c. With such a large storage addition, will it a� l be used as storage for the bar? In fact, the storage addition was to be used for a separate business, a vending machine business, wi�ich is not allowed under the property's B-2 zoning. 6. Section 60.533(1) of the Zoning Code states that all business establish- ments in a B-2 zone shall be retail or service establishments dealing directly with consumers. A vending machine business is first allowed in B-3 under "business sales and service". C. Surranary and Recorrnnendations 1. The vending machine business is not allowed under the B-2 zoning and should be removed from the property. 2. The zoning administrator's interpretation allowing the bar to expand without providing adequate parking simply because the new space is called a storage addition is in direct opposition to the intent and purpose of the zoning � code and should be reversed. This request was based on Chapter 310 of the City Code whicf� provides for revocation or suspension of licenses when issuance of such licenses violates city law. Last June, an application was made for a building permit to construct a large --addition to the Tower Tap. No Site Plan Review ►aas reouired as the addition was for storage only and would not be displacing parking. The building inspector's notes show that the addition was not completed until December, 1983. However, on October 26 an application was made for extension of the bar's beer and wine licenses into the not-yet-completed storage area. The extension was approved by the License Committee on November 9, 1983. It is our position that the extension of these licenses should not have been approved. We believe that this addition should not be used for anything other than storage for the bar until such time as �arking is provided for the expanded area. Allowing this bar to expand without providing adequate uarking simply because the new space was built as a storage area is in direct opposit�on to the intent and purpose of the Zoning Code. We do not believe that any business should be able to expand without providing adequate parking by "going the storage area route. " It is our hope that the License Committee will not allow the service of beer and wine in the storage addition at 472 South Snelling. Section 60.101(11) of the Zoning Code states it is the intent and purpose of the Zoning Code "to lessen congestion in the public streets by providing for off-street parking for motor vehicles and for off-street loading and unloading of co�runercial vehicles". 2. Section 60.101(13) of the Zoning Code states it is the intent and purpose of the Zoning Code "to provide . . , for the elimination of nonconforminq uses of land". 3. Section 62.103 Subdivision 1 states parking spaces are required at the time of erection or enlargement of any main building. 4. Section 62.103 Subdivision 3 states: "When existing buildings are enlarged, off-street parking sha11 be provided` for the additional usable fioor space . . . in accordance with the requirements . . .". , 5. Section 62.103 Subdivision 4 states that existing parking spaces which are required for an existing use can't be removed without being repiaced. 6. Section 62.103 Subdivi,sion 6(.3)(.e) states that establishments for sale and consumption on the premises .of beverage, food, or refreshments are required --�- . to have one off-street parking.space for every 100 square feet of usable floor area. B. Backqround/Grounds for License RevoCation 1. The 1977 Cornmercial Inventory Map indicates five (5) parking spaces behind the Tower Tap building. Those five (5) spaces are required parking for the old part of the Tower Tap building. If any of th�se spaces were displaced by the addition, a building permit should .not have been issued without providing for parking spaces to replace the spaces displaced. 2. The Zoning Code requires five (5) parking spaces for a bar addition aith 500 square feet of usable floor area. With the five (5) spaces which existed behind the building, thes�Tower Tap should provide at teast ten (10) off-street parki ng spaces. �, �y;: _ 3. The Tower Tap claims to provide��Ythirteen (13) off-stre•et parking spaces. . However, the five (5) spaces rented from the Highland Park Liquor Store can't count toward Tower Tap's required parking because the operating hours of the two businesses overlap. Section 62.103 Subdivision 5(4) of the Zoning Code permits the dual function of off-street parkinq spaces only when operating hours of bui]dings do not overlap. There is no evidence that there are eight (8) parking spaces along and behind the bar. If they existed prior to the bar addition all eight (8) spaces would be required parking for the old part of the bar. Background/Grounds for �License Revocation, continued 4. Allowing a bar to expand without providing adequate parking simply because the expansion is called a storage addition when building permits are issued is in total and direct opposition to the intent and purpose of the Zoning Code to provide for adequate off-street parking and to elimi►rate non- � conforming uses. Such a cynical interpret�tion of the Zoning Code provides for the creation of nonconforming uses rat�ier than their elimination. - This interpretation by the Zoning Administrator is unconscionable. It shows a callous disregard for the Zoning Code and the people it is intended to protect. The neigf�borhood should be angry, and it is. If this interpre- tation by the zoning administrator is not overturned it opens a gaping loop- hole in the Zoning Code�. The parking requirements of the Zoning Code would be severely con�romised. Alnrost any business could expand without pro- viding adequate parking by "goi�ng the storage area route". 5. Some reasonable questions should have been asked by the Building Department before permits for the addition were issued: a. Wh�at is the "storage addition" going to be used for? With handicapped- accessible restrooms, direct access to the customer area in bar and �`� . other features of the plans, it appears it was always intended to be a bar expansion. b. . If new stora�e "space is being constructed will existing storage space in the bar be converted to "usable floor area"? If so, parking would be required. c. With such a large storage addition, will it a11 be used as storage for the bar? In fact, the storage addition was to be used for a separate business, a vending machine business, which is not allowed under the property's B-2 zoning. 6. Section 60.533(1I of the Zoning Code states that all business establish- ments in a 6-2 zone shall be retail or service establishments dealing directly with consumers.-�A vending machine business is first allowed in B-3 under "business sales and service". C. Surrmary and Recomnendations 1. The vending machine business is not allowed under the B-2 zoning and should be removed from the property. 2. The zoning administrator's interpretation allowing the bar to expand without providing adequate parking simply because the r�ew space is called a storage addition is in direct opposition to the intent and purpose of the zoning ' code and should be reversed. This request was based on Chaoter 310 of the City Code �,rhich provides for revocation or suspension of licenses when issuance of such licenses violates city 1aw. Last June, an application was made for a building permit to construct a large addition to the Tower Tap. No Site Plan Review ►Nas reouired as the addition was for storage or��y and would not be disolacing parking. The buildir,g inspector's notes show that the addition was not completed until December, 1983. However, on October 26 an application was r�ade for extension of the bar's beer and wine licenses into the no�-yet-completed storage area. The extension was approved by the License Committee on November 9, 2983. It is our position tnat the extension of these licenses should not have been approved. We believe that this addition should not be used for anything other than storage for the bar until such time as parkino is provided for the expanded area. Allot,ring this bar to expand without providing adequate parking sir�ply because the new space was built as a storage area is in direct opposition to the intent and purpose of the Zoning Code. ke do not believe that any business should be abie to expand without providing adequate parking by "going the storage area route. Section 60.101(11) of the Zoning Code states it is the intent and purpose of the Zoning Code "to lessen congestion in the public streets by providing for off-street parking for motor vehicles and for off-street loading and unloading of commercial vehicles" . 2. Section 60.101(13) of the Zoning Code states it is the intent and purpose of the Zoning Code "to provide . . . for the elimination of nonconforming uses of land". � 3. Section 62.103 Subdivision 1 states parking spaces are required at the time of erection or enlargement of any main building. 4. Section 62.103 Subdivision 3 states: "When existing buildings are enlarged, � off-street parking shall be provided for the additional usable floor space . . . in accordance with the requirements . . . " . 5. Section 62. 103 Subdivision 4 states that existing parking spaces which are required for an existing use can't be removed without being replaced. 6. Section 62.103 Subdivision 6(.3)(e) states that establishments for sale and consumption on the premises of beverage, food, or refreshments are required to have one off-street arkin s ace for ever 100 s uare feet of usable P 9 p Y q floor area. B. Background/Grounds for License Revocation 1. The 1977 Commercial Inventory Map indicates five (5) parking spaces behind the Tower Tap building. Those five (5) spaces are required parking for the old part of the Tower Tap building. If any of th�se spaces were displaced by the addition, a building permit should not have been issued without providing for parking spaces to replace the spaces displaced. 2. The Zoning Code requires five (5) parking spaces for a bar addition with 500 square feet of usable floor area. With the five (5) spaces which existed behind the building, the Tower Tap should provide at least ten (10) off-street parking spaces. 3. The Tower Tap claims to provide thirteen ( 13) off-stre•et parking spaces . However, the five (5) spaces rented from the Highland Park Liquor Store can't count toward Tower Tap's required parking because the operating hours of the two businesses overlap. Section 62.103 Subdivision 5(4) of the Zoning Code permits the dual function of off-street parking spaces only wh�n operating hours of buildings do not overlap. There is no evidence that there are eight (8) parking spaces along and behind the bar. If they existed prior to the bar addition all eight (8) spaces would be required parking for the old part of the bar. Code requires the applicant to retain seven existing parking spaces and add eight parking spaces for the building expansion. Therefore the applicant is reguired to provide fif�een par4:in� spa�e� to meet c�de provisior�s if the building exFa��siun is deemed useable floor area. A cursory view of the proposal illustrates the applicant 's intent to provide fifteen spaces. However, four of these spaces do not meet minimum layout dimensions required by code and/or wouTd not be approved by the traffic engineer. Parking space number one must be deleted because the vehicular operator would not be able to back out of that space without crossing the public right of way (sidewalk). Spaces 9 and 10 or 11 and 12 must be deleted or a variance secured because the maneuvering distance between these spaces is 15 feet and the code requires 20 feet. Parking that blocks public access to the liquor store must be removed. At least one space must be removed to provide this access. The ��ity w�ill requi��e 1:hat 1;he rztaining wal i supporting spaces numbered 11 through 15 is designed and constructed under the direct supervision of a structural engineer before they can be approved. In conclusion, the applicant must secure a variance of the minimum number of required parking spaces and a variance of minimum layout dimensions before the City could approve the parking lot. There may be an additional variance required to permit spaces numbered 14 and 15 to be provided as illustrated if it is determined that there is an inadequate space for maneuvering trucks into the northeast corner of the liquor store. Awe, being first duly sworn upon oath, deposes and says: That he is the owner of the premises at 476 South Snelling Avenue in the City of Saint Paul known and described as: Lot 11 , Block 13, Sylvan Park Addition to the City of Saint Paul , according to the recorded plat thereof, of record and on file in the office of Registei• of Deeds in and for Ramsey County, Minnesota, and he acquired the same on the 20th day of December 1971 . See attached Exhibit "A"; That included in the said sale, was an existing building containing an off-sale liquor business known as the Highland Park Liquor Store, and a small single family residence located adjacent to, and immediately north of the said liquor store building; That in 1972, Affiant torn down the single family residence and obtained permission from the City of St. Paul to construct and off-street parking area, with angle parking, on the area previously occupied by the small house. See attached Exhibit "B". That on July 2, 1975, Bernice E. Awe, the wife of Affiant, acquired the commercial building to the immediate north of 476 South Snelling Avenue, known as the Tower Tap, a licensed on-sale beer tavern with a street address of 472 South Snelling Avenue and a legal description of: Lot 10, Block 13, Sylvan Park Addition to the City of St. Paul , except the North 20 feet thereof. See attached Exhibit "C". That thereafter, the premises continued to be leased to third-parties for the operation of an on-sale beer license until 1982 at which time Affiant's son, Donald ' �_ �y-�'�� -2- Awe, took over the operation of the said on-sale beer license and continued to operate the same until present date; That the area lying east of the Tower Tap building was unimproved and was occupied by a walk-in cooler and a dumpster to collect trash; That on June 17, 1983, Affiant, as contractor, on behalf of his wife, Bernice Awe, as owner, applied for a permit to construct a one- story storage area at the rear, or east side, of the Tower Tap building, and received the same on that date; That shortly thereafter, construction commenced and the concrete block foundation was completed on July 17, 1983, flexicore floor on July 29, 1983 and the remaining concrete work on August 23, 1983; That during this period of time, and prior to August 23, 1983, the insulation and dry wall were installed; See attached Exhibits "D", "E", and "F"; That commencing in late September, the said area was used for storage but at that time it was determined that a re- taining wall which had previously been questioned was sufficient to permit basement storage and that thereafter on October 26, 1983, an application was made for the extension of the bar's beer and wine licenses to the recently completed storage area; That following hearings before the License Committee and City Council , the extension of the licenses were approved and Affiant thereupon removed the east wall of the bar and changed the location of a stairway to the basement so as to extend the area of the bar to the east im to what had previously been the storage area; That Affiant, in cooperation with other nearby commercial businesses has investigated the possibility of taking two (2) lots that he owns at the southeast corner of Brimhall and Randolph containing one (1 ) vacant . ��'i';���f�� -3- lot and a single family residence, and creating a parking area; That seven (7) separate sets of plans have been drawn by the Planning Department of the City of St. Paul , some including a single family residence and others not including the same; That the said two (2) lots are separated from the liquor store and Tower Tap by an alley and a third commercial lots fronting on Randolph and lying immediately adjacent to the alley on its east side; That the said third lot is improved with a residentially designed building, but containing several separate businesses; That Affiant has been informed by the office of the St. Paul City Attorney, that if he is to improve the said parking area, and designate it as parking for the Tower Tap, that he would never be permitted to make anyother use of the said two (2) lots, which Affiant is unwilling to do; That although Affiant has been informed and believes that the extension of the beer and wine license to the area that had originally been designated as storage area did not require additional off-street parking, that Affiant is prepared to creat six (6) new parking spaces in the area between the east wall of the Tower Tap and the north-south alley; That to accomplish � this purpose, Affiant is preparing revised plans for the parking area between the 1_iquor store and the Tower Tap building so as to insure that the cars parking to the rear of the Tap would have adequate turning area to enter and exit; That the revised parking area between the liquor store and the Tap would not reduce the number of spaces the parking permit allowed that had been granted in 1972; That it is the intention of Affiant to study further the possible improvement of the two (2) lots owned by Affiant at Brimhall and Randolph , � � �/=�y-�'y� -4- for off-street parking purposes in cooperation with other nearby commercial businesses, but that Affiant does not wish to tie this parking into the Tower Tap so as to forever prevent in the future any other use being made of this property; That Affiant makes this statement by Affidavit because he has recently undergone major surgery and has been informed that it would be medically inadvisable for him to appear at a public meeting in an emotionally stress- ful situation.
