WHEREAS, Daniel and Beverly Oren have applied to the Board of Zoning
Appeals for a variance from the strict application of the provisions of Section
61 .101 (f) of the Saint Paul Legislative Code pertaining to the minimum lot area

property located at 1977 Marshall Avenue, legally described as the West 10 feet

WHEREAS, Following a public hearing with notice to affected property owners,
the Board of Zoning Appeals by its Resolution 9536 adopted April 10, 1984 granted
the variance petition so as to permit four dwelling units on the above described
property based upon the findings as set forth in the said resolution; and
WHEREAS, Pursuant to the provisions of Section 64.205, William and Mary
Anderson, 1969 Marshall Avenue, Saint Paul , Minnesota, duly filed with the City
Clerk their appeal from this determination made by the Board of Zoning Appeals
requesting that a hearing be held before the City Council for the purpose of
considering the actions taken by the said Board; and
WHEREAS, Acting pursuant to Sections 64.205 and 64.208 and upon notice to
appellant and other affected property owners a public hearing was duly conducted
by the City Council on h1ay 3, 1984 where all interested parties were given an
opportunity to be heard; and
WHEREAS, The Council having heard the statements made, and having considered
the variance application, the report of staff, the minutes and findings of the
Board of Zoning Appeals, does hereby
RESOLVE, That the Council of the City of Saint Paul does hereby modify the
decision of the Board of Zoning Appeals in this matter and does hereby approve
and grant an area variance for the subject property located at 1977 Marshall
Avenue, Saint Paul , Minnesota, legally described as the west 10 feet of Lot 8
and all of Lot 7, Block 27, Rearrangement of Merriam, so as to permit the use

Dear Sir:
On March 27, 1984, the Board of Zoning Appeals held a public hearing on an
amended application of Daniel and Beverly Oren to permit a 4-unit apartment
building at 1977 Marshall . The ariginal application for variance requested
permission to establish six units on the lot. Daniel Oren outlined his
proposal and answered questions from Board members.
Four individuals testified in opposition to the variance. They felt that
granting the variance would contribute to overcrowding, traffic congestion,
as well as set an adverse precedent for the comnunity. The hearing was
closed and the case was discussed by members of the Board. A motion to
approve the variance as amended passed on a vote of 6 to 1.
William and Mary Anderson filed an appeal of the Board of Zoning Appeals
decision on April 16, 1984. The appeal is based on six points outlined in
their letter of appeal (see attachment).
This matter is scheduled to be heard by the City Council on May 3, 1984.

ihe purpose of this letter is to set forth the grounds for our appeai of
the April 10, 1984 decision of the Board of Zoning Appeals regarding the
conversion of 1977 Marshall Avenue into a 4-plex by Dan and Beverly Oren.
We believe the Board of Zoning Appeals erred for the following reasons:
l. The intent of the 10,000 sq. ft. area requirement is to provide
adequate space for the multi-family building, off street parking,
and yard space on one lot. 1977 Marshall only has 9,090 sq. f t. ,
� which includes 600 sq. ft. of the alley. Furthermore, the Board of
Zoning Appeals required 6 off street parking spaces (2 in the garage,
4 next to the garage) . The measurement between the garage and the
neighbor's property line is approximately 37 feet. With the 4 foot
setback requirement the developeYS do not have enough room to add
4 off street parking spaces. Thus, the development will be in violation '
of the Board's April lOth resolution.
2. The request for variance is not based on circumstances unictue
to the individual property. The lot size and topoqraphy are similar
to other lots in the neighborhood.
3. Without the variance, the owner would not incur exceptional
practical difficulties or hardship. The structure could reasonably
be used as a triplex or duplex.
4. The variance is being requested to defray the cost of remodeling/
converting the structure to a more intensive use, and assuring a
substantial profit margin. The request for variance, therefore,
appears to be based primarily on a desire for economic gain, which is
contrary to the Minnesota zoning enablincs act. Furthermore, the claim
of "financial hardship" should only be used for those owners who are,
in fact, poor and cannot afford required improvements.
5. The City should enforce zoning regulations in an even-handed,
consistent manner to protect the residential character of the neighborhood. T
However, the Board ot Zoning Appeals' April lOth decision is not
consistent with a decision of theirs in June of I982: In Zoning Case
#9184, 1985 Marshall Avenue, which is directly across the side street,

5. cont. , the applicant requested a variance of 2,425 sq. ft.
The granting of this variance would have allowed a triplex on a 7,575
sq. ft. lot. P.E.D. staff recommended denial and the Board did deny
the variance, thus, only allowing a duplex. In other words, the Board
determined that 2,525 sq. ft. of lot per unit at 1985 Marshall was not
adequate. Rather, the Board only allowed a duplex with 3,787.5 sq. ft.
of lot per unit. Now, less than two years later, the P.E.D. sta�f and
the Board of Zoning Appeals determine that 2,272 sq. ft. of lot per unit --
is adequate. Why is there such a discrepancy?
6. The variance request is not in keeping with the intent of sparit
of the Code, and is inconsistent with the health, safety, comfort, morals
and welfare of the residents of the neighborhood. We are deeply concerned
about overcrowding and congestion in our area, with its related parking,
trash and noise problems. These problems often focus around the presence
of absentee-owned multiple dwellings. This one block alone has 28 dwelling
units not including the property in question. Nine of the twelve buildings
on the block are owner-occupied, sinqle-family homes (7) and duplexes (2) .
We are deeply concerned that, while residents and the Merriam Park Co�anunity
Council have encouraged code compliance in Merriam Park, we are not receiving
support at the City level. Zoning Codes were adopted to protect the neighbor-
hoods from abuse. Refusing to enforce the existing Zoning Codes is to turn
your back on the neighborhoods, and our efforts to stop blight and deterioration.
Therefore, we request that the City Gouncil review and revoke the April 10, 1984
decision of the Board of Zoning Appeals.

DANIEL AND BEVERLY OREN (9536): Request for variance to permit a

The applicants were present. 7here was oppasition present at the hearing.
This matter r�tas laid over from P9arch 13, ��II4 to allow ti�ne f�r the -
applicant to submit additional information.
Mr. Haider showed slides of the site and revie�ved the staff report. The
applicants have amended the request for variance and site pian to de�ete
the carriage house krith related rear and side yard variance as V:ell as to
reduce the number of apartment units in the main structure to four units.
Staff recommended approval of the request for variance as a�nended. Two
letters tdere received in opposition. ,
Daniel Oren stated that when they presented their original p7an to the
corr�nunity there was strong objection to the carriage hause. After meetinq
with staff it was determined that 4 or 5 units would be feasible. 8ecause
of overcrowding, staff sug�ested 4 units with six off-street parking
spaces. Whei� the revised proposal was presented to the Merriam �'ark
Corr�nunity Council , they had different objections. The dis�rict wanted on7y
3 units with 3 off-street parking spaces, ta�a in the garage and one additional
space. He explained that the City was supporting development of rental
property and designated money for rehabilitating the house as a mu�tti-unit
rental structure. Their proposal would upgrade the ne9ghborhood, increase
the value of homes in the area, provide more livable units and increase the
City tax base.
Peter Olin, 1899 P�arshall , representing h1erriam Park, presented a ietter
stating their support for a 3-unit apartment building with 3 off-street
parking spaces. The community's opposition to the intensified use included
on-street parking problems, increased traffic in an already overused a�1ey,
noise problems from a high density building, absentee ownership af the
proper�y, the use of $35,000 at 2� rental rehab money form the City to T
undertake the conversion, and in June of 19$2 the 8oard of Zoning Appeals
supported thz P�lerriam Park Cor�munity Council 's opposition to allowing a
third unit at 1985 Marshall Avenue, which is directly acrcSss the street.
Michael Spreigl , 1966 Tglehart, spoke in opposition. Ne stated that if
property is not maintained, the owner should pay the price at the time
the property is sold. It appears that the City would be fznancing the

capitol gain �ro�i the sale of the p;operty. Given the size of the bactc
yard, if the p•roposed parking vrer� allowed, it would reduce the value of
the adjacent properties. He spoke iri favor of the structure �eing used as
a group home because it would not have the turnover and there would be some
consistency in the neighborhood.
Mary Anderson, 1969 Marshall , testified in opposition stating that the area �
should be maintained as a family neighborhood. She did not fezl the
applicants were completely honest with the community.
There was discussion regarding the previous use of the 5tructure.
Ms. Lane reparted that because the house had been used as a commurrity
residential facility, the status as a rooming house has ceased. If the
applicants wanteJ to reestablish the prev-ious r�oming house, they w�uld

WHEREAS, Danie� and Leverly Oren have applied for a variance from the
strict application of the provisions of Section 61 .101(f) of the St. Paul
Legislative Code pertaining to minimum lot area required for multi-family
��r�uctures in the RM-2 zoning district; and
WHEREAS, the Saint Paul Board of Zoning Ap�eals conducted a public hearing
on P�arch 27, 1984, pursuant to said appeal in accordance r�ith the require-
mer�ts of Section 64.2U4 of the Legislative Code; and _
4�lHEREAS, the Saint Paul Board of Zoning Appeals based upon evidence
presented at the public hearing, as substantially reflected in the minutes,
made the following findings of f act:
1 . The applicants amended the request f or variance and site plan to delete
a carriage house with related rear and side yard variance as well as to
reduce the number of apartment units in the main structure. The �
applicants propose to restore and remodel the subject property and
change the use of the building from a former 11-unit rooming house and
group home to four residential apartments.
2. Without variance, the applicants will incur hardship based on the
unique physical condition of the property. The building is in blighted
and deteriorated condition requiring rehabilitation with costs that
nearl,y equal the f air market value of the existing building. It
appears that the extraordinary costs associated with rehabilitating
this previously placarded building prevent development in accordance
H�ith the strict provisions of the code.
3. The variance request is in keeping with the intent and spirit of the
code and is consistent with the health, safety, comfort, morals and
welfare of the inhabitants of the City of St. Paul .
The code "recognizes the existence of older residential areas of the
city where larger houses can be converted in vrder to extend the
economic life of these structures and allow the owners to justify the
expenditures for repairs and modernization." This is precisely what
the applicant is proposing for this building constructed in 1905.
The code requires a minimum lot area to provide adequate open space on
the site for the recreational and parking needs of inhabitants of the
building. This intent is met if the applicant provides six parking
spaces as illustrated on the amended site plan. Six parking spaces
conform to modern zoning standards for four residential units.
4. The proposed variance will not impair an adequate supply of light and
air to adjacent property, nor will it alter the essential character of
� the surrounding area.
5. Granting the variance will not permit any use that is not permitted in
the RM-2 (moderate density multi-family) zone, nor would it alter or
change the zoning district classification of the property.
6. The request for variance does not appear to be based primarily on a =
desire for economic gain.

the past as an eleven unit aprtment building,
and as a group home, it requires a great deal
of renovation to m�ke it habitable. The City
of St . Paul has , however , made it possible to
renovate this building by designating $35 , 000
of 2% rehab money, which must be matched by
the owner and which must be used to create rental
property, additional parking and shelter. With-
out the city money, any sizeable renovation proj-

The Merriam Park Community Council has met twice to discuss the variance
request of Dan and Beverly Oren to convert 1977 Marshall Avenue to a 4-plex. °
At each of the meetings approximately twenty neighbothood peaple came
to discuss the conversion proposal with the Orens.
After two hours of discussion, at the last meeting, the Housing Committee
unanimously voted to support the conversion of 1977 Marshall Avenue into a 3-unit
structure with three parking spaces � (2 in the existing garage and Z alongside -
the garage) . The group believed there should be one unit on the first floor,
second floor, third floor, and none in the basement.
The community's opposition to the intensified use included on-street
i
parking problems, due to the nearby church, increased traffic in an already
overused alley, noise problems from a high density building, absentee ownership
of the �roper*,i, the use cf. $35,OOq at 2$ �?ntal rehab rn�zey fx�m the City to
undertake the conversion, and i.n June of 1982 the Board of Zoning Appeals
supported the bierriam Park Community Council's opposition to allowing a third
unit at 1985 Marshall Avenue, which is directly across the street (the v.ariance
was for a three family unit with 7,075 square feet) .
The neighbors believe three larger units wouid lend themselves to
occupancy by elderly tenants, due to the adjacent transit line and the single
family residential character of the neighborhood.

This letter is to voice my opinion on Daniel and Beverly Oren�s

I am opposed to allowing this variance because I feel it will have �
a negative impact on the surrounding residental area .
With four rental units there will be additional traffic . With
two grade schools less then 1� blocks away this presents a
potential danger for the children of the neighborhood. Since
there is limited parking on Marshall Avenue there will be a
shortage of parking spaces . Y feel it is important the area
maintains its association as a neighborhood of families and
that every structure is not turned into a rnultiple unit buildiRg .
Buiidings that are not owner occupied tend to cause problems in
the area and therefore I feel any building that is allowed to
have more than one unit in this area should be owner occupied.
