An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462.357 and §64.210 of the Legis-
lative Code, Pearl L. .Potthoff duly petitioned to rezone Lot 3, Knocke & Aicheles
Subdivision, located at 933 Mound Street, from R-4 to RT-1 to permit conversion
of a single family house to a duplex, the petition having been certified by the
Planning Division on March 9, 1984 as having been consented to by at least 67%
of the owners of the area of the property to be rezoned, and further having been
consented to by at least two-thirds of the owners of the property situated with-
in 100 feet of the total contiguous descriptions of real estate held by the same
owner or any party purchasing any such contiguous property within one year pre-
ceding the date of the petition; and
WHEREAS, The current Zoning Committee on April 5, 1984 conducted a public
hearing for the purpose of considering the rezoning petition, and pursuant to
Section 107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on April 13, 1984 and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
April 21 , 1984 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought
to be rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted
on May 3, 1984 where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore, .

Dear Sir:
On April 5, 1984 the Zoning Comnittee of the Planning Commission held a
public hearing on this rezoning. Petitioner was represented and the purpose
of the rezoning was explained. There was no other testimony. At the close
of the public hearing, the Zoning Committee voted 5 to 0 to recommend
approval of the rezoning to RT-1.
On April 13, 1984 the Planning Corrmission reviewed the Zoning Comnittee's
recommendation and upheld it on a vote of 16 to 0.
This rezoning is scheduled to be heard by the City Council on May 3, 1984.
Please notify me by May 2 if any member of the City Council wishes to have
slides of the site presented at the public hearing.

hearing. •
Ms. James showed slides of the site and reviewed the staff report with a
recommendation for approval . One letter was received in support.
Clayton Potthoff, 1091 Goodrich, representing the applicant, stated that
the property has been owner--occupied for appraximately 75 years. The
building has been used as a duplex for the past 30 years with the exception
of shared bath faeilities. The rezoning will formalize the duplex use,
ensure its continuance and enable the current residents to stay in the
structure. He further stated that they received 1009' support from the
neighborhood.
Hearing no further testimony, Mr. Pangal closed the public hearing pnrtion
of the meeting.
Mr. Levy moved approval based. on findings 1 through 7 of the staff report.
Ms. Summers seconded the motion, which passed on a ro11 cali vote of
5to0.

G. FINDINGS:
1 . Applicant proposes converting this structure into two dwelling units. The
building has been essentially used as a duplex for the past 30 years,
according to petitioner, with the exception of shared bath f acflities.
Petitioner seeks the rezoning in order to formalize the duplex use and ensure
its continuance. The conversion will also enable tRe current residents to
stay in the structure.
2. The St. Paul Land Use Plan, policy 4.1-5, states: °The City wi11 establish
criteria to allow sensitive reuse and conversion of existing housing
structures. The criteria will address density, lot characteristics,
structural characteristics, parking, open space and neighborhood impact."
3. The Planning Commission has established guidelines to implement poticy 4.1-5.
4. The lot size must be 6,000 square feet with frontage of 50 feet.
Petitioner's lot has 80 feet of f rontage and over 8,OOO ,square feet.
5. The ro erty should be located in a mixed density neighborhood. There are

6. Gross living area of the house after conversion of 1,840 square feet is
required. According to tax records, the ground area of �the building is
968 square feet. The area for both stories would therefore be 1 ,936 sq. ft.
7. Two off-street parking spaces are required. Currently, •there is a garage at
the rear of the site with space for one car. A wider door on the garage
would enable two cars to use the existing garage. There is also room on the
lot for a parking space next to the garage. Petitioner has stated that they
will provide the additional space.
