Preliminary and Final Plat Approval for East Maryland Clinic
WHEREAS, Maryland Real Estate Investments has submitted for City Council approval the attached preliminary and
final plat for subdivision of property at 905-911 E. Maryland Avenue, along the north side of Maryland between Forest
Street and Mendota Street, into two commercial lots; and
WHEREAS, the appropriate City departments have reviewed the plat and found that it meets the requirements of
Chapter 67 of the Zoning Code; and
WHEREAS, notice of a public hearing before the City Council was duly published in the official newspaper of the
City and notices were mailed to each owner of affected property including all property situated within 350 feet of the
subject property; and
WHEREAS, the City Council held a public hearing on the proposed plat on September 27, 2000, where all interested
parties were given the opportunity to be heard and the Council considered all the facts and recommendations
concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and
final plat for East Maryland Clinic at 905-971 E. Maryland Avenue, along the north side of Maryland between Forest
Street and Mendota Street, subject to the condition that the applicant shall file a copy of the Council Resolufion
approving the plat with the Ramsey County Recorder's Office.

E. ZONING CODE CITATION: Section 67301 states that platting is required when a
subdivision is for previously unplatted land. Section 67.406 gives criteria for the review o£
subdivision applications. These criteria are covered below under "Required Findings: '
F. HISTORY/DISCUSSION: The Board of Zoning Appeals, in 1993 (Zoning File 93-132),
granted a variance to aIlow 13 parking spaces that back out onto the alley behind the garden
center site 905 E. Maryland to serve Maryland Clinic at 911 E. Maryland. A site plan was
subsequently approved for this parking, as well.

A. REQITIRED FINDINGS:
1. All the applicable provisions of the Legislative Code are being complied with.
The plat would create a 23 ft. wide by 125 ft. long extension of proposed Lot 2 along the
alley behind proposed Lot l. The only likely future use for this nanow lot appendage is
the existing 13 pazkittg spaces that back out onto the alley. This does not conform with
§ 62.104 (7) o£ the Zoning Code, which requues that access to any paridng space for a
use other than one- or two-family structures shall be provided by a maneuvering lane.
However, the Boazd of Zoning Appeals, in 1993 (Zoning File 93-132), granted a
variance to a11ow this use. The proposed plat would only tend to make this
nonconforming parking layout more permanent.

_.-§ 67.508 (� Lot access of the Zoning Code Subdivision Regularions states, "Lots sha11
not, in general, derive access exclusively from an arterial: ' The purpose of this is to
avoid unsafe access to and from arterials with high traffic volumes and speeds. On the
other hand, § 62.104(9)(fl of the Zoning Code discourages alley access &om non-
residential parldng lots when there is residentially-zoned land across the alley except in
unusual condirions such as where altemarives to alley access aze unsafe due to tr�c •
volumes and traffic speeds.
Proposed Lot 1 would have access exclusively from Maryland, which is classified as an
"A" minor arterial, and thus may not fully comply with § 67.508 (fl of the Code. On the
other hand, based on § 62.104(9)(f j of the Code, alley access from this lot should not be
allowed unless it is determined that altematives to alley access are unsafe due to high
traffic volumes and speeds. The proposed plat has been reviewed by Public Works staff,
who have expressed no objections to the exclusive access to Lot 1 from Maryland.
City staff have reviewed the proposed plat and have determined that all other applicable
provisions of city codes are met.
2. The proposed subdivision will not be detrimental to the present and potential
surrounding land uses. The proposed subdivision basically creates two separate lots
for two existing uses. It will not be dehimental to present and future use of surrounding
land.
The area surrounding the su6division can be planned aud developed in
coordination and compatibility with the proposed subdivision. The azea sunounding
the proposed plat, as well as the area of the plat itself, is already developed.
4. The subdivision is in conformance with the Comprehensive Plan. This subdivision is
in conformance with the City's land use plan, which calls for commercial uses that serve
the immediate neighborhood in locations along bus routes.

The subdivision preserves and incarporates the site's important natural features,
whenever possible. The site has been developed for many yeazs, and most of the site is
paved. The purpose of the proposed plat is to divide the site into two separate parcels for
ownership purposes, and will not change how the site is developed.
6. AlI land intended for building sites can be used safely without endangering
residents by peril from flood, erosion, continuously high water table, severe soil
conditions or other menace. This finding is met. The site has been used for
commercial and office uses for many years.
The subdivision can be economically served with public facilities and services. The
subdivision is served with public facilities and services from Maryland Avenue.
I. S'�AFF RECOMMENDATION: Based on required findings 1 through 7 above, staff
recommends approval of the final plat submitted by Maryland Real Estate Investments for East
MaryIand Clinic at 905-9ll E. Maryland Avenue, on the north side of Maryland between Forest
and Mendota, subject to the condition that the applicant shall file a copy of the Council
Resolution approving the plat with the Ramsey County Recorder's Office.

Preliminary and Final Plat Approval for East Maryland Clinic
WHEREAS, Maryland Real Estate Investments has submitted for City Council approval the attached preliminary and
final plat for subdivision of property at 905-911 E. Maryland Avenue, along the north side of Maryland between Forest
Street and Mendota Street, into two commercial lots; and
WHEREAS, the appropriate City departments have reviewed the plat and found that it meets the requirements of
Chapter 67 of the Zoning Code; and
WHEREAS, notice of a public hearing before the City Council was duly published in the official newspaper of the
City and notices were mailed to each owner of affected property including all property situated within 350 feet of the
subject property; and
WHEREAS, the City Council held a public hearing on the proposed plat on September 27, 2000, where all interested
parties were given the opportunity to be heard and the Council considered all the facts and recommendations
concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and
final plat for East Maryland Clinic at 905-971 E. Maryland Avenue, along the north side of Maryland between Forest
Street and Mendota Street, subject to the condition that the applicant shall file a copy of the Council Resolufion
approving the plat with the Ramsey County Recorder's Office.

F. HISTORY/DISCUSSION: The Board of Zoning Appeals, in 1993 (Zoning File 93-132),
granted a variance to aIlow 13 parking spaces that back out onto the alley behind the garden
center site 905 E. Maryland to serve Maryland Clinic at 911 E. Maryland. A site plan was
subsequently approved for this parking, as well.

A. REQITIRED FINDINGS:
1. All the applicable provisions of the Legislative Code are being complied with.
The plat would create a 23 ft. wide by 125 ft. long extension of proposed Lot 2 along the
alley behind proposed Lot l. The only likely future use for this nanow lot appendage is
the existing 13 pazkittg spaces that back out onto the alley. This does not conform with
§ 62.104 (7) o£ the Zoning Code, which requues that access to any paridng space for a
use other than one- or two-family structures shall be provided by a maneuvering lane.
However, the Boazd of Zoning Appeals, in 1993 (Zoning File 93-132), granted a
variance to a11ow this use. The proposed plat would only tend to make this
nonconforming parking layout more permanent.

_.-§ 67.508 (� Lot access of the Zoning Code Subdivision Regularions states, "Lots sha11
not, in general, derive access exclusively from an arterial: ' The purpose of this is to
avoid unsafe access to and from arterials with high traffic volumes and speeds. On the
other hand, § 62.104(9)(fl of the Zoning Code discourages alley access &om non-
residential parldng lots when there is residentially-zoned land across the alley except in
unusual condirions such as where altemarives to alley access aze unsafe due to tr�c •
volumes and traffic speeds.
Proposed Lot 1 would have access exclusively from Maryland, which is classified as an
"A" minor arterial, and thus may not fully comply with § 67.508 (fl of the Code. On the
other hand, based on § 62.104(9)(f j of the Code, alley access from this lot should not be
allowed unless it is determined that altematives to alley access are unsafe due to high
traffic volumes and speeds. The proposed plat has been reviewed by Public Works staff,
who have expressed no objections to the exclusive access to Lot 1 from Maryland.
City staff have reviewed the proposed plat and have determined that all other applicable
provisions of city codes are met.
2. The proposed subdivision will not be detrimental to the present and potential
surrounding land uses. The proposed subdivision basically creates two separate lots
for two existing uses. It will not be dehimental to present and future use of surrounding
land.
The area surrounding the su6division can be planned aud developed in
coordination and compatibility with the proposed subdivision. The azea sunounding
the proposed plat, as well as the area of the plat itself, is already developed.
4. The subdivision is in conformance with the Comprehensive Plan. This subdivision is
in conformance with the City's land use plan, which calls for commercial uses that serve
the immediate neighborhood in locations along bus routes.

The subdivision preserves and incarporates the site's important natural features,
whenever possible. The site has been developed for many yeazs, and most of the site is
paved. The purpose of the proposed plat is to divide the site into two separate parcels for
ownership purposes, and will not change how the site is developed.
6. AlI land intended for building sites can be used safely without endangering
residents by peril from flood, erosion, continuously high water table, severe soil
conditions or other menace. This finding is met. The site has been used for
commercial and office uses for many years.
The subdivision can be economically served with public facilities and services. The
subdivision is served with public facilities and services from Maryland Avenue.
I. S'�AFF RECOMMENDATION: Based on required findings 1 through 7 above, staff
recommends approval of the final plat submitted by Maryland Real Estate Investments for East
MaryIand Clinic at 905-9ll E. Maryland Avenue, on the north side of Maryland between Forest
and Mendota, subject to the condition that the applicant shall file a copy of the Council
Resolution approving the plat with the Ramsey County Recorder's Office.

Preliminary and Final Plat Approval for East Maryland Clinic
WHEREAS, Maryland Real Estate Investments has submitted for City Council approval the attached preliminary and
final plat for subdivision of property at 905-911 E. Maryland Avenue, along the north side of Maryland between Forest
Street and Mendota Street, into two commercial lots; and
WHEREAS, the appropriate City departments have reviewed the plat and found that it meets the requirements of
Chapter 67 of the Zoning Code; and
WHEREAS, notice of a public hearing before the City Council was duly published in the official newspaper of the
City and notices were mailed to each owner of affected property including all property situated within 350 feet of the
subject property; and
WHEREAS, the City Council held a public hearing on the proposed plat on September 27, 2000, where all interested
parties were given the opportunity to be heard and the Council considered all the facts and recommendations
concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and
final plat for East Maryland Clinic at 905-971 E. Maryland Avenue, along the north side of Maryland between Forest
Street and Mendota Street, subject to the condition that the applicant shall file a copy of the Council Resolufion
approving the plat with the Ramsey County Recorder's Office.

Maryland Real Estate Investments has submitted an application for preliminary and &nal plat approval
for subdivision of property at 905-911 E. Maryland, on the north side of Maryland between Forest and
Mendota, to create two commercial lots to provide for sale of one of the Iots to separate owners.
Attached are the staff report and the preliminary and final plat for your consideration. Subject to the
condition recommended below, this application meets all subdivision requirements and staff
recommends approval of the final plat.

E. ZONING CODE CITATION: Section 67301 states that platting is required when a
subdivision is for previously unplatted land. Section 67.406 gives criteria for the review o£
subdivision applications. These criteria are covered below under "Required Findings: '
F. HISTORY/DISCUSSION: The Board of Zoning Appeals, in 1993 (Zoning File 93-132),
granted a variance to aIlow 13 parking spaces that back out onto the alley behind the garden
center site 905 E. Maryland to serve Maryland Clinic at 911 E. Maryland. A site plan was
subsequently approved for this parking, as well.

A. REQITIRED FINDINGS:
1. All the applicable provisions of the Legislative Code are being complied with.
The plat would create a 23 ft. wide by 125 ft. long extension of proposed Lot 2 along the
alley behind proposed Lot l. The only likely future use for this nanow lot appendage is
the existing 13 pazkittg spaces that back out onto the alley. This does not conform with
§ 62.104 (7) o£ the Zoning Code, which requues that access to any paridng space for a
use other than one- or two-family structures shall be provided by a maneuvering lane.
However, the Boazd of Zoning Appeals, in 1993 (Zoning File 93-132), granted a
variance to a11ow this use. The proposed plat would only tend to make this
nonconforming parking layout more permanent.

_.-§ 67.508 (� Lot access of the Zoning Code Subdivision Regularions states, "Lots sha11
not, in general, derive access exclusively from an arterial: ' The purpose of this is to
avoid unsafe access to and from arterials with high traffic volumes and speeds. On the
other hand, § 62.104(9)(fl of the Zoning Code discourages alley access &om non-
residential parldng lots when there is residentially-zoned land across the alley except in
unusual condirions such as where altemarives to alley access aze unsafe due to tr�c •
volumes and traffic speeds.
Proposed Lot 1 would have access exclusively from Maryland, which is classified as an
"A" minor arterial, and thus may not fully comply with § 67.508 (fl of the Code. On the
other hand, based on § 62.104(9)(f j of the Code, alley access from this lot should not be
allowed unless it is determined that altematives to alley access are unsafe due to high
traffic volumes and speeds. The proposed plat has been reviewed by Public Works staff,
who have expressed no objections to the exclusive access to Lot 1 from Maryland.
City staff have reviewed the proposed plat and have determined that all other applicable
provisions of city codes are met.
2. The proposed subdivision will not be detrimental to the present and potential
surrounding land uses. The proposed subdivision basically creates two separate lots
for two existing uses. It will not be dehimental to present and future use of surrounding
land.
The area surrounding the su6division can be planned aud developed in
coordination and compatibility with the proposed subdivision. The azea sunounding
the proposed plat, as well as the area of the plat itself, is already developed.
4. The subdivision is in conformance with the Comprehensive Plan. This subdivision is
in conformance with the City's land use plan, which calls for commercial uses that serve
the immediate neighborhood in locations along bus routes.

The subdivision preserves and incarporates the site's important natural features,
whenever possible. The site has been developed for many yeazs, and most of the site is
paved. The purpose of the proposed plat is to divide the site into two separate parcels for
ownership purposes, and will not change how the site is developed.
6. AlI land intended for building sites can be used safely without endangering
residents by peril from flood, erosion, continuously high water table, severe soil
conditions or other menace. This finding is met. The site has been used for
commercial and office uses for many years.
The subdivision can be economically served with public facilities and services. The
subdivision is served with public facilities and services from Maryland Avenue.
I. S'�AFF RECOMMENDATION: Based on required findings 1 through 7 above, staff
recommends approval of the final plat submitted by Maryland Real Estate Investments for East
MaryIand Clinic at 905-9ll E. Maryland Avenue, on the north side of Maryland between Forest
and Mendota, subject to the condition that the applicant shall file a copy of the Council
Resolution approving the plat with the Ramsey County Recorder's Office.
