(2) The proposed recycling center is compatible with existing uses in the area and the additional development will be of a similar character. OPPOSITION: Letter from Department of Natural Resources stating their position and suggested changes. Dear Sir: On February 16, 1984 the Zoning Corrnnittee of the Planning Commission held a public hearing on this Special Condition Use Permit. The applicant was present and explained his proposal . There was no other testimony. At the close of the public hearing, the Committee considered the requirements of city codes, federal government standards, and the recor►mendation of the Department of Natural Resources. A motion to deny the permit failed on a vote of 2 to 2, and the application went to the full Planning Commission without recommendation. On Feburary 24, 1984 the Planning Comnission considered this application. After their discussion, they voted to deny the permit on a vote of 12 to 3. On March 5, 1984 the Zoning Office received an appeal of the Planning Commission's decision. The grounds for the appeal include the following: (1 ) A substantial amount of money has already been spent on equipment; (2) Access would be difficult if the building were required to be raised; and (3) The requirement that Barge Channel Road be elevated if this industrial area is platted would create a hardship for existing uses and would make railroad access difficult or impossible. • . . . �� �y- �y� . z . . Eventually they plan to eatilize the railroad pro�erty and to slo�e the land t��vard the railr�ad tracks would des�roy tFe use of that property. Ms. Jam�s reported that the Port Autharity is in th� prc�cess of plattfng the Southport industrial district and one of the reguiremerrts of the subdivisian regulation� is that the road be elevated. If the permit were approved, the elevation of the road could create a prablem for the applicant. Measures shall be taken to minimize interference with normal plant operations during anticipated periods of flooding." F. FINDINGS: 1 . Applicant proposes constructing a storage building in which he will conduct a recycling business. Recyclables will be brought to the site by the applicant's rubbish hauling business. Space for individuals to drop off recyclables will also be available. 2. Applicant proposes recycling of oil as well . Storage of petroleum products in the flood fringe is not permitted under the State Building Code reguTations unless the container is buried and constrained. 3. Ground elevation at this site is 702.5: The regulatory flood protection elevation (R�PE) is 707.5' . Construction on this site must be floodproofed to the RFPE either by elevating the site on fill (a permitted use) or by using approved floodproofing techniques (a special condition use) . . . _. _._ ,.. . . , � . . . , g �� � `� 9 . , JOHN C. MUDEK (#9521 ) Page 2 4. Applicant proposes using FP-4 floodproofing measures. He has submitted an evacuation plan which is being reviewed by the Minnesota Department of Natural Resources. 5. The City of St. Paul parLicipates in the National Flood Insurance Program regulated by the Federal Emergency Management Agency (FEMA) . FEMA regulations do not recognize FP-4 floodproofing techniques for purposes of the program. . 6. St. Paul 's River Corridor Regulations have not been in compliance with FEMA regulations and have recognized FP-4 floodproofing as an approved floodproofing method. On January 19, 1984 the City Council appraved - amendments to the Zoning Code that bring St. Paul into compliance with the federal standards. ��� 7. Under FEMA standards, variances permitting floodproofing other than FP-1 or FP-2 may only be granted on parcels one-half acre or less in size upon a deter.mination of hardship, and when granting the variance will not threaten public safety, result in extraordinary public expense, create a nuisance, etc. • G. FACTORS CONSIDERED: The Planning Commisson must consider 14 factors in passing upon con it�ona use permits. 1 . The relationship of the proposed use to the Comp:^ehersive Plan and Floocl Plain Managernent Program for the City. . The Comprehensive Plan recommends labor intensive uses for ihdustrial areas and river-related bulk commodity storage and transfer as a primary �se in the Southport industrial area. The Flood Plain Management Program recorr�nends construction of buildings so that they are safe from flooding. Applicant's build�ng will be susceptible to flooding. 2. The importance of the services provided by the propased facility to th�� corr�nun i ty. Recycling of glass , metal , and paper is a valuable service; however, applicant's use appears to be mainly for I�is ov�n t,us:ness. 3. The compatibility of the proposed use with existing development anticipated in the foreseeable future. � The recycling center is compatible with existing uses in the. area. Additional development will probably be of a similar character. However, future development may very well be elevated on fi11 and not require a � special condition use. When Southport i,s platted, Barge Channel Road wi11 have to be elevat�d on fill as well . •' � 4. The ability of the existing topography, soils, and geology to support and accommodate the proposed use. The proposed use is similar to other uses which the soils and geology support. 5. The compatibility of the proposed use with�existing characteristics of biologic and other natural communities. The proposed use appears compatible with existing natural corrvnunities. 6. The proposed water supply and sanitation systems and the ability of� these systems to prevent disease, contamination, and unsanitary conditions. It appears the site will not be served by sewer or water. 7. The requirements of the f acility for a river-dependent location if applicable. The safety of access to the property for ordinary vehicles. Access during times of flood will be by boat only. 9. The susceptible of the proposed f acility and its contents to flood damage and the effect of such damage on the individual owner. The proposed facility and contents are not susceptible to flood damage with the exception of the oil . 10. The dangers to life and property due to increased flood heights or velocities caused by encroachments. If the structure is not elevated, it will not increase flood heights or " � velocities. -.,� 11 . The expected heights, velocity, duration, rate of rise, and sediment transport of the flood waters expected at the site. The height of the 100-year flood is approximately 706 feet; velocities in the floodfringe are generally low; the duration and rate of rise will vary. 12. The danger tMat materials may be swept onto other lands or downstream to the injury of others. The building contents would very likely be swept downstream if the evacuation is not comp�leted on time or is not thorough. 13. The availability of alternative locations or configurations f or the proposed � use. The proposed use could be located in other I-1 or I-2 districts that are not . in the floodplain, or the structure could be elevated on fill . 14. Such other f actors as are relevant to the purposes of this chapter. • The other relevant factor is FEMA's authority to suspend the City's fload insurance program eligibility for f ailing to adequately enforce floodptain management regulations meeting their minimum standards. - H. STAFF ANALYSIS: Recycling businesses are permitted uses in industrial districts. However, t e nature of the recycling business, with so many loose materials, seems inappropriate for a flood-prone site. It seems more reasonable to require that the site be elevated on fill rather than depend on an evacuation plan. In addition, approving the FP-4 floodproofing standards seems inconsistent with federal regulations and with the intent of the City's Flood Management Program and the newly adopted floodplain regulation. I. I currently operate 5 trucks on a 7-day a week basis. Tne principal part of the business is servicing ap�rtment buildingw, shopping cent.ers and restaurants, About 75� ot the business is the apartment complexes which is about 350 to 375 buildings. The apartments are _ serviced on a difterent basis, from once a day to once a week. The second largest are the shopping centers and restaurants w hich are serviced 7-days a week, 354 days a year. The volume of trash that is taken to the landfiZl daily is about 35 � tons. The recycling center that I am proposing will not recycle all rubbish because some of the rubbish is not possible to recycle. Th.�s applies to that from tne restaurants because they are total waste and rubbish from most homes because of yard waste, owner-maintained gardens, pets and absence of garbage disposals. Tne prime source of the recycled material wiI.l be from the shopping centers arid aparrments. It is e5��inatec] about 25 �cns wi�l be going through the recycl ing center which will consist of aluminum, tin cans, glass, newspaper, cardboard and white ledger paper. The paper material will be bailed and loaded on semi-trailers and transported to Champion International Corporation daily. The aluminum and tin cans including heavy metals will be loaded on roff-off boxes and transported to Great 'Western Iron daily. The glass material will be sorted on-site by color and loaded into roll-off boxes. It is estimated that 3 to 5 boxes of glass per week will be transported to Brockway Glass Company. Ninety-five percent of the estimated 25 ton waste gen�rated daily will be rec�cled. I have enclosed a 30 year land lease pro�ection for the 1 .8 acre site East of the existing District Heating operation. Under terms of the lease the land rent would be renegotiated every five years during the original or any extended terms. As I indicated yesterday becaus� of the fact the site is in the flood plain it will be necessary for you to apply to the City of St. Paul for a conditiunal use permit to erect a structure in the flood plain before any construction commences. The flood plain ordinance requires that the floor of any building be raised so that it equals the level of record flood in the area. The ground elevation of the si.te is approximately 700'-702' and record flood is approximately 706` , thus, fill material woutd have to be brought to the site to elevate the flaor, I would suggest that you contact Rick Wiederhorn of the City Planning and Economic Development Department - 292-1577 - regarding the procedure that you will have to go through to obtain a special use permit to construct a building. We will be sending out an ENS notice to the local neighborhood on FridaX, January 20 to notify them that the proposed land lease would be submi�ted to our Commission on February 21 for consideration. Based upon my review, I offer the following comments: -This proposal is not consistent with the zoning text amendments which were required by Federal Regulations and should have been in effect bynow. Section 65.223 was amended to state, in part, that "Structures flood-proofed to FP-3 or FP-4 classification shall not be permitted. " Considering the ordinance amendment, the applicant should be app_lying for a variance. To maintain consistency with Federal Regulations, the variance should meet the requirements contained in Chapter I-Federal Emergency Manage- ment Agency � 60.6 (copy previously sent to you). -Although state regulation will allow for use of wet fload-proofing techniques (FP-3 or FP-4), we will only support such techniques when all other methods of elevating the lawest floor have been shown to be infeasible or where a hardship can be proven. -If the City allows this request, the applicant must provide certif i- cation by a registered engineer or architect that the building is designed and constructed in accordance with the flood-proofing standards contained in the State Building Code (SBC) . If the permi= i� grant�d, conditiol� �nus± be rsquired to ene•;r� that storage of material be limited to those items which are not damage- able by flood waters or to items which can be readily evacuated within the flood warning time. PATRICIA JAMES February 14, 1984 Page Two -If the applicant can meet City, state, and federal standards ' for hardship and the City allows this use, a flood warning and evacuation plan must be required as a condition of the permit. -The flood warning and evacuation plan which was submitted by Mr. Mudek is basically adequate but should be amended as follows: 1) The National Weather Service (U.S. Weather BureauJ River Forecast Center should be contacted weekly (at a minimum) � during flooding season and probably daily if flooding has been predicted for St. Paul. , 2) A phone number for the National Weather Service River Forecast Center (725-3091) and the Corps of Engineers (725-7584) should be listd on the Flood Evacuation Schedu).e. 3) The flood warning and evacuation plan should contain a requirement that all responsible staff review the plan at least once a year. As I have stated on previous requests of this type, we strongly encourage the City to take a. comprehensive )_ook.. at how you intend to deal with uses or expansion of uses below the regulatory flood protection eleva- tion. This is a serious issue and it should be carefully considered. Continued granting of variances by the City for such uses will threaten your eligibility in the National Flood Insurance Program. If the City continues to allow uses or expansion of uses below the regulatory f lood protection elevatio�n, we strongly urge you to consider appointing a flood warning and evacuation coordinator to ensure proper enforcernent.
