1 WHEREAS, the McGough Construction Company, is in need of a temporary construction easement on
2 City owned properry in connection with the exterior renovation of the Saint Paul Cathedral, said
3 easement area is ouflined on the attached map referenced as Exhibit "A" , a copy of which is on file in
4 the Department of Technology and Management Services, Real Estate Division in the file known as
5 2000-X-3,and

WHEREAS, the City of St. Paul, Department of Parks (Parks) is the owner of the above mentioned
property in Exhibit "A" as stated 'an the St. Paul Parks and Recreation Commission's Resoluuon
Numbered 00-9, adopted November 8th 2000, a copy of which is attached hereto; and

WHEREAS, Parks concurs, as mentioned in the above ResoluUOn Numbered 00-9, that the
12 McGough Construction Company enter into a temporary construction easement agreement with the City
13 of St. Paul and just compensation be paid to Parks as determined by an independent appraiser; so

THEREFORE BE IT RESOLVED, that the proper City officials are hereby authorized and directed
to enter into an temporary construction easement agreement with the McGough Construcuon Company,
their successors and assigns; and
FURTHER RESOLVED, that just compensauon for said the said temporary easement be paid by the
McGough Construction Company, its successors or assigns and deposited into the Pukland Replacement
Fund and held in reserve for purchase of Pazk proper[ies as required in Chapter 13.01.1 of the City
Charter and that any other costs incurred by the City of St. Paul to complete this agreement shall be fully
compensated by McGough Construction Company its successors or assigns.

VJHEREAS, the Saint Paul Parks and Recreation Commission is an appointed
body to advise the Mayor and City Council on long-range and city-wide matters related
to Parks and Recreation; and
WHEREAS, the Saint Paul Division of Parks and Recreation is the owner of
certain parks property bounded by Dayton Avenue, John Ireland Boulevard and Marshall
Avenue, adjoining the Saint Paul Cathedral; and '
WHEREAS, McGough Construction Company is the contractor for an exterior
renovation of the Saint Paul Cathedral consisting of a new roof, cleaning the exterior,
and tuckpointing; and
WHEREAS, McGough Construction Company has requested the use of the pazk
property described herein for a period not to exceed 30 months to provide an area for
pazking, materials storage and construction staging; and
WHEREAS, McGough Construction Company is willing to enter into a temporary
construction easement agreement with the City, including provisions for fencing siTe
during construction, regular cleanup, insurance, total restoration upon compietion and
payment to the Division of Parks and Recreation for its use of the site; and
WHEREAS, the granting of said temporary construction easement will have no
long term adverse effect on the park site; now, therefore,
BE IT RESOLVED, that the Saint Paul Pazks and Recreation Commission
concurs with the proposed temporary construction easement requested by McGough
Constr�ction Company, and in accordance with City Charter Section 13.01.1
recommends approval by the City Council.
