Hogan , Assistant City ttorney DATE: May 7, 1984 RE: Claim against the City of St. Paul by Lloyd Harris Mr. Harris brought an action in replevin against the City for return of his car, License No. MFC 025, which had been towed by the City for violation of an ordinance. After two hearings before the Honorable John J. Kirby, a compromise between the parties was reached, and an Order directing the City to return the car was issued by the Court. Prior to the date of the Order, and unknown to either party, the car had been auctioned at a public auction and a bona fide sale to a third party was made. Becanse of the outstanding court order, a compromise settlement of $1, 080, re- presenting the value of the car, was made and accepted by Nir. Harris in full settlement of his claim.
