WHEREAS, the City of Saint Paui is a Member of the Lower Mississippi Watershed Management
Organization (LMWMO); and
WHEREAS, the LMWMO's joint powers agreement expired on December 31,1999; and
WHEREAS, the purpose of the LMWMO is to protect and enhance water quality resources within
the watershed.
Now, therefore, be it RESOLVED, that the City of Saint Paul approves the amendment to the
LMWMO's joint powers agreement extending the agreement through January 1, 2002; and
Be it FURTHER RESOLVED, that the Mayor, and Assistant City Attorney are authorized to sign
said agreement on behalf of the City of Saint Paul.

Council File 85-1564) expired on December 31, 1999. T'he LMWMO is currendy developing their watershed
management plan and will renegotiate their joint powers agreement upon the completion and approval of that
plan. The attached resolution extends the agreement until7anuary 1, 2002.

FOR TFIE LOWER MISSISSIPPI RIVER WATERSHED
THE PARTIES TO THIS AGREEMENT are members of the Lower Mississippi River
Watershed Management Organization. This amendment is made pursuant to the authority
conferred upon the parties by Minn. Stat. Sections 471.59 and 473.875, et sea•
1. EXISTING AGREEMENl'. The existing Joint Powers Agreement for the
Lower Mississippi River Water Management Organization is incorporated
herein and shall remain in fuli force and effect, except as specifically amended
by this Agreement.
2. PARAGRAPH 11, SUBDIVISION 1 of the Joint Powers Agreement is
amended to provide:
Each member agrees to be bound by the terms of this Agreement until
January 1, 2002, and it may be continued thereafter upon the agreement of all
the parties.
3.` EFFECTIVE DATE. This agreement shall be in full force and effect when all
existing members approve and sign this Agreement. All members need not sign
the same copy.
IN WITNESS WHEREOF, the undersigned governmental units, by action of their
goveming bodies, have caused this Agreement to be executed in accordance with the
authority of Minn. Stat. 471.59.

WHEitEAS, the Dakoca Counry Board of Commissioners has notified the member communities of
rhe Lower Mississippi River Watershed Manasement Organization that they wili be obligated under state
starute to petirion the Minnesota Boazd of Water and Soil Resources to fo*m a Watershed Disttict in a
watershed cnanagement orgatrization where a Joint Powers Agreement is not in place, and
WEiEREAS, a Watershed District established by Dakota County under these circumstances would
be granted taxing authority within the member communities, and
tiVHEREAS, the Lower Mississippi River Watershed Management Organizatioa has reviewed starm
water matters and implemented numerous projects to resolve many intercommunity storm water issues
within the member communiries through improvement projects or studies funded under the Joint Powers
Agreement of the Lower Mississippi River Wacershed Management Organizarion, and
yVHEREAS, the Lower Mississippi River Watershed Management Organization is in the process of
developing a second generation Watershed Management Plan; and
WfiEREAS, the Minnesota Boazd of Water Resources has granted the Lower tifississippi River
Watershed Management Organization an extension until 2d01 to complete this second generation Watershed
Mana�ement Plan; and
V4��REAS, the Lower Mississippi River Watershed Management OrganiZation member
communities of Mendota Heights, West St. Paul, South St. Paul, Inver Grove Heights, Sunfish Lake and
Lilydale have determined it is in their best interest to extend the 7oint Powers Agreement until 7anuary 1�`
2002, and have taken formal action to execute its extension; and
�VIIEREAS, the Ciry of Mendota Heights has deemed it imperative and desirabie to maintain local
control over iniciatives and funding mechanisms related to intercorununity storm water issues; and
NOW THEREFOI2E BE TT HE�$Y �SOLVED, by the City Council of the City of Mendota
Heights that we encourage the Ciry of St. Paul to approve and execute an extension to the Lower Mississippi
River Watershed Management Organization Joint Powers Agreement; and
BE TT FURTAER RESOLVED, that ihe Ciry of Mendota Heights encourages the Ciry of Sc. Paul
to approve and execute an extension to the Joint Pov.�ers Agreement of che I.ower Mississippi River
Watershed Management Organization at their earliest convenience.

2. PARAGRAPH 11, SUBDIVISION 1 of the Joint Powers Agreement is
amended to provide:
Each member agrees to be bound by the terms of this Agreement until
January 1, 2002, and it may be continued thereafter upon the agreement of all
the parties.
3.` EFFECTIVE DATE. This agreement shall be in full force and effect when all
existing members approve and sign this Agreement. All members need not sign
the same copy.
IN WITNESS WHEREOF, the undersigned governmental units, by action of their
goveming bodies, have caused this Agreement to be executed in accordance with the
authority of Minn. Stat. 471.59.

WHEitEAS, the Dakoca Counry Board of Commissioners has notified the member communities of
rhe Lower Mississippi River Watershed Manasement Organization that they wili be obligated under state
starute to petirion the Minnesota Boazd of Water and Soil Resources to fo*m a Watershed Disttict in a
watershed cnanagement orgatrization where a Joint Powers Agreement is not in place, and
WEiEREAS, a Watershed District established by Dakota County under these circumstances would
be granted taxing authority within the member communities, and
tiVHEREAS, the Lower Mississippi River Watershed Management Organizatioa has reviewed starm
water matters and implemented numerous projects to resolve many intercommunity storm water issues
within the member communiries through improvement projects or studies funded under the Joint Powers
Agreement of the Lower Mississippi River Wacershed Management Organizarion, and
yVHEREAS, the Lower Mississippi River Watershed Management Organization is in the process of
developing a second generation Watershed Management Plan; and
WfiEREAS, the Minnesota Boazd of Water Resources has granted the Lower tifississippi River
Watershed Management Organization an extension until 2d01 to complete this second generation Watershed
Mana�ement Plan; and
V4��REAS, the Lower Mississippi River Watershed Management OrganiZation member
communities of Mendota Heights, West St. Paul, South St. Paul, Inver Grove Heights, Sunfish Lake and
Lilydale have determined it is in their best interest to extend the 7oint Powers Agreement until 7anuary 1�`
2002, and have taken formal action to execute its extension; and
�VIIEREAS, the Ciry of Mendota Heights has deemed it imperative and desirabie to maintain local
control over iniciatives and funding mechanisms related to intercorununity storm water issues; and
NOW THEREFOI2E BE TT HE�$Y �SOLVED, by the City Council of the City of Mendota
Heights that we encourage the Ciry of St. Paul to approve and execute an extension to the Lower Mississippi
River Watershed Management Organization Joint Powers Agreement; and
BE TT FURTAER RESOLVED, that ihe Ciry of Mendota Heights encourages the Ciry of Sc. Paul
to approve and execute an extension to the Joint Pov.�ers Agreement of che I.ower Mississippi River
Watershed Management Organization at their earliest convenience.
