WI�EtE'AS, the Council of the City of Saint Paul by Council Resolution,
C. F. No. 229628, adopted July 27, 1966, did vacate certain sections of
public street and public alley located in the City of Saint Paul, and
specifically c�scribed in said resolution; and
WHEREAS, said vacation reserved to the City of Saint Paul and other
public instrumentalities, public utility easements estabalished for the
purpose of installation, maintenance and operation of any sewer, water, gas
or electric main, pipe or conduit of a public instrumentality located and
aontained in said area; and
WHEREAS, the Council has been requested by the Housing and
Redevelopnent Authority to waive these retained easements; and
W�S, the affected City Departments, Northern States Power Company,
Northwestern Bell Telephone Company and Western Union have filed written
Certificates of Intended Non-use with the Office of the City Clerk, which
release in part all easements on said property, said Certificates
inoorporated herein by reference; and
NOW THEREFORE BE IT RESOLVED, pursuant to Section 130.06 of the Saint
Paul Legislative Code and on behalf of the City of Saint Paul and those
persons for whom the City has reserved easements, the Council of the City of
Saint Paul does hereby waive arxl release in part the retained easements in
the vacated public property as specified in the Certificates of Intended
Non-use.

WI�2EAS, The Council of the City of Saint Paul by Cbuncil Resolution,
C.F. 229628, adopted May 16, 1969 did vacate certain public land and
retained vertain easements in said vacated land; said vacated land was
subsequently acquired by the Housing and Rec7evelapment Authority. The legal
description of said vacated land is as follaws:
All of the alleys in Block 10 and 11,
Rioe Street Villas
Wf�E�S, In order to cleaz title to a portion of said vacated land the
. � Housing and Redevelopment Authority requested waivers of easements retained
on behalf of the Water Utility City of St. Paul, the Department of Public
Works City of Saint Paul, Western Union Company, Northern States Power
Company and Northwestern Bell Telephone Company in a p�rtion of said vacated
land; the easement to be waived is described as follows:

lying between the extensions across it of the
South line of Lot 15, said Block 11, extended

21.16 feet of Lot 8, extended Westerly.
WHERE'AS, The Council of the City of Saint Paul by resolution, Council
File 84-599, adopted May 10, 1984, did waive said easements but failed to

include a legal description of the land to which they applied and was
therefore unrecordable;
NOW Tf�RF�EORE BE IT RE50LVID, That Council Resolution, Council File 84-
599 is hereby rescinded in its entirety; and

BE IT FURTHER RESOLVED, That pursuant to Section 130.06 of the Saint
Paul Legislative Code and on behalf of the City of Saint Paul and those
persons for whom the City has reserved easements, the �il of the City of

Clerk is hereby authorized and directed to transmit a copy of this
resolution for recording to the office of the Register of Deeds, Ramsey
County, Minnesota.

vacation of part of Milton Street et 1-35E and Jefferson
Avenue for the purpose of providing additional off-
street parking.

2. 5/8/84 FINAL ORDER: To decide on the construction of a storm
sewer in Timberlake Road from Jackson Street to 427 feet
East. '

sewer service connections in Springside Drive from Point
Douglas Road to Burlington Road for the following
properties: Lots 8 and 4, Block 7, Burlington Heights

Burlington Heights Division #2, Also, Parcel #02-01400-
040-05 (2184 Springside Drive).

4. 5/8/84 F[NAL ORDER: To decide on improving the following
streets under the Residential Street Paving Program by
regrading. surfacing, constructing concrete curb &
gutter, an ornamental lighting system and drives where
necessary:
FARRINGTON ST. from Thomas to Como; BLAIR AVE. from
Western to Elfelt; VAN BUREN AVE. from Western to
Virginia; VAN BUREN AVE. from Farrington to Elfelt and
