'+�� a . 3 , Council Resolution � ,-,-► Presented By �--="' � � ' r Referred To � Committee: Date Out of Committee By Date WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota ("HRA") is desirous of vacating a portion of public right-of-way, as follows: Virginia Street, lying between the extensions across it of the South right-of-way line of Dayton Avenue and the North right-of-way line of Selby Avenue; and WHEREAS, the City of Saint Paul ("City") is fee owner of Easterly land adjoining said street; and WHEREAS, the petition to vacate must be executed by 51% of the owners abutting said street; and WHEREAS, the City and HRA allege this vacation is in the vital and best interests of the City, and will allow development to continue i.n the Selby/Western Area by using this and adjoining lands for construction of approximately 110-135 stalls of parking for future commercial development; and WHEREAS, the Easterly half of said vacated street will accrue to City-owned property adjoining, and is needed for aforesaid development, HRA has requested that City quit-claim its interest to it upon proper vacation thereof; NOW THEREFORE, be it resolved by the Co�.cil of the City of Saint Paul, as follows: 1. That the proper officers of the City be and are hereby directed to execute the Petition to Vacate said portion of Virginia Street. 2. That upon public hearing and proper vacation thereof, the City shall, by quit- claim deed and without consideration therefor , convey its right title and interest in the Easterly half of said vacated street to the HRA for its de- velopment. XXI T0: THE HONORABLE COUNCIL PRESIDENT and MEMBERS OF THE CITY COUNCIL . Your Petitioners, the Housing and Redevelopment Authority of the City of Saint Paul , Minnesota (HRA) and City of Saint Paul (City) , respectfully state and allege they are the fee owners of record of the real estate abutting that certain part of a street described as follows, to-wit: Virginia Street, lying between the extensions across it of the South right-of-way line of Dayton Avenue and the North right-of-way line of Selby Avenue. Prime Petitioner HRA, pursuant to the provisions of the City-Wide Redevelop- ment Plan , adopted and approved by the Council of the City of Saint Paul on October 28, 1981 , Council File No. 277600, states the proposed Street vacation is required for development of the Selby-Western area to include approximately 110-135 stalls of parking for future commercial development, as well as ancillary parking for the adjoining City Park. Co-Petitioner, City of Saint Paul joins with said HRA to vacate that portion of the above described public street in order to achieve the objectives of the said Redevelopment Plan . Your Petitioners herein request that the provisions of the Saint Paul Legislative Code, Chapter 130, codified March 1 , 1981 , pertaining to the reser- vations of easements , rights and other claims for the installation or maintenance and operation of any sewer, water, gas, telephone or electrical main , pipe or conduit of public instrumentality for the City of Saint Paul and for other persons or corporations having public instrumentalities in the vacated portion of land be waived upon presentation to and approval by the City Council of statements of intent to abandon and not use utility and other public easements in the aforesaid portion of land.
