- RESOLVED, that upon execution and delivery of a release in
full to the City of Saint Paul, the proper City officers are hereby
authorized and directed to pay out of the Tort Liability Fund
09070-511-000 to Donald Michalec the sum of $1, 677 . 50 in full
settlement of his claim for damages sustained February 22, 1981,
to his property located at 428 Wabasha as a result of the e�ecution
of a search warrant by the St. Paul police.

RE: Claim against the City of St. Paul by
Donald Michalec
On February 22 , 1981, St. Paul police executed a search warrant
at 428 Wabasha, upon allegations that the premises were being used
as an after-hours establishment. During the search, physical
damage was done to the building and to rental equipment and fixtures
in the building.
An investigation of the damages was made; after crossmatching
both the police record of damages and the plaintiff ' s claimed
damages, a total of $1, 677 . 50 of damages remained beyound what
would reasonably occur in the execution of a search warrant.
The plaintiff has agreed to settle for that amount.
