WHEREAS, St. Anthony Associates applied to the Board of Zoning
Appeals for a variance from the strict application of the provisions
of Section 62. 103 (3) of the Saint Paul Legislative Code pertaining
to required parking standards in a B-2 zoning district for their
property located at 2264-2276 Como Avenue and 2239 Carter Avenue ;
and
WHEREAS, Following a public hearing with notice to affected
property owners the Board of Zoning Appeals by its Resolution No .
9499 adopted January 10, 1984 granted the variance so as to allow
the construction of a 380 sq. ft. of office space at the said
property on the condition that a two hour parking zone be estab-
lished on Carter Avenue between Keston Street and Como Avenue and
that all construction shall be in accordance with the application
for variance and the site plan on file with the St . Paul Planning
Division; and
WHEREAS, St. Anthony Associates has appealed the decision of
the Board of Zoning Appeals to the City Council requesting that the
City Council rescind the condition requiring two hour parking
restrictions on Carter Avenue; and
WHEREAS, The City Council having heard the matter at a public
hearing held for that purpose on January 26, 1984, and having con-
sidered the matter does hereby
RESOLVE, That the Council of the City of Saint Paul does hereby
grant the appeal of St. Anthony Associates and does hereby rescind
the condition imposed by the Board of Zoning Appeals requiring the
two hour parking restriction on Carter Avenue; and, be it
FURTHER RESOLVED, That a copy of this resolution shall be
mai.Zed by the City Clerk to St. Anthony Associates , the Zoning
Administrator, the Board of Zoning Appeals and the Planning Commission.

At our business meeting on January 17, 1984, members present voted
unanimously to instruct me to inform you of their support for the
appeal of the condition included in the Zoning Board approval of the
Saint Anthony Park Associates parking variance application.
It is the feeling of our membership that the construction in question
will have, at most, a minimal impact on the parking situation in our
area. The building contractor for whom office space is to be provided
is a valued member of our business community as a source of jobs and
-.necessary services in our area, and we recognize that the space is
necessary for the viability of their operation.
� Our group has been aware that there is a parking related problem in our
area, and our efforts to deal with it have been intensified as a result
of the hearings in connection with the variance requeste
� However, we hope you will remove the condition which, in our opinion,
speaks to a problem that actually is not particularly related to the
construction in question.

City Council Hearing: January 26, 1984
PURPOSE: To consider an appeal of a Board of Zoning Appeals decision
requiring a 2-hour parking restriction on Carter between
Como Avenue and Keston Street as a condition to granting a variance
of the minimum off-street parking spaces required to expand
a commercial building.
BOARD OF ZONING APPEALS DECISION: Grant variance on the condition that a
2-hour parking restriction be placed
on Carter Avenue (5-1 ) .
STAFF RECOMMENDATION: Deny variance.
SUPPORT: District 12 supported variance with conditions attached.
OPPOSITION: Three people testified (one person withdrew opposition
and supported proposal with conditions) .
Dear Sir:
On December 13, 1983, the Board of Zoning Appeals opened a public hearing
on a request for variance of a Zoning Code provision that requires three
parking spaces be provided to expand an office building by 650 square feet.
Staff recorrr�nnended the variance be denied because granting the variance
would overcrowd the site and increase traffic congestion.
The Board reviewed the staff report and correspondence on the matter,
solicited testimony from the applicant and neighbors, as well as a
representative of the District 12 Planning Council . District 12 requested
the matter be laid over to December 27 to allow time for the applicant,
neighbors and District Council to confer on the matter. The Board laid the
matter over on a vote of 6 to 0.
On December 27, 1983, the public hearing was reopened. The District
Council , neighborhood and appellant indicated agreement that a variance of
2 spaces to permit construction of 380 sq. ft. addition should be approved
if a 2-hour parking restriction were extended to include all of Carter
Avenue between Como Avenue and Keston Street. The Board discussed the
condition and made it clear that the variance is void if arrangements to
restrict parking to two hours were not complete.

On January 9, 1984, St. Anthony Associates appealed the Board's decision
contending that (1) the condition of variance approval related more to a
general comnunity land use problem than to a reasonable requirement to
permit a small business expansion; and 2) proper consideration was not
given to a proposal to reduce the size of the building expansion and
reducing the variance request.
This matter is scheduled to be heard by the City Council on January 26,
1984. Please notify me by January 25 if any member of the City Council
wishes to have slides of the site presented at the City Council public
hearing.

SAINT ANTHONY ASSOCIATES: Request for variance of required parking to
expan an office building at 2264-2276 Como Avenue.
The applicant was present. 7here was opposition present at the hearing.
Mr. Maider showed slides of the site and reviewed the staff report with a
recommendation for denial . One letter was received in support.
Jim Gillespie, representing St. Anthony Associates, stated that they are
proposing a very small addition to accommodate the needs of the existing
tenant, the Transformed Tree. They need additional space for display,
office and storage of material . The business is both an employer of
individuals in the area and a supplier of services of value to the
community. He stated they would be very interested in supporting any kind
of proposal to increase aarking in the St. Anthony Park area.
Mary Slind, owner and operator of the Villa Sportswear Shop, 2278 Como,
testified in opposition stating that until the parking problem in the
business area of North St. Anthony Park is addressed and resolved, the
� proposed building plan was premature.
Peter Mann, 2249 Carter, stated opposition on the basis that District 12
. did not have an opportunity to review the proposal , and as a resident of
the area, he requested the opportunity to meet with the St. Anthony Park
Business Merchants ' Association to develop an alternate proposal addressing
the parking issue. He presented a letter from David and Joyce Perrin,
2253 Carter, in opposition.
Robert Bjorndahl , 2282 Como, concurred with the opposition expressed by
Ms. Slind.
Hearing no further testimony, Mr. Grais closed the public hearing portion
. of the meeting.
Mr. Haider reported that Ann Copeland from District 12 requested the matter
be laid over for two weeks to allow time for the District to review the
proposal .
Ms . Summers moved to lay the matter over to December 27, 1983 and reopen
the public hearing. Mr. Peterson seconded the motion, which passed
unanimously.

Joseph Michels, 2183 Hendon, reported that they have arranged to lease the
adjacent parking lot which had been used by the Fuller Company. This will
provide approxima�ely 20 parking spaces. District 12 also agreed to work
with the City in an effort to have a 2-hour parking restriction posted on
Carter Street . He stated �that they have changed their proposal to a
1-story building which will lower the variance request to 2 off-street
parking spaces instead of three.
Richard Slind, 2278 Como, presented a letter stating that if the proposed
� expansion is kept to a single story, its architectural lines reflect an
extention of the general architecture of their shop front, and the current
plans to alleviate the parking situation zre carried through, they would
. support the variance.
Mary Ann Milton, President of Milton Investment Co. , Como and Carter,
stated the if they are able to lease the Fuller parking lot and the 2-hour
parking restriction on Carter is obtained, she would support the proposal .
Mel Thome, President of the Transformed Tree, the company in question that
will be occupying the space, reported that they need the expansion for
office space for existing personnel . They have no iniention of hiring
additional people that would require addition parking spaces in the

� WHEREAS, St. Anthony Associates has applied for a variance from the strict
application of the provisions of Section 62.103(3) of the Saint Paul
Legislative Code pertaining to required parking standards in the 6-2 zoning
district; and
WHEREAS, the Saint Paul Board of Zoning Appeals conducted a public hearing
on December 13, 1983, pursuant to said appeal in accordance with the
. requirements of Section 64.204 of the Cegislative Code; and
WHEREAS, the Saint Paul Board of Zoning Appeals based upon evidence
presented at the public hearing, as substantially reflected �in the
minutes, made the following findings of fact:
1 . The property in question cannot be put to a reasonable use without a
variance.
2. Without a variance, the landowner will incur hardship by reason of
circumstances unique to the property.
3. The variance is in keeping with the spirit and intent of the code.
4. The variance will not impair neighboring property if a 2-hour parking
zone were continued along Carter Avenue corrmencing from a point 167 '
southwest of the intersection of Como Avenue and Carter southwesterly
to the intersection of Carter and Keston Street.
5. The variance would not permit any use of land that is inconsistent with
the B-2 zone.
6. The request for variance does not appear to be based primarily on a
� desire for economic gain.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Board of Zoning Appeals
. that the provisions of Section 62.103(3) be hereby waived to allow
construction of 380 sq. ft. of office space .at 2264-76 Como Avenue, 2239
Carter Avenue on the condition that there be a two (2} hour parking zone
established on Carter Avenue between Keston Street and Como Avenue; and all
construction in accordance with the application for variance and the site
plan on file with the St. Paul Planning Division.

or alteration of a building or off-street parkinq facility shall
be valid for a period lonqer than one year, unless a building
� permit for such erection or alteration is obtained within such

l�cation, the Traneformed Tree, a contractor occupying space
in our building, needs additional s�ace for display, office ar, d
for atorage of materials. This business ie both an er�ployer
of individuals in the area and a su�,plier of se-vices of
value to �u� area. Their being required to set up business
else�rhera would result in a s�nificant loss both to the
� bueinees and to o�ir commurlity.
The Bibelot Shop also needs space in vrhich ta sture
merchandise that is receivad. As a l�cal employer and a
provider of a needed service , t�eir loss w�uld also be
detrimental to the comrnunity.
b. The greater �art of the businees of the Tranaformed
Tree is carried oixt at the premises of their customers thua
minimizin� the need for parking they generate. The added
space in que�tion will aimply allow a more efiicient use of
their present etaff.
, The addition itself will be built in s portion of a

To Whom It May Concern :
As owner of the building located at 2278 Como , and Owner
Operator of the Villa Sportswear Shop located at the same
address , I have the following observations/concerns regarding
the proposed expa•nsion plans immediately adjacent �o my shop .
l . That the finished product not be a detraction/deterrant
to my front entry which opens on the rear of the building .
� 2 . That the mess and distraction of construction not deter
� from the introduction of Spring lines and their subsequent
sales .
3 . That the parking situation , already intolerable , will
not become worse .
4 . That the finished product and it ' s tenants will not be
detremental to the intrinsic worth of either 2278 Como
or the Villa Sportswear Shop .
I have had meetings with representatives of the owner group that
proposes this expansion and they have allayed my fears to the
best of their ability while still going ahead with the plans .
It is my feeling that if the proposed expansion is kept to a
sinQle story , and it ' s lines reflect an extension of the general
architecture of my shop front , and the current plans to alleviate
the parkin9 situation are carried through to fruition , that
