x����LVED, That upon petition of Hubbard Broadcasting, Inc. that
sec�ioaz of public street hereinafter described, be and the same hereby
is vacated and discontinued as public street ;
All that part of Charles Avenue which lies southeasterly
of the west line of Auditor's Subdivision No . 9,
St. Paul , Minnesota and northwesterly of a line located
thirteen (13) feet west of and parallel to the east
line o� Lot 10, Auditors Subdivision No , 9 , St. Paul ,
iKinnesota.
s�bject expressly to the following conditions and reservations :
1 . That the vacation be subject to all terms and conditions of
Chapter 130, codified March 1, 1981 , of the St . Paul Legislative Coc?e ,
as amended.
2 , That a specific easement be retained to protect the interests
of Northern States Power Company within the vacated area.
3 . That a specific easement be retained to protect the interests
of Northwestern Bell Telephone Company within the vacated area.
4. That the petitioner pay to the City of St. Paul the sum of
$7,000. 00 as fair market compensation for the vacation.
5 . That by Petitioner's acceptance of the terms and conclitions
of this vacation, the Petitioner agrees and acknowledges that the City
has a right to require payment of the above stated compensation, Further,
petitioner waives its right to object to the City's requireme�t that a
fair market compensation be paid as a condition of this vacation and
waives its right to challenge the compensation issue in court .
6 . That the petitioner, its successors or assigns by acceptance

from all suits , actions , or claims of any characterr including but not
limited to a claim brouoht because of any injuries or damages re-
ceived or sustained by any person, persons or property, on account of
this vacation; or because of any act or omission,neglect or misconduct
of said petitioner, or because of any claims or liability, arising
from or based on any violation of any law or regulation made in accordance
with the law, whether by the petitioner or any of its agents or employees .
