WHEREAS, Specialty Management Corporation has requested an interpretation
of the zoning district boundary location at 966 Manvel Street; and
WHEREAS, Section 60.302 paragraph 6 of the Saint Paul Zoning Code provides
a method for the City Council to make such interpretation by resolution
upon recomnendation of the Planning Comnission; and
WHEREAS, the Zoning Comnittee of the Planning Commission held a public
hearing on October 6, 1983, and also examined appropriate records from the
Division of Housing and Building Code Enforcement, the Ramsey County
Assessor, and the files on this area from the 1975 citywide rezoning and
determined that the property should be zoned R-4; and
WHEREAS, the Planning Corrmission has reviewed the Zoning Comnittee's
recommendation and has approved the determination that 966 Manvel should be
in the R-4 zoning district;
NOW, THEREFORE, BE IT RESOLVED, that the City Council determines that the
zoning district boundary follow the southeasterly property line of
966 Manvel Street so that the lot described as the westerly 40 feet of
Lot 9, Block 60, St. Anthony Park Addition is entirely in the R-4 single
family district. -

TESTIMONY: Three letters were received, 1 person spoke and District 12
submitted a letter in support of the R-4 determination.
Dear Sir:
Zoning Code Section 60.302(6) provides that wherever there is any
uncertainty as to the intended location of a zoning district boundary, the
interpretation of the exact location of the boundary shall be determined by
resolution of the City Council upon recomnendation by the Planning
Comnission. The Comnission may hold a public hearing. On October 6, 1983
the Zoning Committee of the Planning Commission held a public hearing to
determine the intended location of the zoning district boundary line at 966
Manvel Street. The Committee based their recornrnendation on records in the
County Assessor's Office, in the Division of Housing and Building
Enforcement, and the City Directory. All of these records showed that the
use of the site was single family prior to 1982. At the close of the
public hearing, the Committee, based on findings 1 through 6 of the staff
report, recomnended that the zoning map be corrected to show the boundary
line between the R-4 and RM-2 districts along the southeastern property
line of 966 Manvel .
On October 7, 1983 the Planning Comnission reviewed the Zoning Comnittee's
recommendation and upheld it on a vote of 15 to 0.
This zoning district boundary correction does not require a public hearing
by the City Council . Enclosed with this letter is a draft resolution for
City Council consideration. Please schedule this matter for City Council
action at your earliest convenience and let me know the date it will be
heard.

Ms. James showed slides of the site and reviewed the staff report with a
recommendation that the zoning map corr•ection show tr,e boundary li�e
between the R-4 and RM-2 districts along the southeastern prop2rty line of
966 Manvel . Letters were received from three property ovrners and
District 12 in support of the R-4 zoning.
Sherman Eagles, 980 Hampden Avenue, supported staff's position that the
intention of the 1975 zoning was that this property be zoned single f amily.
He stated that during 1973 and 1974 he was a member of the Project Area
Comnittee for South St. Anthony Park and for several years leading up to
that, they had attempted to define boundaries. It is a fairly small
residential area that is totally surrounded by industrial land. Prior to
that time, the industrial encroachment on the residential area was eroding
the residential area. When the rezoning was discussed, they had several
meetings with City staff concerning how the area should be zoned. It was
th�e inter.tion �f the Project Area Comnittee to try to protect the single
family homes that were in the area and for that reason the zoning lines
went along property lines and along alleys to try to separate the existing
multi-family structures into RM zones and the existing single families into
R-4 zones. He stated that he felt it was a simple error in actually
drawing zoning lines and requested the lot be zoned R-4 which was the
neighborhood's intention in 1975.
Hearing no further testimony, Mr. Bryan closed the public hearing portion
of the meeting.
Mr. Levy moved approval to recommend that the zoning map correction show
the boundary line between the R-4 and RM-2 districts along the southeastern
property line of 966 Manvel . Mr. Lanegran seconded the motion, which
passed on a roll call vote of 7 to 0.

F. FINDINGS:
1 . The zoning district boundary currently runs down the center of this lot.
2. The City Directory, Building Department, and County Assessor's Office records
all show the use at this site as single f amily prior to 1982.
3. The building was converted to 5 units after its purchase by Specialty
Management.
4. In creating the zoning district boundaries for the 1975 Zoning Code, it was
decided that zoning district boundary lines that do not follow property lines or
public right-of-way should be marked with dimensions on the St. Paul Zoning
Maps. There are no dimensions in this case.
5. The intent in 1975 was to have the zoning in that area conform to the use at
that time.
6. The intent would therefore appear to be to have the existing apartments
immediately bordering the industrial zpne designated RM-2 as a narrow buffer
zone, and to leave the remaining residential area as R-4, single family.
G. STAFF RECOMMENDATION: Based on findings 1 through 6, staff recommends that the
zoning map correction show the boundary line between the R-4 and RM-2 districts
along the southeastern property line of 966 Manvel .

' I hereby request that you consider issuing a clarification
of the zoning of "The westerly 40 feet of Lot 9 , Block 60 ,
St. Anthony Park, Minnesota" commonly known as 966 Manvel St. ,
St. Paul, Minnesota. As it is now, the zoning district boundary
i line appears on the 4�Iesterly 20 feet of said lot with the I
� center of th�� line being placed so that approximately two-
i thirds of the lot is zoned RM-2 and the remaining one-third
is R-4 .

j This appears to be a mistake and it must have been intended
i that the lot be either R-4 or RM-2 . A convincing agreement
can be made either way. From our point of view we have always
! �'believed it to be RM-2 because the east and north sides of
� the lot border RM-2 . Having managed the adjacent apartment
� buildings for about 12 years, it has always appeared to us
that the building at 966 should °logically be part of our ap-
prQximately 50 unit complex. Although the building was
, occupied by it' s owner, the activity associated with the
I property and the status of the building after we purchased
� it led us to conclude that the building was occupied by
� multiple tenants . And for that reason, in 1975 when the com-
� prehensive zoning of the city took place, the lot was zoned
RM-2 to conform to it ' s usage at that time. Obviously someone
has to decide and we will await your decision.

Prior to the purchase of 966 Manvel I referred to the City of St. Paul
zoning ordinance as adopted by St. Paul City Council on August 28, 1975
(Council File No. 264550-- Ordinance No. 15881) , Reprinted April 1979,
which I purchased from the City of St. Paul, and I referred to zoning
tnap No. 9 which clearly identifies the Westerly 40 feet of Lot 9, Block
60 as being in an RM-2 zone.
When the question was raised as to the zoning of that lot I referred to
the "official" map in the planning commission office and an enlargement
of that map is herewith supplied for your review. The line is drawn
slightly east of the west boundary line, but the majority of the lot
is in RM-2. I believe the lot is RM-2, there are significant reasons
for believing that it was intended to be RM-2, and my conclusion is
. that to rule otherwise would constitute an arbitrary re-zoning of
property.

Dear b�r. Bryan and Members of the Committee:
The District 12 Council has discussed the problem with the
�Iocation of the zoning boundary at 966 Manvel. �e believe
that the boundary between the R-4 and the Rhi-2 zones should
be located on the current legal eastern lot line betcceen the
' house at 966 Manvel and the apartment house at 958 rianvel.
Sherman Eagles and Steven Flink were active in the South St .
Anthony PAC and worked with the city when the rezoning was
done . Both men agree that primary consideration was given to
locating zoning boundaries on streets and alleys if at all pos-
sible and on lot lines if not. In addition Roger Ryan, of the
� Department of Planning and Economic Development , says that
where boundaries did not follow established lines, distance
measurements were to be given .
Eagles and Flink also agree that a primary consideration when
the rezoning was done in South St . Anthony was to leave multi-
family areas as multifamily and to protect the rest of the area
� as singZe family zones . Historical use of the property was
taken into account when the zoning lines were drawn.
Since there would be no logical reason to draw the line down
the middle of the lot and thus through the middle of the house,
the reasonable explanation to us is that when the zoning r�ap
was drawn a mistake was made . Instead of locating the boundary
on the current property line which would be 20 feet west of the
original platted Iot line , the map draftsperson located it 20
feet west of the current property line, thus placing it in the
middle of the house .

In regards to Zoning File 9454 which is to determine the zoning of the
property on 966 Manuel Street, St. Paul , Minnesota.
It is my understanding that this property is currently zoned for both
single and multiple dwelling and that this hearing is to determine whether
it is to become a totally single or totally multiple dwelling.
It is my desire that this property be zoned, "single dwelling". I have
lived in this area for the past 12 years and my desire is to maintain
family home-ownership instead of having a corporation turn the lot into
• rental property.

WHEREAS, Specialty Management Corporation has requested an interpretation
of the zoning district boundary location at 966 Manvel Street; and
WHEREAS, Section 60.302 paragraph 6 of the Saint Paul Zoning Code provides
a method for the City Council to make such interpretation by resolution
upon recorrm endation of the Planning Comnission; and
WHEREAS, the Zoning Committee of the Planning Commission held a public
hearing on October 6, 1983, and also examined appropriate records from the
Division of Housing and Building Code Enforcement, the Ramsey,County
Assessor, and the files on this area from the 1975 citywide rezoning and
determined that the property should be zoned R-4; and
WHEREAS, the Planning Commission has reviewed the Zoning Corrmittee's
recommendation and has approved the determination that 966 Manvel should be
in the R-4 zoning district;
NOW, THEREFORE, BE IT RESOLVED, that the City Council determines that the
zoning district boundary follow the southeasterly property line of
966 Manvel Street so that the lot described as the westerly 40 feet of
Lot 9, Block 60, St. Anthony Park Addition is entirely in the R-4 single
family district. "
