WHEREAS, Resolution No. 83-558 approved by the County Board on July 25,
1983 approved an agreement between Ramsey County, the City of St. Paul, and
the Metropolitan Council for the exchange of land and responsibility in Lily-
dale and Battle Creek Regional Parks; and
W'HEREAS, Action by the City of St. Paul is bein� withheld pending the
resolution of a problem involving adequate space for �the Pig's Eye Resource
Recovery Opertion; Now, Therefore Be It
RESOLVED, That the Board of Ramsey County Commissioners hereby approves
Addend� No. 1 to the A gree ment (Special Use Permit) to the City of St. Paul
f rom Ramsey County granting to the City the exclusive right to use and control
certain premises for use in conjunction with the adjacent Pig's Eye Wood k'aste
Utilization System for a term of ten years as more fully spelled out in the
two (2) page Special Use Permit which is made a part hereof by reference and is
on file in the office of the Board of Ramseq County Go�issioners; and Be It
Further
RESOLVED, That the Chairman and Chief Clerk of the County Board are
authorized to execute this Special Use Permit on behalf of Ramsey County.

A SPECIAL USE PERMIT
TO
THE CITY OF ST. PAUL
FROM '
RAMSEY COUNTY

I. DESCRIPTION OF PREMISES. Ramsey County (the County) grants
to the City of St. Paul (the City), a municipal corporation of the State

of Minnesota the exclusive right to use and control the following
described premises :
. The East 1120 feet of the North 2220 feet
of the NW 1/4 of Section 10, Township 28,
Range 22, southerly of the south boundary
• of the Milwaukee Road Railroad Property as
identified on the attached exhibit 5A.
for use in conjunction with the adjacent Pig's Eye Wood Waste Utilization
System now used in the City's resource recovery operation.
II. TERM. This permit shall be in effect for a period of 10 years
or for the termination of the City's resource recovery operation, which
ever shall come first.
III. PERMIT CHARGES. The County shall make no charge for this
special use permit.
I�• MAINTENANCE OF PREMISES. The City shall be responsible for
the maintenance and control of all property made available to the City
under this permit. The property shall be maintained in a safe and
sanitary condition and shall conform to all requirements of regulatory

agencies charged with the protection of environmental quality.
V. INDEMNIFICATION. The City shall indemnify the County and
save it harmless from any and all claims for damages which the County
may be required to pay for injury or damage caused through the negligence
of the City or any of its agents or employees by virtue of its operation
and control of the premises.
