Re: Diseased Tree Hearing held �t C�ty 'Caur�`�L on January 10, 1984 l. Eleanor Eichten 2100 Law�rer St. Dennis Road St. Pa.ul, Minn. (698-1739) Ms. Eichten's complaint w�as that she was being assessed $397.75 for a diseased tree cut d�rn in the woods at the rear of her property which is appa.rent�jr fronting on Snelling Avenue. She claimed that the year before last, the City took several elm trees down without charging her. She can't figure out hcnnr there can only be one diseased elm tree in her whole area when there are appa.rent�jr mar�y elms in the immediate vicinity. She is worried about continued assessments for diseased elms. She mentioned the possibility of deeding some of the property to the City to help beautify Snelling Avenue. Note: Bill Donova.n remembered some kind of scenic easement in the area - need to check out. Councilma.n Fletcher suggested a policy statement that would limit the amount of money a given property would pay for diseased tree removal. He suggested tha.t a property o�wner pay on�y for l or 2 trees on a given parcel and ar�y other trees to be removed at the City�s expense. This would ease the burden on ar�y homeuwners who Y�appened to have a lot of elm trees. It will be necessary to get back to the City Council on policy matter in 4 weeks. 2. Robert Netzlaff The City Council unanimously voted 6 - 0 deleting his assessment of $170.50 for 120 Como Avenue on the advice of Ed Starr who stated that the notice was improperly sent to the renter not the homevwner. He advised the City Council that proper notice was not given. Mr. Netzla.ff thru John Saumwe'ber as an interpreter of Sign Language, told tha.t he would ha.ve cut the tree down himself if he would ha.ve received the notice. 3. Bernice Strane 1472 Laurel St. Pa.ul, Minn. Ms. Strane is not on the roll but testified that she ha.d a priva.te contractor remove her tree and flirther ha.d it tested. The testing apparent],y shaw'ed the tree was not diseased. The Council (Fletcher, I think) suggested a follc�w-up to see if she could produce evidence that tree wasn't diseased. If so, she should be reflinded the money he thought. He ` � claimed ttr�t the snow covered up the red ring around the tree when he bought �`1� the house. He did not kno�w� it wa.s going to be taken down until one day when he came home fY�om work it wa.s removed. Councilman Scheibel suggested a last warning notice (possib�y a yellow ribbon) tha.t indicates when a given tree 2�.s been sentenced to die within one or two days to give the awner a last ditch chance to take the tree down himself. We need to respond to this suggestion in �+ weeks. 5• Lucille Berry 370 �a. at Western St. Paul, Minn. (222-4041j Ms. Berry admitted that the two trees, one in the yard and one near a 3oirrt-use a]1ey with the railrna.d were on her property. Her problem was that her husba.nd is going to be permanent�y laid off soon. She thought maybe the railxoad would warrt to share the costs of the assessment in the amount of �3�+1.00. I promised to look into Loan and Grant options as well as would check trees for being her responsibility. I told Lucille Berry and Eleanor Eichten that I wovld get back to them within two weeks. The City Council approved the entire tree roll with exceptions (Netzlaff and Shepard) noted above. The Eichten and Berry properties were pulled out of the roll and laid over for four weeks. One additional issue, Councilman Wilson asked after the hearing if I would find out the current policy for planting new trees on Oxford between Selby and Lexington. Tom K�.rl said (�+88-7291) that he would take care of this by calling Councilman Wilson. I will be calling Tom ICarl the week of January 16th to discuss these notes and our strategy for the next (laid over) hearing on Februa.ry 7, 198�+.
