WHEREAS, Harold Awe has requested an interpretation of the zoning district
boundary location at 1553-1555 Randolph Avenue; and
WHEREAS, Section 60.302(6) of the Saint Paul Zoning Code provides a method
for the City Council to make such interpretation by resolution upon
recommendation of the Planning Comnission; and
WHEREAS, the Zoning Committee of the Planning Corr�nission held a public
hearing on December 15, 1983, and also examined appropriate records from
the Department of Public Works and the Ramsey County Department of Taxation
and determined that the zoning district boundary should follow the rear lot
lines along the south 7' of Lot 15, Block 13, Sylvan Park Addition; and
WHEREAS, the Planning Commission has reviewed the Zoning Comnittee's
recommendation and has approved the determination that the zoning district
boundary line should coincide with the northerly lot lines along the south
7' of Lot 15;
NOW, THEREFORE, BE IT RESOLVED, that the City Council determines that the
zoning district boundary line between the B-2 and the R-4 districts follow
the northerly property lines at the south 7' of Lot 15, Block 13, Sylvan
Park Addition so that 1553, 1555 and 1559 Randolph are entirely within the
B-2, Community Business District.

PURPOSE: Determine intended location of zoning district boundary line for
property at 1553-1555 Randolph.
PLANNING COMMISSION DECISION: Locate boundary line along the south 7' of
Lot 15 (17-0).
ZONING COMMITTEE DECISION: Locate boundary line along the south 7' of
Lot 15 (6-0) .
STAFF RECOMMENDATION: Locate boundary line along the northern (rear) lot
lines of applicant's lots. (The south 7' of Lot 15)
SUPPORT: One person testified.
OPPOSITION: Three people testified; 1 letter was received.
Dear Sir:
Zoning Code Section 60.302(6) provides that wherever there is any
uncertainty as to the intended location of a zoning district boundary,
the interpretation of the exact location of the boundary shall be
determined by resolution of the City Council upon recomnendation by the
Planning Commission. The Comnission may hold a public hearing.
On December 12, 1983, the Zoning Committee of the Planning Commission held
a public hearing to determine the intended location of the zoning district
boundary line at 1553-1555 Randolph. The Corr�nittee based their
recomnendation on records in the County Recorder's Office and the Public
Works Department. The testimony involved the question of whether or not
the property should be used for a parking lot and problems with parking in
that general area. At the close of the public hearing, the Committee, based
on findings 1 through 6 of the staff report, recomnended that the zoning
district boundary line be located along the south 7' of Lot 15. The
Corrmittee further stated that this interpretation does not imply approval
of the parking lot.
On December 16, 1983, the Planning Corrmission reviewed the Zoning
Corr�nittee's recommendation and upheld it on a vote of 17 to 0.

6. PARCEL SIZE: 82.63' (Randolph) x 99.99' (Brimhall ) = 8,262 square feet.
C. EXISTING LAND USE: One-story house and parking lot.

North: Single f amily and duplex residential (R-4)
East: Multif amily residential (RM-2)
South: Office and retail (6-2)
West: Retail and restaurant (B-2)
E. ZONING CODE CITATION: Section 60.302(2) states: "Where district boundaries are so
in icate t at t ey approximately follow the lot lines, such lot lines shall be
construed to be said boundaries."
Section 60.302(6) states: "Where unzoned property may exist, or where public right-
of-way may be realigned, or where there is any uncertainty, contradication, or
conflict as to the intended location of any district boundaries shown thereon,
interpretation concerning the exact location of the boundary lines shall be
determined by resolution of the City Council upon recomnendation by the Planning
Comnission. The Planning Commission may hold a public hearing."
F. FINDINGS:
1 . Zoning map #26 shows the boundary between the R-4 district to the north and the
B-2 district to be 99.99' north of Randolph right-of-way.
2. The original plat for Sylvan Park Addition was filed in 1886. This plat shows
Lot 13 with a width of 49.99' and Lot 14 with 50' . Randolph Street has a 66'
right-of-way.
3. According to records in the Public Works Department, Randolph right-of-way was
widened to 80' in 1890, and 7' was taken from the south side of Lot 13.
4. According to records in the County Recorder's office, Lots 13 and 14 were
redivided to front on Randolph, and the south 7' of Lot 15 was added to Lot 14
sometime in the 1920's.
5. The subtraction of 7 feet for Randolph created a width of 42.99' for Lot 13.
Adding 7' to Lot 1� made it 57' . The total of the two would still have been
99.99 feet.
6. Paragraph 2 of Section 60.302 states that zoning district boundaries were
intended to follow lot lines.
7. Applicant has submitted a certificate of survey for his property that shows a
depth along Brimhall of 103 feet.
8. Applicant wishes to use the property for off-street parking. He has applied
for, but not yet received site plan approval .

G. STAFF ANALYSIS: Based on plat maps available to City staff in 1975, the applicant's
proper y wou have appeared to have 99.99' of f rontage on Brimhall . This distance
would have been conterminous with the revised rear lot line that was created in the
1920's. It would therefore appear that the north 7' of both of the applicant's lots
would be in the 6-2 district, not the R-4 district.
H. STAFF RECOMMENDATION: Based on findings 1 through 6, staff recomnends that the
zoning istr�ct oundary line be located along the northern (rear) lot lines of
applicant's lots.

denlial ) . A parking lot is a permilted use in a R-2 zone but not
1n the R-4 portion .
Before any parking lot in the City can be established , a site plan
approval �is required . This assures that a11 zoning regulations will
be met � !including landscaping , setbacks , dcainage , paving , proper
traffic circulation , and space dimensions .
Because you did not follow the pr. oper procedures in eslablishing this
parking lot , the Lol must be barricaded to prevenC access for any
vehicles . This must be done within one week , by OctoEer. 21 , 1983 .
You may apply for a site plan r. e.view by submitting ] U copies of the
site plan. to the Planning �•ivision . Attached is itiformation regarding
the procedure .
