PROPERTY APPELLANT 99-83-H . 513 Portland Avenue Carol Thayer APPEARANCE: Carol Thayer, O�mer-Administrator SUBJECT: Request variance of St. Paul Legislative Code pertaining to requirement of deadbolt locks on all sleeping rooms, and variance of St. Paul Legislative Code, Section 34 .11, pertaining to basic facilities, to allow the use of 3 bathrooms by 16 people instead of the stipulated 15, because of financial hardship. PROCEEDINGS: Ms. Thayer addressed the board stating the property at 513 Portland Avenue is a Rule 36 facility, licensed by the State Department of Welfare, to house mentally ill adults. The residents . are chronically mentally ill, on medication, and some heavily medicated at night. She explained the city inspector has requested deadbolt locks be installed on all sleeping rooms. She stated that in August she had all new locks installed to meet the State Fire Code and at this time did not know the city's requirement. The present locks can be opened from the outside with a key and from the inside by merely turning the knob. They can be locked from the inside by turning a handle on the knob. These are r,zuch easier and safer for the occupant to exit as they do not need to look for or fumble for a key. Because of the type of occupants, Ms. Thayer stated, the personnel must be able to gain immediate access to the sleeping rQOms in case or fire, psychotic episode, etc. Frank Staffenson. explained the reason for requiring deadbolt locks is for security of the occupant and because the rooms exit into a common hallway. He said the type of locks presently on_ the rooms can be easily popped for access if needed. � BOARD ACTION: Harold Knutson moved to grant the variance to allow continued use of sleeping rooms with present locks. William Tilton seconded the motion. MOTION CARRIED. THE VOTE: Ayes 5 Nays 0 Abstentions 0 FURTHER PROCEEDINGS: Alice Bijjani spoke with Don Miller, the in- spector involved with this case. Mr. Miller stated he had no objection to granting the variance of St. Paul Legislative Code, Section 34 . 11 to allow 16 people to share 3 bathrooms. BOARD ACTION: Glen Gausman moved to grant the variance of St. Paul Legislative Code, Section 34 .11, to allow cantinued use of shared bathrooms by 16 people. William Tilton seconded the motion. PROCEEDINGS: Mr. Loban explained there are two bathrooms available to the six occupants. However one is on the same floor as the oceupants rooms and the other is in the basement. Most of the ather work stipulated in the inspector' s report has been completed. Alumni Corp, APPEARANCE: Robert Miller for Geoffrey Miller SUBJECT: Request variance of classification of dwelling as an apart- ment, and an extension of time to allow for financing to complete other work stipulated in the inspector' s report. PROCEEDINGS: This case was heard at the September 13 , 1983 meeting. An extension of 90 days was granted to allow for financing to be obtained. Mr. Miller has been in touch with Alice Bijjani dura.ng this period of time. NIr. Miller stated that just today he has been able to record the mortgage. They were able to obtaa.n financing from the National Fraternity Association, but they wanted the mor-ts�age on record before they v�ould disburse half of the money to the treasurer who is an adult member of the Alumni. He stated they have a contract to start the work and expects it will be commencing in about two weeks and should be completed by June 1, 1984 . PROCEEDINGS: . Ron Kline stated he is representing his father who is out of state at the present time. Mr. Kline stated it is an old house in St. Anthony Park. The inspector has cited 44 violations and at the present time they have cor.lplied with 27 which is 60� of the violations cited. He is appealing No. 27 on the inspection report pertaining to a bathroom outside rental unit. Alice Bijjani felt there was no problem with granting a variance on this. BOARD ACTION: Glen Gausman moved to grant a variance to allow con- tinued use of bathroom outside apartment #2. Rosann Bostrorn seconded the motion. MOTION CARRIED. THE VOTE: Ayes 5 Nays 0 Abstentions 0 FURTHER PROCEEDINGS: Mr. Kline explained he is seeking a• variance of item #34 on the inspection report, pertaining to insufficient light in the kitchen area in apartment �4 . He said he has had an estimate for a skylight and it is too costly and would create a hardship for his parents. � AZice Bijjani said she would address the shared bath problem along with the light and ventilation. She stated if the Klines caould con- sider going to one apartment (combining #4 and #5) it would eliminate the need for a second exit and the problem with the shared bath. Ron Kline said this is definitely a possibility but it would not be until approximately June that it could be done.
