Dear Councilman Fletcher :
On Friday, July 13 , 1984 , you orally requested from Ed Starr and
me a legal opinion with respect to the procedure for filling a
vacancy on the St. Paul city council . Specifically, you inquired
as to the procedure for filling the vacancy which will be created
by your resignation of your fourth ward city council seat . You
indicated that you would probably file with the Office of the City
Clerk at twelve o' clock in the afternoon on Tuesday, July 17, 1984
a letter of resignation which, by its terms , would become effec-
tive at two o_' clock in the afternoon of that same day.
Before detailing the procedure for filling that vacancy, we must
first determine when the vacancy occurs . St . Paul City Charter
Section 2.04 provides in relevant part , " fa )n elective office
becomes vacant when the incumbent . . .resigns by a writing filed
with the city clerk. . . " Should you proceed as described in the
previous paragraph of this opinion, the fourth ward St . Paul city
council seat becomes vacant at two o ' clock in the afternoon of
Tuesday, July 17, 1984 .
The procedure for filling a vacancy on the city council is set
forth in Charter Section 2. 05, a discussion of which will follow.
First, however, it should be noted that Tuesday, July 17, 1984 is
the last date for filing for the United States House of Represen- �
tatives ( Minnesota Statutes Section 204B. Q9) . I called the Secre-
tary of State ' s office today and verified that in fact at five
o' clock in the afternoon on Tuesday, July 17, 1984 filings for
United States Representative close . The significance of this
event will be discussed in connection with the procedure for fill-
ing a vacancy on the city council .

St . Paul City Charter Section 2 .05A provides that the council. may,
within thirty days of the vacancy, elect a qualified voter of the
city to fill that vacancy as an interim appointee. If a tie vote
occurs , then the Mayor is required to break that tie . Should the
council not �ill the vacancy within the allotted thirty days, the
charter requires the Mayor, within ten days thereafter, to appoint
an interim appointee.
Because your resignation will become eftective on the day which
is the last date for filing for the United States House of Repre-
sentatives , the interim appointee, regardless of whether that per-
son has been elected by the council or appointed by the Mayor,
may serve only until a successor is elected in the manner set
forth in City Charter Section 2 .05B.
"If__the vacancy occurs on or before the last day for
the filing of affidavits 'of candidacy to be a United
States Representative, the vacancy shall be filled
at the next state-wide general election, being the
first Tuesday after the first Monday in November of
even-numbered years . " Charter Section 2 . OSB.
The successor to your fourth ward city council seat shall be
elected then at the general election on Tuesday, [Vovember 6, 1984.
Affidavits of candidacy for the fourth ward council seat must be
filed with the City Clerk within fourteen days of July 17, 1984,
i .e. the last date for filing for U. S. Representative. Should
more than two persons file for that vacancy, then Charter Section
2 .05B requires that a primary election be held on the first Tues-
day after the second Monday in 5eptember which is September 11 ,
1984 .
By the provisions of Charter Section 2 . 02, the successor shall
serve the remainder of your term unless a vacancy within the mean-
ing of Section 2 .04 occurs earlier.

Re : Application for interim position � city council
Dear Sir:
This letter is written in formal application for the interim appoint-
ment to the St. Paul City Council. Attached to this application,
and made a part hereof, is my resume setting forth my personal back-
ground, educational and employment history, and a brief synopsis of
my civic and professional activities. Because the resume is only an
outline of my background and abilities , further detail concerning my
qualifications for an appointment to this City Council seems appropriate
here.
First and foremost, except for a brief period during which I received
my bachelor and graduate degrees, I have been a lifetime resident
of St. Paul and, specifically, the Fourth Ward.
Moreover, along with engaging in numerous professional activities and
organizations, I have been a member of the Merriam Park Community
Council for the past several years. I have acted as chair of their
Community Issues and Legislation Committee and most recently have
been elected president of that Council. As a resident of the Fourth
Ward, and in my position as chair and president of the Council,
I have been involved in numerous neighborhood issues and activities.

The following is but a brief sampling of the kinds of activities
and issues with which I have been directly involved.

including proposals for assessments on streets , curbs, side-
walks, lighting, sewers and the like.
2. Review of proposed permit parking ordinance.
3. Work with D�innesota Pollution Control Agency concerning
hazardous waste at 1724 Concordia.
4. Review of citizens budget process.
5. Review of various nuisance, noise and refuse problems .
6. Review of Mississippi River Boulevard plan.
7. Implementation of stump removal program, tree planting
program and spring clean-up programs.
8. Review various requests for zoning variances, special use
permits or other zoning and planning matters.
9. Engage in activities to attempt to revitalize the businesses
in the Marshall and Cleveland area within the Fourth Ward.
10 . Review of traffic and parking situation in the neighborhood.
11. Review of proposal for and requests for basketweaving in the
neighborhood.
12 . Dealing with the issuance of liquor licenses at Good Friends
Restaurant, Stuart' s Bar, etc.
13. Involved in fund raising for the Merriam Park Community Council.
Since my tenure as chairman and president of the Council, membership
has gone up and the participation and involvement of community residents
has increased. The problems we are dealing with in the Fourth Ward,
some of which have been detailed above, are similar to the problems
found in many neighborhoods throughout this city. As a member of the

My experience with city politics was climaxed in 1978 when I ran as an Independ-
ent candidate with the help of Roslie Butler and her committee.
Finding out how futilistic it was expecting to become elected as an Independent, I
was part of a group formed to obtain the thousands of signatures necessary to make
the District $ystem a real ity in St. Paul.
All meetings, press releases, planning and implementing for the District system were
held in my home for many months in which I held office as Treasurea�.
Upon the successful adoption of the District or Ward system by St. Paul voters, I
nominated Bob Fletcher from my district and used my influence to help Bob become
elected.
I believe Bob Fletcher has much ability, but it is unfortunate his e�cperience was not
sufficient to carry him through the ordeals required of him.

I am submitting my resume and asking your consideration for the interim
appointment to the Ward 4 council position. I have been active in the
community for a number of years, primarily in Ward 4. My service on the
Planning Commission has enabled me to help neighbors meet and resolve
potential conflicts.
The budget will be on the agenda this fall . My experience on the Planning
Commission and work for a community council have given me valuable insights
which will be helpful in this area.
Isssuance of liquor licenses , a matter of concern to many residents of
Ward 4, is another item on the agenda. My experience dealing with
community residents could be of value to the city, the neighbors and the
license holders .
Also under consideration this fall is the Parks Plan. I have spent many
hours with the parks staff , planning staff, and neighborhoods putting this
plan together. It is a thoughtful plan with which our parks department can
build while living within budget constraints .
Because I know how the city works , I believe I would be an excellent choice

Dear Council Members:
I am applying for the interim appointment to the vacant District 4 City
Council seat. My reasons for applying are: 1) I believe I have the
necessary background to fulfill the duties of the position; 2) I believe
the appointment should be given to someone with no interest in running
for the seat; and 3) I believe the appointment would give me a fresh
perspective on issues confronting Saint Paul 's citizens.
My work experience is detailed in the attached resume. In the course of
working for the Planning Division, I have worked with Community Councils
in Citizen Participation Districts all over the City, including 11, 12,
13 and 14. While we have not always agreed on every issue, I believe
that I have established a solid working relationship with these
districts and their community organizers. My work in the Zoning Section
has given me experience in dealing with individual citizens as well as
groups.
Before working in zoning, I coordinated the Planning Comnission's review
of the capital improvement proposals and the Capital Allocation
Policies. I am therefore very f amiliar with the City's capital
budgeting process. In the course of working with capital improvement
budgeting, I have gained some knowledge of the general fund and special
funds budgets as well . Based on my dealings with the City Council
through my work, I have developed a familiarity with many of the Council
processes. I therefore would be able to pick up the duties of this
position quickly and become an effective Council member.
My second reason for applying for this position is that I believe the
appointee should not be a candidate for election to the seat this fall .
Issues facing the Council will require a new members' full attention, and
an election campaign would take time and energy better spent on dealing
with these issues.
In a sense, this appointment would be an extension of my current duties,
since the City Development and Transportation Committee will be
reviewing a series of zoning text amendments recently forwarded to the
City Council from the Mayor's Office. The interim appointment would be
well-filled by a concerned professional caretaker like me until the
citizens of the ward can elect a new Council member.

Finally, I would like to be appointed to this position because of the
broader perspective it would give me respecting my current position in
the Planning Division. This appointment would give me a greater
appreciation of the range of issues facing the City, and would provide
me with a wider context for the planning and zoning issues faced in day-
to-day planning work. The timing is perfect. I have worked for the
City for almost five years and am ready for a new challenge. The
appointment would last approximately four months; long enough to "learn
the ropes", but not so long that I could not easily resume my duties as
a planner.
