WHEREAS, failure to have a certificate of occupancy is a basis for adverse action against
a license under Saint Paul Legislative Code §310.06(b)(3); and
WHEREAS, the licensee has failed to respond to the Notice of Violation or to otherwise

contest the basis for adverse action; now therefore, be it
RESOLVED, that all licenses held by Food Squaze Grocery & Deli, Inc., d/b/a Food
Square Grocery & Deli at 962 Burr Street be, and hereby aze, suspended untii such time as the
certificate of occupancy for the premises at 962 Burr Street is reinstated.
16 This resolution is based upon the facts contained in the September 1, 2000 Notice of
17 Violation, the 7une 27, Certificate of Occupancy Revocation letter from the Deparhnent of Fire
18 and Safety Services and such arguments as may have been presented to Council at the public
19 hearing in this matter.

Dear SirfMadam:
The Office of License, Inspections and Bnvironmental Protection has recommended
adverse action a�ainst the licenses held by Food Square Grocery & Deli, Inc., d/b/a Food Squaze
Grocery & Deli, Inc. for the premises at 9b2 Burr Street. The basis for the recommendation is as
follows:
On March 3, 2000 an inspection was done to determine
whether to renew the certificate of occupancy for the building
at 962 Burr Street. A list of deficiencies was noted, and a re-
inspection date of April ll, 2000 was set. At that inspection,
and subsequent reinspections on May 17, 2000, June 23, 2000
and July 27, 2000, there was stil] no compliance with the
correction orders. The certificate of occupancy for the
building was revoked on June 23, 2000. Pursuant to Saint Paul
Legislative Code §310.06(b)(3), it is a basis for adverse actioa
against a licensa that the premises which are licensed do not
comply with applicable health, huusing, fire, zoning and
building codes and regulations.
If you do not dispute the above facts please send me a letter with a statement to that
effect. The matter will then be scheduled for a hearing before the St. Paul City Councii to
determine what penalty, if any, to impose. You will have an opportunity to appear and speak on
your own behaif, or to have someone appear there for you.

On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary
hearin� before an Administrative Law Judge (AL�. If you wish to have such a hearing, please
send me a letter stating that you are contestin� the facts. You �vill then be sent a"Notice of
Hearing," so you will kno�v when and where to appear, and what the basis for the hearing will be.
In either case, please let me know in writing no later than Monday, September 11,
2000, how you would like to proceed. If I have not heard from you by that date, I wiil
assume that you are not contesting the facts. The matter will then be scheduled for the
hearing before the St. Paul City Councii. ,

Saint Paul City Hall and Ramsey County Courthouse.

Dear SirfMadam:
The Office of License, Inspections and Bnvironmental Protection has recommended
adverse action a�ainst the licenses held by Food Square Grocery & Deli, Inc., d/b/a Food Squaze
Grocery & Deli, Inc. for the premises at 9b2 Burr Street. The basis for the recommendation is as
follows:
On March 3, 2000 an inspection was done to determine
whether to renew the certificate of occupancy for the building
at 962 Burr Street. A list of deficiencies was noted, and a re-
inspection date of April ll, 2000 was set. At that inspection,
and subsequent reinspections on May 17, 2000, June 23, 2000
and July 27, 2000, there was stil] no compliance with the
correction orders. The certificate of occupancy for the
building was revoked on June 23, 2000. Pursuant to Saint Paul
Legislative Code §310.06(b)(3), it is a basis for adverse actioa
against a licensa that the premises which are licensed do not
comply with applicable health, huusing, fire, zoning and
building codes and regulations.
If you do not dispute the above facts please send me a letter with a statement to that
effect. The matter will then be scheduled for a hearing before the St. Paul City Councii to
determine what penalty, if any, to impose. You will have an opportunity to appear and speak on
your own behaif, or to have someone appear there for you.

Dear SirfMadam:
The Office of License, Inspections and Bnvironmental Protection has recommended
adverse action a�ainst the licenses held by Food Square Grocery & Deli, Inc., d/b/a Food Squaze
Grocery & Deli, Inc. for the premises at 9b2 Burr Street. The basis for the recommendation is as
follows:
On March 3, 2000 an inspection was done to determine
whether to renew the certificate of occupancy for the building
at 962 Burr Street. A list of deficiencies was noted, and a re-
inspection date of April ll, 2000 was set. At that inspection,
and subsequent reinspections on May 17, 2000, June 23, 2000
and July 27, 2000, there was stil] no compliance with the
correction orders. The certificate of occupancy for the
building was revoked on June 23, 2000. Pursuant to Saint Paul
Legislative Code §310.06(b)(3), it is a basis for adverse actioa
against a licensa that the premises which are licensed do not
comply with applicable health, huusing, fire, zoning and
building codes and regulations.
If you do not dispute the above facts please send me a letter with a statement to that
effect. The matter will then be scheduled for a hearing before the St. Paul City Councii to
determine what penalty, if any, to impose. You will have an opportunity to appear and speak on
your own behaif, or to have someone appear there for you.

hearin� before an Administrative Law Judge (AL�. If you wish to have such a hearing, please

In either case, please let me know in writing no later than Monday, September 11,
2000, how you would like to proceed. If I have not heard from you by that date, I wiil
assume that you are not contesting the facts. The matter will then be scheduled for the
hearing before the St. Paul City Councii. ,
