(car wash) at the southwest corner of Seventh Street (Fort Road) and Dealton subject to the following conditions which are hereby expressly made a part of this special condition use permit: (1) All ingress and egress to the auto laundry site shall be from West Seventh Street (Fort Road) , with no motor vehicle access to the site from Dealton. (2) The permittee shall construct along the south line of their property a three foot high block wall with three foot high suitable fencing on top of the block wall, together with suitable shrubbery as specified by the Planning Administrator. (3) A four foot landscaped area shall be provided along the west property line. (4) An attendant shall be on duty at all times while the car wash is open for business. (5) The entrance and exit shall be provided with a chain or gate closure to be used when the business is closed. (6) The auto laundry shall be closed at 11:00 P.M. every day or earlier if required by the noise ordinance. (7) Lighting shall be directed on-site and away from neighbor- ing residential uses. (8) Landscaping and street trees shall be provided in conform- ance to Fort Road guidelines. (9) Snow shall not be plowed onto or stored on public rights- of-way. PLANNING COMMiSSION ��ECISION: Deny (10-8) ZONi1dG COMMITTEE DECISION: Deny (4-2) STAFF RECQMMENDATION: Approve with 9 additional conditions attached. SUPPaRT: One person testified. OPPOSITION: On May 3, 7984, five individuals testified and a petition with 48 signatures was submitted. On June 7, 1984, six individuals testified in opposition. Dear Sir: On June 7, 1984, the Zoning Committee of the Planning Commission concluded a public hearing on the application of Robert Anderson for Special Condition Use Permit to construct and operate a car wash on the southwest corner of 4Jest 7th Stree� and Dealton. The staff recommendation was for approval if the appiicant would agree to meet nine additional conditions to minimize impact on adjacent properties. Applicant agreed to all conditions except to erect a concrete wall eight feet in height a7ong the southern property line. He suggested that a wood fence be substituted for the wall . There was considerabie testimony �ontending that a car wash at the proposed l ocation �voul�i create a traffic hazard. Staff advised the Com�nittee that the �City`s traffic engineer and police traffic safety officer have reviewed and approved the site p1an. A motion to deny the permit was made, based on the anticipated traffic hazard created by the proposed car a�ash. In a 4-2 vote, the Zoning Committee deter- mined that the permit cannot be issued without impairing public health and safety. The appellant bases the appeal on the grounds that the Planning Corr�nission acted arbitrarily in dismissing the professional judgement of the traffic engineer and recommendations of Zoning staff. This matter is scheduled to be heard by City Council on June 28, 1984. ROBERT ANDERSON (�9559): Speciai Condition Use Permit to construct a 4- stall auto laundry car wash) at the southwest corner of 7th Street and Deai�:o,�. The applicant was present. There was opposition present at the hearing. Mr. McGuire showed slides of the site and reviewed the staff report with a recommendation f or approva7 subject to conditions 1 through 9. Correspondence was received on the matter from the West 7th/Fort Road Federation Mr. Levy asked if it was indicated that Benson Street would be used as an access route because of the difficulty of the left turn into 7th Street. He stated there is compe7ling concern with regards to access of the site, especially traffic occuring at peak hours. Mr. McGuire stated he does not see the volume of traffic to be a great problem and doesn't anticipate rush hour traffic to i�e a concern. In response to a second qiaesion about access, he stated that lvoki�g at the site plan, two drives on 7th will not work physically. Ms. Tracy asked if applicant had obtained any more property. Mr. McGuire said that it was his understanding that applicant had agreed to purchase additionai land, but that he has not seen the deed. t�1r. Pangal statexi �hat the applicant anticipates approximately 2,000 cars per month, 75-i00 per day, and that all these cars would not be using the car wash during the peak hours but rather duri.ng the 12-14 hour day. Ms. Zieman asked what the noise rdinance stated. Mr. McGuire answered that it is pending, but if passed it �ight have a 10:30 shut-off. Ms. Zieman , also asked if landscape plan had `�been received. Mr. McGuire stated that it . had been received, that the proposal is to accomodate landscape space and vehicles, that street trees will be specified according to Fort Road guidelines. Ms. Tracy asked if a "No Right Turn" sign could be placed at the curb cut on Dea7ton. Mr. McGuire stated that the Dealton drive was to be for entering the car wash only and such a sign would serve no purpose. Tracy stated the twa main issues of concern for neighborhood appear to be the saf�ty of the residents and people entering and exiting the proposed car wash. Anderson agrees and accepts �iaff recor�merrda�:ior except far Itein n3, tnat an f�' hioh concrete block wall shall be provided along the southern property line. There is a 150' strip on W. 7th Street, which would call for a 150' x $' high wall. They believe that would serve as an invitation for grafetti . They understar�d the reasons for, and are willing to put up a sound barrier, such as a woven cedar type fence or shrubs, but do not understand why an 8' high concrete wall is being requested. They feel it would look terrible, that it would be useri as a deposit for trash. Mr. Pangal asked why Mr. Berg felt the 8' wall wo�ld be a target for graffeti and mischief because persons would have tfl go onto adjacent property to do so. Mr. Berg believes it would happen on the car v�ash property by peopi� cuming in. Mr. Milton Gray, Att�rney for h1r. Hathaway, owner of adjacent property, and vendar of su�ject property, stated that Mr. Hathaway wholeheartedly endorses the propos at except for the cement wall . Although he understands that it would not he at his expense to install the wall he feels that it would not be to his best interest as far as the cosmetics of the wall , feels it would not be easily maintined, and urges the adoption of the proposal except for Item #3. Mr. Panga3 asked Mr. Gray if Mr. Hatha�,ray owns property on W. 7th. Mr. Gray stated tha� the wall will not be on Mr. Hathaway's property but that he is concerned about the appearance. Betty Moran, Corr�nun�ty Orqanizer for the West 7th Street Federation, was present in cappositi�n. She distributed to Zoning Committee photographs of other prope�ty she said was owned by Mr. Anderson for their review to show why the neighbors wa�r�t the wall put up. The existing fence is not well maintained an Rnderson's other property, and the neighbors want the cement wall to be a condit�aon. She stated that the property owner to the immediate south wants the wa11 , but she further stated that the Federation wants the Pianning Commission to deny the permit. Sylvia Shaver, 1873 Ivan Way, was present in opposition. She stated there are many chi7dren in the neighborhood, including her handicapped son, and she is very +concerned with the traffic volume. She has drivers speeding down her aliey and streets now. There are 19 children within 15Q feet of the car was� site. The children ride bikes, play soccer, baseball , etc., , and that the nearby playground is used primarily for softball teams. She - does not view the pr�posal as a safe environment for either the children or for the air she breathes. Sarah Hillstrom, 1836 Benson, was present in opposition. She stated that a teenager hac4 been h�t by a car and that a 5 year old boy had been killed. She had a f amily em�rgency and could not get home because of the traffic volume. She stated that a "No Left Turn" sign would not help, and that she fee]s the car wash wrould not be an asset to the neighborhood. . , � ����� ROBERT ANDERSON (#9559) Page Three Edith Calhoun, 1854 W. 7th Street, was present in opposition. She stated that she is very cancerned about the amount of traffic that would be generated if the car wash propasal was approved. huah P1anning was present in opposition. He is concerned with the volume of traffic and stated that buses on W. 7th Street are also a concern of his. He stated that Dealton is not wide enough, and that the winter months are especially bad. He feels that with so many children running and playing outside that the car wash would be hazardous. Otting Jackson, retired Police Officer, who stated he owns property at W. 7th and Montreal, was present in opposition. He stated that the area has a high speed pattern of 30-35 miie zone then a 40-mile zone, and that it is extremely dangerous. There are small children in the area, narrow streets ::nd 1�ts of tr�Ff i c thro;�,h. the al l eys. Fr�r� Lexi ngton ou± there i s a h�a�+y traffic pattern and that trucks use the roads. He believes that the car wash would be a disgrace to the City of Saint Paul . Hearing no further testimony, Mr. Pangal closed the public hearing portion of the meeting. Mr. Levy asked counsei if there needed to be more elaborate discussion to deny the permit to install the car wash. Mr. Sullivan, Assistant City Attorney, stated he didn't know, but he would research the matter and report back, and the propasal should be forwarded to the Commission with some find�ngs if the recorr�nendation was to be for denial . Mr. McGuire stated that the request is for a Special Condition Use Permit, that iL is a use permitte� in this district pro•�iding ��he candit�ons of the ordinance are either met or are agreed to by the developer. Mr. Levy stated that the issue is a projection of anticipated traffic as a severe problem in terms of residential streets. He feels that it's an overriding concern that cannot be 'met by the applicant due to the nature of the area. Mr. McGuire asked Levy if he felt the judgement of the traffic engineer and police traffic safety official who have reviewed and approved the plan were in error. Mr. Levy stated that e is not a lawyer or a traffic engineer, but based on his knowledge of th� area he felt the car wash would not be a � good asset. Applicant has purchased an additional 35' along t�lest 7th, and the site now appears to accommo�ate the necessary landscapping, four wash bays, and the • required parking and maneuvering areas. (The code requires one space per employee and 20 reservior spaces) . 7. The traffic engineer has determi"ned that some of the reservior spaces shown on the revised plan are not usable, since cars cannot maneuver into and out of them. However, there appear ta be approximately 17 usable waiting spaces and 3 usable drying spaces for a total of 20 reservior spaces. 8. The p7an does not show sufficient landscaped area along the west property line. In additien, no landscaping plan has been submitted. °. (car wash) at the southwest corner of Seventh Street (Fort Road) and Dealton subject to the following conditions which are hereby expressly made a part of this special condition use permit: (1) All ingress and egress to the auto laundry site shall be from West Seventh Street (Fort Road) , with no motor vehicle access to the site from Dealton. (2) The permittee shall construct along the south line of their property a three foot high block wall with three foot high suitable fencing on top of the block wall, together with suitable shrubbery as specified by the Planning Administrator. (3) A four foot landscaped area shall be provided along the west property line. (4) An attendant shall be on duty at all times while the car wash is o�zen for business. (5) The entrance and exit shali be provided with a chain or gate closure to be used when the business is closed. (6) The auto laundry shall be closed at 11:00 P.M. every day or earlier if required by the noise ordinance. (7) Lighting shall be directed on-site and away from neighbor- ing residential uses. (8) Landscaping and street. trees shall be provided in conform- ance to Fort Road guidelines. (9) Snow shall not be plowed onto or stored on public rights- of-way. Dear �ir_ On June 7, 1984, the Zoning Committee of the Planning Commission concluded a public hearing on ttte application of Robert Anderson for Special Condition Use Permit to construct and operate a car wash on the southwest corner of 4Jest 7th Stree� and DeaTton. The staff recommendation was for approval if the applicant would agree to meet nine additional conditions to minimize impact on adjacent properties. Applicant agreed to all conditions except to erect a concrete wall eight feet in height along the southern property line. He suggested that a wood fence be substituted for the wall . There was considerable testimony contending that a car wash at the proposed location wou7d create a traffic hazard. Staff advised the Committee that the _City's traffic engineer and police traffic safety officer have reviewed and approved �he site plan. A motion to d�ny the permit was made, based on the anticipated traffic hazard creatzd by the propased car wash. There was opposition present at the hearing. Mr. McGuire showed slides of the site and reviewed the staff report with a recommendation for approval subject to conditions 1 through 9. Correspondence was received on the matter from the West 7th/Fort Road Federation Mr. Levy asked if it was indicated that Benson Street would be used as an access route because of the difficulty of the left turn into 7th Street. He stated there is compelling concern with regards to access of the site, especially traffic occurin� at peak hours. Mr. McGuire stated he does not see the volume af traffic to be a great problem and doesn't anticipate rush hour traffic to be a concern. In rESponse to a seconC quesion abnut access, he stated that looking at the site plan, two drives on 7th will not work physically. Ms. Tracy asked if applicant had obtained any more property. Mr. McGuire said that it was his understanding that applicant had agreed to purchase additional land, but that he has not seen the deed. Mr. Pangal stated that the applicant anticipates approximately 2,OOQ cars per month, 75-100 per day, and that all these cars would not be using the car wash during the peak hours but rather during the 12-14 hour day. Ms. Z�eman asked what the noise ordinance stated. Mr. McGuire answered that it is pending, but if passed it might have a 10:30 shut-off. Ms. Zieman , aiso asked if landscape plan had been received. Mr. McGuire stated that it . had been received, that the proposal is to accomodate landscape space and vehicles, that street trees will be specified according to Fort Road guidelines. Ms. Tracy asked if a "No Right Turn" sign could be placed at the curb cut on Dealton. Mr. McGuire stated that the Dealton drive was to be for entering the car wash only and such a sign would serve no purpose. Tracy stated the two main issues of concern for neighborhood appear to be the safety of the residents and people entering and exiting the proposed car wash. Mr. Thomas Serg, Attorney for Robert Anderson, stated that P1r. Anderson agrees and accepts staff recommendation except for Item #3, that an 8' high concrete biock waii sha17 be provided along the southern property line. There is a 150' strip on W. 7th Street, which would call for a 150' x 8' high wall . They believe that would serve as an invitation f or grafetti . They understand the reasons for, and are willing to put up a sound barrier, such as a woven cedar type fence or shrubs, but do not understand why an 8' high concrete wall is being requested. They feel it would look terrible, that it would be used as a deposit for trash. Mr. Pangal asked why Mr. Berg felt the 8' wall would be a target for graffeti and mischief because persons would have to go onto adjacent property to do so. Mr. Berg believes it would happen on the car wash property by people coming ir�. Mr. Milton Gray, Attorney f or Mr. Hathaway, owner of adjacent property, and vendor of subject property, stated that Mr. Hathaway wholeheartedly endorses the proposal except for the cement wall . Although he understands that it would not be at his expense to install the wall he feels that it would not be to his best interest as f ar as the cosmetics of the wall , feels it would not be easily rnaintined, and urges the adoption of the proposal except for Item �3. Mr. Panga7 asked P�r. Gray if Mr. Hathaway owns property on W. 7th. h1r. Gray stated that the wall will not be on Mr. Hathaway's property but that he is concer�ed about the appearance. Betty Moran, Community Organizer for the West 7th Street Federation, was present in opposition. She distributed to Zoning Committee photographs of other property she said was owned by Mr. Anderson for their review to show why the neighbors want the wall put up. The existing fence is not well maintained on Anderson's other property, and the neighbors want the cement wall to be a condition. She stated that the property owner to the immediate south wants the wall , but she further stated that the Federation wants the Planning Commission to deny the permit. Sylv�a Shaver, 1873 Ivan Way, was present in opposition. She stated there are many children in the neighborhood, including her handicapped son, and she is very car�cerned with the traffic volume. She has drivers speeding down her alley and streets now. �There are 19 children within 150 feet of the car wash site. ihe children ride bikes, play soccer, baseball , etc., � and that the nearby playground is' used primarily for softball teams. She does not view the proposal as a safe environment for either the children or for the .air she breathes. Sarah HiTlstr�:�, 1836 Benson, was present in opposition. She stated that a teenager ha� teEn hit by a car and that a 5 year old boy had been killed. She had a family emergency and could not get home because of the traffic volume. He stated that Dealton is not wide enough, and that the winter months are especially bad. He feels that with so many children running and playing outside that the car wash would be hazardous. Otting Jacks�n, retired Police Officer, who stated he owns property at W. 7th and Montreal , was present in opposition. He stated that the area has a high speed p attern of 30-35 mile zone then a 40-mile zone, and that it is extremely dangerous. There are small children in the area, narrow streets and iats �f traff�� �hrough the �'.'.eys. Fr�m Lex�ngten out there is a heavy traffic pattern and that trucks use the roads. He believes that the car wash would t�e a disgrace to the City of Saint Paul . Hearing no further testimony, P1r. �angal closed the public hearing portion of the meeting. Mr. Levy astced counsel if there needed to be more elaborate discussion to deny the perm3t to �nstall the car wash. Mr. Sullivan, Assistant City Attorney, stated he didn't know, but he �ould research the matter and report back, and the proposal should be farwarded to the Commission with some findings if the recommendation was to be for denial . Mr. McGuire stated that the request is for a Special Condition Use Permit, tha�t it is a tase perrr�itted in this distric� pro��iding the conditions of the ordinance are either met or are agreed to by the developer. h1r. Levy stated that the issue is a projection of anticipated traffic as a severe problem in terms of residential streets. He feels that it's an overriding concerrr that cannot be met by the applicant due to the nature of the area. Mr. McGuire asked Levy if he felt the judgement af the traffic engineer and police traffic safety official who have reviewed and approved the plan were in error. Mr. Levy stated that he is not a lawyer or a traffic engineer, but based on his knowledge of the area he felt the car wash would not be a , good asset.
