WHEREAS: Clodetta I. Carlone (Sole Owner) , dba Lower Court Bar is
the holder of a Restaurant, Entertainment, and On Sale
Malt (3.2 Beer) License at 361 West Seventh Street;
WHEREAS: The License Inspector for the City of St. Paul notified
the above-named licensee on July 5, 1984 by letter that
he would recommend to the City Council for the City of
St. Paul the following:
1. Violation of St. Paul Legislative Code 310.12.
2 . Violation of St. Paul Legislative Code 272.01
and 310.06, Subd. 2.
3. Violation of St. Paul Legislative Code 310.06
and 409.09 .
WHEREAS: On July 18, 1984 the Council held a hearing on the License
Inspector's recommendation, and
WHEREAS: The Council heard testimony from Joseph Carchedi, License
Inspector, and Police Officers O'Brien, Moore, Drews,
Hinzman, Roeder, Trow, and Patrick Carlone who represented
the licensee; and
WHEREAS: The Council has considered the testimony and the demeanor
of the witnesses, the applicable law and the exhibits sub-
mitted; and
WHEREAS: The evidence established that on October 25, 1983 and on
June 21, 1984, there occurred on the licensed premises
female dancers who danced completely nude, exposed their
breasts, genitals and pubic hair and simulated master-
bation; that on June 21, 1984 female employees used the

licensed premises for purposes of prostitution; and that
on June 13 and June 26, 1984 police officers were refused
admission to the licensed premises during normal business
hours for purposes of performing lawful inspections of
licensed premises; and
WHEREAS: The above cited activities violate Sections 310.12 , 310.06 ,
409.09 and 272.01 of the Saint Paul Legislative Code and
are grounds for this Council to take adverse action on the
existing business licenses; and
WHEREAS: Based upon all of the evidence, testimony and documents
received, upon consideration of the demeanor and credibil-
ity of the witnesses, and upon the findings recited above,
the Council has determined that the licensed premises has
been operated in such a manner as to create a serious
danger to the public health, safety and welfare and so as
to create a nuisance; now, therefore, be it
RESOLVED: That the licenses held by Clodetta I. Carlone for the
premises known as Lower Court Bar, 361 West Seventh Street,
are hereby revoked, effective at noon on the date this
resolution is published.

� St. Paul City Council regarding your On Sale non-intoxicating Malt
(3.2 Beer) Beverage, Entertainment, and Restaurant Licenses. This
hearing will be held in the St. Paul City Council Chambers, Third
Floor of the City and County Court House at 10:00 a.m.
At this hearing the License and Permit Division will make a recorr�nend-
ation that your On Sale non-intoxicating Malt (3.2 Beer) Beverage,
Entertainment, and Restaurant �icenses presently issued to you at 361
� West Seventh Street be suspended, and that the private cubicles that
are presently located within the main licensed area be removed prior
. to your reopening.
The License and Permit Division bases its recommendation on the
following: �
1. On June 13 and June 26, 1984 you refused to allow a
police officer(s) admission to the licensed premises
for the purpase of inspection. �
It is our allegation that the above described activities have violated
' St. Paul Legislative Code 310.12.
2. On June 21, 1984 allowing and/or permitting a female •
employee to use the premises at 361 West Seventh
� Street for the acts of prostitution.
It is our allegation that the above described activity has violated St.
Paul Legislative Code 272.01 and 310.06 Sub-div 2.
3. On October 25, 1983 and June 21, 1984 allowing and/or
permitting female �employees to expose their breasts, �
� genitals and pubic hair and simulating masterbation.
It is our allegation that the above described activity violated St. Paul
Legislative Code 310.06 and 409.09.

In addition the St. Paul City Council may also hear complaints from
residents witfi respect to the manner in which you have conducted
your business causing it to become an (alleged) neighborhood nusiance.
This may possibly result in an additional suspension of your license
and/or stipulations being placed on the license you presently hold at
361 W. Seventh Street.
You may be represented at this hearing by an attorney and/or other
representative of your choice. You and/or your attorney/representative
will be allowed to cross-examine witnesses and present evidence through
witnesses and documents at this hearing.
Enclosed is a memorandum of procedures, used by the St. Paul City Council
for hearings on license revocations, suspensions and denials of licenses.
