ItFSOT��IED, that District Heating Development Company' s
application for an easement for the construction of hot water
heatin� system �ipes across land owned by the City and leased
to the Civic �enter Partners Limited Partnership is hereby
informally approved for construction activities to commence,
upon occurrence of the following conditions : •
1 . That the Civie CEnter Partners Limited Part-
nership or its representative consents thereto.
2 . That District Heating Development Company or
its construction contractor fully defend and indem-
nify the City and hold it harmless from any claim
or injury resulting from the construction of said
pipes and system; and provide proper evidence that
th� Civic Center Arena and ancillary structures are
?r�sured as to property damage or loss by the construc-
tion. contractor.
3 . That District Heating Development Company
agrees to continue to make proper application for
an easement, to comply with the requirements of law
in regard thereto, and to agree to and accept said
easement, its terms and conditions .
4. That if any of the above conditions are not
met, District Heating Development Company shall
remove its pipes and related equipment from said
easement area.
