WHEREAS, based upon the records in the Ramsey County Recorder's Office and information
obtained by Division of Code Enforcement on or before July 28, 2000, the following aze the now known
interested or responsible parties for the Subject Property: Fairbanks Capital, 3815 South West Temple,
Salt Lake City, UT 84115-4412 ; Counselor Realty, Inc., 7766 N.E. Hwy 65, Spring Lake Park, MN

WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance
Building(s)" dated September 12, 2000; and
WHEREAS, this order informed the then known interested or responsible parties that the structure
located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by October 13, 2000; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this
building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Division of Code Enforcement
requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City
Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the
public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, November 7, 2000 to hear testimony and evidence, and after receiving tesrimony and
evidence, made the recommendation to approve the request to order the interested or responsible parties to
make the Subject Properiy safe and not detrimental to the public peace, health, safety and welfare and
remove its blighting influence on the community by rehabilitating this structure in accardance with all
applicable codes and ordinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolirion and removal of this building(s) is estimated to exceed three
thousand dollazs ($3,000.00).
That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties
to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Enforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division of
Code Enforcement, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this resolution and
that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property safe and not
detrimental to the public peace, health, safety and welfare and remove its blighting influence on the
community by rehabilitating this structure and correcting all deficiencies as prescribed in the above
referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and
ordinances, or in the alternative by demolishing and removing the structure in accordance with all
applicable codes and ordinances. The rehabilitation or demolition and removal of the shucture
must be completed within��53' days after the date of the Council Hearing.

If the above corrective action is not complete within this period of time the Citizen Service Office,
Division of Code Enforcement is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the Subject
Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.

1 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
2 property or fixtures of any kind which interfere with the demolition and removal shall be removed
3 from the property by the responsible parties by the end of this time period. If all personal property
4 is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and
5 dispose of such property as provided by law.

Inasmuch as this Order to Abate has not been complied with the nuisance condition remains

recommendation of the Division of Code Enforcement that the City Council pass a resolution

STAFF PRESENT: Dick Lippert, Code finforcement; Steve Magner, Code Enforcement
Gerry Strathman called the meeting to order at 10:03 a.m.
Appeal of summary abatement order at 703 Fnller Avenne.
Dick Lippert reported that he came to an agreement with the owners, who indicated they would
call to check on getting their money back.
Gerry Strathman recommends denying the appeal and said he did not receive a call from the
owners.
Resolufion ordering the owner to remove or repair the buiiding at 1093 Seventh Street
Westi520 Bav Street. If the owner fails to compiy with the resolution, Code Enforcement is
ordered to remove the building.
The following appeazed: Robyn Mazshall, owner, and Boris Tsvetovat, potential buyer.
Steve Magner reported there aze two addresses on this building. The building was condemned in
December 1999 and vacant since then. Three summary abatement notices have been issued to
secure the dwelling, remove unsecured vehicle, remove debris, cut grass. On 8-21-00, an
inspection of the building was conducted and a list of deficiencies which constitute a nuisance
condition was developed and photographs were taken. This property remains in a condition that
comprises a nuisance as defined by the legislarive code. The vacant building fees are paid. Real
estate t�es aze paid. Estimated market value is $56,200. A code compliance inspection has not
been applied for nor a$2,000 bond posted. The estimated cost to repair is $80,000. The
estimated cost to demolish is $10,000 plus the cost for toxic waste removal.
A fire broke out in this building because of a methamphetamine lab on the second floor,
explained Mr. Magner. Waste &om the lab was thrown out the attic window. Some waste has
been cleaned up, but there aze toxic chemicals left in the walls and debris of the building. The
Fire Depardnent is going to require the second floor and attic be completely gutted prior to any
remedial repairs to this building. The building has been boarded, aud this is probably why no
inspection has been completed. The City is unwilling to go into this building due to the
hazardous contamination.
Boris Tsvetovat stated he buys and remodels properties. He is interested in this area, and he
would like to make this property nice. Enviranment and pollution problems concem him also.
He was asked to demolish the attic and the second floor.
Gerry Strathman asked how long it will take to get this building into a condition so that the code
compliance can be done. Mr. Tsvetovat responded February or Mazch. If the weather gives him
a chance, he will demolish the properiy before winter and a big snow.

Mr. Strathman asked why weather is an issue as tlus is inside work. Mr. Tsvetovat responded the
inside has no heat and there are some struchual probiems. He pians to open one wali.
If the Fire Deparnnent will not send inspectors in the building, Mr. Strathman asked, who will do
this inspection. Mr. Tsvetovat responded subcontractors.
Mr. Strathman asked how long the demolition will take. Mr. Tsvetovat responded days.
Mr. Strathman stated this building has been vacant for a year and is ohviously a blighting
influence on the neighborhood. He cannot see how the City could continue to let this situation
exist for two to three months. Then there will be rehabilitation time after that. If the demolition
can be done in days, it could be done now instead of February. Mr. Tsvetovat responded he
cannot promise, but he will try.
Ms. Marshall stated she was under the impression that the top two floors had to come ofF
completely. She asked did Mr. Magner say they have to be gutted out. Mr. Magner responded
Phil Owens with the Fire Department would dictate what would haue to be completed to
facilitate this project. Mr. Owens opinion is that everything from the fust floor ceiling would
haue to be stripped out and gutted. Whethex that requires the whole second floor and attic to be
removed versus being stripped down to the bare studs, is probably open to question until the
work is started. If the fire is extensive enough to compromise the structural ability of the studs
andlor their associate members, that area will need to be removed. There aze some structural and
foundation problems that ea�tend all the way up. Until the deconstructian or removal of the walls,
there is no definite answer.
Gerry Strathman recommended approval. He understands the desire to sell the building and
rehabilitate it, but he is concerned the effect the building has on the City and that it has sat in this
condition for almost a year. Without a code comptiance, no bond can be posted

the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.
Steve Magner reported the owner has posted a bond, obtained permits, had a code inspection, and
has started repairs on the property. The owner purchased the building right after public hearings
were scheduled. Mr. Magner informed him they had to follow through with this public hearing,
but ihat Mr. Magner will recommend 180 days.
Gerry Strathman recommended granting six months to complete rehabilitafion on the property.

Gerry Strathman called the meeting to order at 10:03 a.m.
Appeal of summary abatement order at 703 Fnller Avenne.
Dick Lippert reported that he came to an agreement with the owners, who indicated they would
call to check on getting their money back.
Gerry Strathman recommends denying the appeal and said he did not receive a call from the
owners.
Resolufion ordering the owner to remove or repair the buiiding at 1093 Seventh Street
Westi520 Bav Street. If the owner fails to compiy with the resolution, Code Enforcement is
ordered to remove the building.
The following appeazed: Robyn Mazshall, owner, and Boris Tsvetovat, potential buyer.
Steve Magner reported there aze two addresses on this building. The building was condemned in
December 1999 and vacant since then. Three summary abatement notices have been issued to
secure the dwelling, remove unsecured vehicle, remove debris, cut grass. On 8-21-00, an
inspection of the building was conducted and a list of deficiencies which constitute a nuisance
condition was developed and photographs were taken. This property remains in a condition that
comprises a nuisance as defined by the legislarive code. The vacant building fees are paid. Real
estate t�es aze paid. Estimated market value is $56,200. A code compliance inspection has not
been applied for nor a$2,000 bond posted. The estimated cost to repair is $80,000. The
estimated cost to demolish is $10,000 plus the cost for toxic waste removal.
A fire broke out in this building because of a methamphetamine lab on the second floor,
explained Mr. Magner. Waste &om the lab was thrown out the attic window. Some waste has
been cleaned up, but there aze toxic chemicals left in the walls and debris of the building. The
Fire Depardnent is going to require the second floor and attic be completely gutted prior to any
remedial repairs to this building. The building has been boarded, aud this is probably why no
inspection has been completed. The City is unwilling to go into this building due to the
hazardous contamination.
Boris Tsvetovat stated he buys and remodels properties. He is interested in this area, and he
would like to make this property nice. Enviranment and pollution problems concem him also.
He was asked to demolish the attic and the second floor.
Gerry Strathman asked how long it will take to get this building into a condition so that the code
compliance can be done. Mr. Tsvetovat responded February or Mazch. If the weather gives him
a chance, he will demolish the properiy before winter and a big snow.

Mr. Strathman asked why weather is an issue as tlus is inside work. Mr. Tsvetovat responded the
inside has no heat and there are some struchual probiems. He pians to open one wali.
If the Fire Deparnnent will not send inspectors in the building, Mr. Strathman asked, who will do
this inspection. Mr. Tsvetovat responded subcontractors.
Mr. Strathman asked how long the demolition will take. Mr. Tsvetovat responded days.
Mr. Strathman stated this building has been vacant for a year and is ohviously a blighting
influence on the neighborhood. He cannot see how the City could continue to let this situation
exist for two to three months. Then there will be rehabilitation time after that. If the demolition
can be done in days, it could be done now instead of February. Mr. Tsvetovat responded he
cannot promise, but he will try.
Ms. Marshall stated she was under the impression that the top two floors had to come ofF
completely. She asked did Mr. Magner say they have to be gutted out. Mr. Magner responded
Phil Owens with the Fire Department would dictate what would haue to be completed to
facilitate this project. Mr. Owens opinion is that everything from the fust floor ceiling would
haue to be stripped out and gutted. Whethex that requires the whole second floor and attic to be
removed versus being stripped down to the bare studs, is probably open to question until the
work is started. If the fire is extensive enough to compromise the structural ability of the studs
andlor their associate members, that area will need to be removed. There aze some structural and
foundation problems that ea�tend all the way up. Until the deconstructian or removal of the walls,
there is no definite answer.
Gerry Strathman recommended approval. He understands the desire to sell the building and
rehabilitate it, but he is concerned the effect the building has on the City and that it has sat in this
condition for almost a year. Without a code comptiance, no bond can be posted

Steve Magner reported the owner has posted a bond, obtained permits, had a code inspection, and
has started repairs on the property. The owner purchased the building right after public hearings
were scheduled. Mr. Magner informed him they had to follow through with this public hearing,
but ihat Mr. Magner will recommend 180 days.
Gerry Strathman recommended granting six months to complete rehabilitafion on the property.

obtained by Division of Code Enforcement on or before July 28, 2000, the following aze the now known

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolirion and removal of this building(s) is estimated to exceed three
thousand dollazs ($3,000.00).
That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties
to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Enforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division of
Code Enforcement, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this resolution and
that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property safe and not
detrimental to the public peace, health, safety and welfare and remove its blighting influence on the
community by rehabilitating this structure and correcting all deficiencies as prescribed in the above
referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and
ordinances, or in the alternative by demolishing and removing the structure in accordance with all
applicable codes and ordinances. The rehabilitation or demolition and removal of the shucture
must be completed within��53' days after the date of the Council Hearing.

If the above corrective action is not complete within this period of time the Citizen Service Office,
Division of Code Enforcement is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the Subject
Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.

1 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
2 property or fixtures of any kind which interfere with the demolition and removal shall be removed
