Merit System. A merit system shall be permanently established for positions in the city of Saint Paul. Sec . 12 . 02. Civil Service Commission. There shall be a civil service commission consisting of three members appointed by the mayor with the consent of the council and the board of education of independent school district number 625. Terms shall be six years , except that one of the three members first appointed shall serve for a term of two years and one for a term of four years. All appointments shall be from among the qualified voters of the city who are in known sympathy with the application of inerit principles to public employment . The council may, by administrative ordinance , provide compensation and reimbursement of expenses for the commissioners. Any member may be removed by the council for cause after a hearing. Proceedings for removal may be initiated by the mayor ,e� the council , or the board of education. Sec. 12. 03. Classified and Unclassified. Sec. 12. 03. 1 . Civil Service Divisions. The civil service of the city of Saint Paul shall consist of the classified and un- classified service. . .,.r...... � n � Sec . 12.03 . 2. Unclassified Service. The unclassified service shall comprise : (A) Elected officials. (B) Heads of executive departments. (C) A secretary to the mayor. � �D) The city attorney and deputy and assistant city attorneys , subject to Section 5 .03. � (E) The fire chief, and police chief, and personnel director. (H) Such additional positions as shall be assigned by ordinance to the unclassified service, with the consent of the civil service commission. � Sec. 12.03.3. Classified Service. The classified � service shall include all other positions in the city service, including offices hereinafter created and not excluded therefrom. All classified employees shall en- joy the benefits and protection and be subject to the civil service rules and no permanent employee in the classified service shall be discharged except for cause , and upon such hearing as the civil service rules or other law prescribe. � Sec. 12. 04. Duties of the Civil Service Commission. Hearing of Grievances. The civil service rules sha 1 include provisions estab- lishing a formal procedure for . the �review of employee grievances not cov�red under labor agreements. After exhausting the orma grievance proce ure, t e complain- ing employee may petition the ci.vil service commission for a hearing and the commission shall, within a reason- , able time, conduct a hearing at wh�ich all parties to the grievance or their representatives may be heard. Follow- ing �he hearing, the �commission shall promptly rule on the grievance petition. Its decision shall have such binding effect as the civil service rules prescribe. 6ee.--��.-94.-3.- � Sec. 1�2. 04.�2 . Studies. Civil Service Rules and Amendments. The rules shall deal with all matters necessary to the administration of the city perso�nel system on a merit basis. The council may b� reso- lution adopt any or all of such rules with or without amend- ment or they may initiate their own proposed rules;. Such rules or amendments which are approved by the couricil shall. be submitted�with�n five days of the'ir passage to the civil service commission for their approval or rejection. Status of Employees and Officers. Sec. 12. 07.1. Retention of Positions. Every person holding a probationary or regular appointment to a position in the classified service��at��the time this charter takes effect shall retain his� 'or h�er position until discharged, promoted, or transferred in accordance with the provisions of this charter and the personnel` rules. Probationary employees shall acquire �such protection at the completion of their probationary period in the same manner as if this _ chart�r: had not been adopted. Sec. 12.07.2. Employees ' Rights and Salaries. Allowances for vacation, sick leaves, perision and retirement, and other rights of employees accrued when this charter takes effect, shall not be affected by the adoption of this charter. Protection of Employees in Newly Un- classified Positions. When a position iri the unclassified service is created under terms of �this charter, an erson who has served satisfac�torily in the affected position for at least five continuous years prior to the posit�ion change shall be entitled to retain, for two years or urit�il� 'trans- ferred into a classified job, whichever is the �shorter period, all rights and privileges to which that� person wou d ave een entitled in a classi�fied �ob. Sec. 12. 07. 4. No change in job title shall diminish or otherwise affect the rights granted by this section to present holders of classified and unclassified positions. Sec�-12.08. Prohibition of Payment. No disbursing officer of the city shall pay any comperisation for services to any person holding a position in the classified service unless the payroll or account for the compensation bears � the certificate of . the director of personnel that .he or she � has been appointed or employed and is performing service n accordance with the provisions of this charter and the rules established hereunder. : Sec. 12.09. Collective Bargaining Agreements. The council and the boarcl of education� �of �independent school dist�rict number 62 s a recognize bargaining agents for apprapriate employee units in accordance with state law and �may, by resolution , enter into collective bargaining agreements to the extent not prohibit�d by law. Such agreements may con- tain provisions dealing with wages, hours , fringe benefits, working conditions, .griedances, and arbitration of disputes as the council 'or the board of education c�eems appropriate. -7- . Incapacitated Employees. Any fireman fighter or police officer injured in actual service and thereby rendered incapable of performing his duty shall receive full pay during the period of incapacity not exceeding 12 months. In the case of disability through injury or sickness other than as hereinbefore mentioned, such fire�ar�fighter or polic_e officer shall notwithstanding such injury or sickness,� receive his o'r her salary for a . period not exceeding six months. The c—ity council may increase the benefits hereunder by appropriate action through administrative ordinance. Employees injured or incapacitated by illness in the line of duty shall be entitled to reinstatement at any time with- in five years from the date of injury or incapacity, if physically capable of resuming their duties. Sec-.---12. 11. ��ek�l��t�ens.- Proh�ibited Personriel Practices. Wi�thin the framework of the meri�t 'system, the following personne practices shal e prohi ited. Sec. 21.11. 1. Discrimination. No person in the classi- fied service of the city or seeking admission thereto shall be appointed, promoted, reduced, removed, or in any way � favored or di.scriminated against because of his race, color, creed, �age, sex, religion,� haridicap, national origin, or � , po itical opinions or affiliations. Sec. 12. 11.2. Political Influence. No person in the � unclassi�ied service shall solicit a contribution or assess- ment for any political purpose from any person in the classi- fied service. No person in the service of the city shall use his or her official authority to influence or coerce the politi al action of any person or body or to interfere with any nomination or election to any public office, or during his or her hours of duty engage in any political activities. 8. � o-��-f�'� . : . : - - - G���-��� - � . � � � . �7���- Sec. 12. 11.3. Employee Actions. No person in the service of the city shall be penalized, denied a job or job advancement, or otherwise harmed �for: (A) The lawful disclosure of information wh�ich such person believes is� a violation 'of law, mismanagement, abuse of authority, or sub- stantial danger to ublic health or safety, and which is not ot�ise �prohibited by law. (B) The exercise of any appeal right which� does not adversely affect the employee's or appli- cant s performance� or the performance of others. � Sec. 12 .11. 4. Personne'1 Actions. No pe'rsonnel action shall be taken or denied which .violates the merit principles of Sec. 1�1 o t e c art�er. Sec. 12.12. Duties and Procedures. Each respective committee shall provide for competitive examinations to . test the relative fitness of candidates, the grading of candidates , and the certification to the mayor of the five best qualified candidates. The examining committee shall give notice of examinations in the same manner as required in examinations for filling vacancies in the classified service. The council shall provide for the payment of reasonable and necessary expenses of the com- mittee and for staff help throu h the personnel director or otherwise as the mayor s a arrange. Sec. 12. 12. 3. Appointment. Except as provided in 12. 12. 5, upon receiving from a qualifications and examining committee five names, the mayor shall appoint one of said certified names , subject to the approval of city council. If the council does not approve the appointment, the mayor shall in turn appoint each of the remaining candidates , each subject to council approval . If the council approves none of the candi- dates, the candidate who has received the highest grading by , the committee shall be appointed without further action by the mayor or council . . Sec. �����T3.- 12. 12.4. Tenure of Police Chief, Fire Chief and Personnel Director. The term of each police chief, fire chief e€-gE�}ee and personnel director shall commence upon the expiration of the preceding term and they shall , except as providE.d in this section, serve a term of six years and until their successors are �s appointed and qualified. During the first year of l��s a term, a l�e police chief, fire chief, or personnel director may be removed by the mayor upon written nc�tice and approval by the city council �y-�}�re-�e�es. In that event and ` in any other case when a vacancy occurs, the mayor;-e� �l�e-�ea�-e€-��.e-de�a��c�e��-�€-��ie-x�a}e�-se-�es}g�a�es,- shall appoint an acting e�i�e� person, and the eex�}ss}er� committee herein provided for shall forthwith arrange for an examination to determine eligibles to fill any ��ie vacancy. The beginning and ending of the term of the incumbent pe��ee shall not be affected by adoption of this chapter, but the provisions of it shall apply to all vacancies for the positions of police chief, fire Chief, and personnel director, which shall occur thereafter. Sec. 12. 12. 5. Notwithstanding .any other provision of law -- to- the contrary, upon expiration of the present terms of office of the fire chief arid police chief, the present incumbent shall continue as fire chief and police chief for the next six years or first six year term authorized in Section 12. 12.4. This section shall expire December 31 , 1994. Sec. 12. 13. Reinstatement. The civil service rules shall provide for the reinstatement of any employee in the classified service who shall take leave to serve in �he unclassified service, in a position of equivalent salary and tenure to that which �ie the employee held prior ta such leave, upon termination of Y�}s the employee' s service in the unclassified service.
