WHEREAS, the Mayor of the City of Saint Paul has established a Personnel
Issues Task Force to review the personnel system of the City and to provide
recoimnendations on how the City personnel system may be improved; and
WAEREAS, the Personnel Issues Task Force has completed its study; and
WAEREAS, one recommendation made by this task force is that the Mayor
should be made directly responsible for monitoring the performance of the
personnel function of the City; and
WAEREAS , independent studies and review by the Mayor' s Office have
resulted in determinations si.milar to those recommendations set f orth in the
Personnel Issues Task Force report; and
WHEREAS, it is therefore desirable to amend Chapter 3 , Chapter 9, and
Chapter 12 of the Saint Paul City Charter; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul, upon the request of
the Mayor, does hereby recommend that the Saint Paul Charter Commission
favorably consider amending Chapter 3 , Chapter 9, and Chapter 12 of the City
Charter pursuant to the provisions of the ordinance attached hereto and
containing the suggested amendments, so as to permit the City Council by
ordinance enactment to adopt such Charter amendments; and, be it
FURTHER RESOLVID, that the Council of the City of Saint Paul requests said
Charter Commission, after its revfew and consideration of said Charter
amendments, to recommend said amendments to the City Council pursuant to
Minnesota Statutes 410 .12, Subdivision 7; and, be it
FINALLY RESOLVED, that the City Clerk is directed to transmit a copy of
this resolution, with the attached ordinance draf t, to the Secretary of the
Saint Paul Charter Commission.

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
Pursuant to Minnesota Statutes 410 .12 , Subdivision 7, and upon
recommendation of the charter commission of the city of Saint Paul,
the charter of the city of Saint Paul is amended in Section 3 .01.3 ,
9 . 02 , 12 . 01 , 12.02, 12.03 , 12.04, 12.05, 12.06, 12.11 , and 12.12
thereof so that the same shall read:

Sec. 12.02. Civil Service Commission. There shall be a civil
service commission consisting of three members appointed by the mayor
with the consent of the council . Terms shall be six years, except
that one of the three members first appointed shall serve f or a term
of two years and one for a term of four years. All appointments shall
be from among the qualified voters of the city who are in known
sympathy with the application of inerit principles to public
employment. No member may hold any office or employment under the
city; provided, however, members of the police commission may serve on
the civil service commission. A member shall cease to be a member of
the commission upon becoming a candidate for elective city office.
The council may, by administrative ordinance, provide compensation and
reimbursement of expenses for the commissioners. Any member may be
removed by the council for cause after a hearing. Proceedings for
removal may be initiated by the mayor or the council.
Sec. 12.03. Classifiecl and Onclassified.
Sec. 12.03 .1 . Civil Service Divisions. The civil service of
the city of Saint Paul shall consist of the classified and
unclassified service.
Sec. 12. 03 .2. Onclassified Service. The unclassified service
shall comprise:
(A) Elected officials.
(B) Heads of executive departments.

(C) A secretary to the mayor.
(D) The city attorney and deputy and assistant city
attorneys, subject to Section 5.03.

service rules shall incluc3e provisions establishing a formal procedure
for the review of employee grievances. After exhausting the formal
grievance procedure, the complaining employee may petition the civil
service commission for a hearing and the commission shall, within a
reasonable time, conduct a hearing at which all parties to the
grievance or their representatives may be heard. Following the
hearing, the commission shall promptly rule on the grievance petition.
Its decision shall have such binding effect as the civil service rules
prescribe.

make studies at the request of the mayor or the council or on its own
motion concerning the enforcement and eff ect of this chapter and the
observance of the provisions and the rules established hereunder.

Sec. 12.07. Status of I�nployees and Officers.
Sec. 12.07 .1 . Retention of Pbsitions. E�ery person holding a
probationary or regular appointment to a position in the classified
service at the time this charter takes effect shall retain his
position until discharged, promoted, or transferred in accordance with
the provisions of this charter and the personnel rules. Probationary
employees shall acquire such protection at the completion of their
probationary period in the same manner as if this charter had not been
adopted.
Sec. 12.07 .2 . Bmployees' Rights and Salaries. Allowances for
vacation, sick leaves, pension and retirement, and other rights of
employees accrued when this charter takes effect, shall not be
affected by the adoption of this charter. No salary of any present
city employee shall be reduced as a result of the adoption of this
charter.

Sec . 12 . 07 . 4 . No change in job title shall diminish or
otherwise affect the rights granted by this section to present holders
of classified and unclassified positions.
Sec. 12.08. Prohibition of Payment. No disbursing officer of
the city shall pay any compensation for services to any person holding
a position in the classified service unless the payroll or account f or
the compensation bears the certificate of the director of personnel
that he has been appointed or employed and is perf orming service in
accordance with the provisions of this charter and the rules
established hereunder.
Sec. 1 2.0 9. Collective Bargaining Agreements. The council shall
recognize bargaining agents for appropriate employee units in
accordance with state law and may, by resolution, enter into
collective bargaining agreements to the extent not prohibited by law.
Such agreements may contain provisions dealing with wages, hours,
fringe benefits, working conditions, grievances, and arbitration of
disputes as the council deems appropriate. �?-±�-�terri.

Sec . 12 .10. Incapacitated Saployees. Any fireman or police
officer injured in actual service and thereby rendered incapable of
performing his duty shall receive full pay during the period of
incapacity not exceeding 12 months. In the case of disability through
injury or sickness other than as hereinbefore mentioned, such fireman
or police officer shall notwithstanding such injury or sickness ,
receive his salary for a period not exceeding six months. The city
council may increase the benefits hereunder by appropriate action
through administrative ordinance.

Employees injured or incapacitated by illness in the line of duty
shall be entitled to reinstatement at any time within f ive years from
the date of injury or incapacity, if physically capable of resuming
their duties.

Sec. 12.11 .1 . Discrimination. No person in the classified
service of the city or seeking admission thereto shall be appointed,
promoted, reduced, removed, or in any way favored or discriminated
against because of his race, color, cr.eed, sex, -re�-i�gi�etr,-national
origin, or political opinions or affiliations.
Sec . 12 .11 .2 . Political Influence . No person in the
unclassified service shall solicit a contribution or assessment for
any political purpose from any person in the classified service. No
person in the service of the city shall use his official authority to
influence or coerce the political action of any person or body or to
interfere with any nomination or election to any public office, or
during his hours of duty engage in any political activities.

competitive written and oral examinations to test the relative f itness
of candidates, the grading of candidates, and the certification to the
mayor of the three best qualified candidates. The mayor shall appoint
one of the three candidates, subject to approval of the council. If
one of the certified candidates, subject to council approval . If the
council fails to approve him, the mayor shall appoint the remaining
candidate, subject to council approval . If the council fails to
approve him, the person who has received the highest rating by the
committee shall become the chief of police without further action by
the mayor or council . The examining committee shall give notice of
examinations in the same manner as required in examinations f or
filling vacancies in the classified service. The council shall
provide for the payment of reasonable and necessary expenses of the

Dear Council Members:
It gives me great pleasure to transmit to you today my thoughts
and recommendations on where we , together , should take the
personnel management system of the City of St. Paul .
My thoughts and recommendations are based upon the advice of
the Personnel Issues Task Force , which concluded its work
last Monday, April 16 , and upon 31 meetings held by me and
the Personnel Director , Thomas Gleason, with bargaining units,
employee groups and interested citizen groups.
Let me begin by saying that there is broad consensus on the
need for modernization of our personnel management system.
The Personnel Issue s Task Force recommendations, which are
attached to this letter , capture precisely the key elements
of that modernization.
David Lilly, Chair of the Personnel Issues Task Force, has
reported to you on the major provisions of the task force ' s
recommendations. Our focus today is on those changes requiring
charter reform. My proposed charter revisions, attached, vary
from the recommendations of the Personnel Issues Task Force
in only a handfull of areas:
l. I recommend charter language which establishes a term of
six years for the Personnel Director .
2 . I recommend that the present charter language providing
for Civil Service Commission approval of the conversion
of classified positions to unclassified not be chanqed.
3 . On additional unclassified appointments by the Mayor :
I depart from the task force ' s advice and will not pursue
additional unclassified appointments, except for the

positions of Director of Personnel and his or her immediate
two subordinates.
4 . A matter not discussed by the Personnel Issues Task Force :
I recommend that the term of the Fire Chief be converted
to a six-year term exactly analogous to that proposed for
the Personnel Director and currently in place for the
Police Chief .
5 . I propose new charter language which will cause to be
reappointed in the year 1995 another Personnel Issues Task
Force which shall review and report to the Mayor in 1996
their recommendations regarding personnel management practices
of the City of St. Paul. We are today reviewing Chapter 12
of the 1972 Charter after 12 years; we ought to review it
again, 12 years from now.
I wish to reaffirm that these recommendations in no way diminish
any rights, especially wages, secured through collective bar-
gaining. No changes to the personnel management system which
might affect bargained labor contracts will be implemented un-
less first negotiated.
With regard to merit increase s, I agree that the passage of
time is an appropriate yardstick to initiate a performance re-
view and consider the awar d of a merit increase . I do not
agree , however , that the passage of time, or longevity, is an
adequate criteria for an increase in salary, via the merit
increase .
The basis of a merit increase should be performance . Support
for that assertion comes, importantly, from our employees as
expressed in the survey conducted last year .
Our current system is indeed flawed: It should be changed, but
not in the way which the taskforce has recommended.
With these exceptions or additions, I commend to you with the
strongest possible support the analysis and recommendations of
the Personnel Issues Task Force and of its staff, Institute of
Public Administration. The year and one-half process which
the Personnel Issues Task Force went through in reviewing our
personnel management system, evaluating other systems, and
developing a set of recommendations has been difficult work
for staff and task force members alike . The work is outstanding.
The task force is to be commended, and as a token of the City ' s
appreciation for their work, I have prepared and will distribute
to taks force members a certificate of commendation for their

Section 3.
Pursuant to Minnesota Statutes 410.12, Subdivision 7, and upon
recommendation of the charter commission of the city of Saint Paul, -
the charter of the city of Saint Paul is amended in Sections 12.01,
12. 02 , 12 . 03, 12.04, 12. 05, 12.06 , 12. 07, 12. 08, 12. 09, 12.10,
12.11, 12.12 and 13 thereof so that the same shall read:
Sec. 12. 01. Merit System. A merit system shall be
permanently established for positions in the city of
Saint Paul. All personnel' prac�tices �shall b�e imple-
mented consistent wit the following principles:
(A) Recruitment, selection, and advancement of
employees on the basis of their relatibe
knowledge, skills, abilities�, and competence
for the position which the hold or for which
they are applying or may be appointed;
(B) Equitable compensation and benefi�t plaris;
lC) rmprovemerit in job pe�rforinance through trai�ning
and education reflecting chan es in wor7cforce
concepts and tec no ogical advarices;
(D) Compensation, retention�, advancement, and
separation of employees on t e basis of job

their prs.vacy and constitutional rig ts; and
(F) Protection of employees from arbitrary action,
personal favoritism, political coercion, or

Sec . 12 . 02. Civil Service Commission. There shall be a
civil service corrimission consisting of three members appointed by
the mayor with the consent of the council and the board of education
of independent school district number 625. Terms shall be six
years , except that one of the three members first appointed shall
serve for a term of two years and one for a term of four years.
All appointments shall be from among the qualified voters of the
city who are in known sympathy with the application of inerit
principles to public employment. No member may hold any office or
employment under the city. p�e��de�,--�iewe�e�,--x�e�be�s-e�-�l�e-pe�}ee
ee�aaa�ss�e�-x�a�r-se��e-e�-��ie-�}���-se��r}ee-eex��ss}e�.- A member
shall cease to be a member of the commission upon becoming a candi-
. date for elective city office. The council may, by administrative
ordinance , provide compensation and reimbursement of expenses
for the commissioners. Any member may be removed by the council
for cause after a hearing. Proceedings for removal may be initiated
by the mayor, e� the council , or the board of education.
Sec . 12. 03 . Classified and Unclassified.
Sec. 12. 03. 1 . Civil Service Divisions. The civil 5ervice
of the city of Saint Paul shall consist of the classified and un-
classified service.

Sec. 12. 03. 2. Unclassified Service. The unclassified service
shall comprise :
(A) Elected officials.
(B) Heads of executive departments.
(C) A secretary to the mayor.
� (D) The city attorney and deputy and assistant city
attorneys , subject to Section 5. 03. '
(E) The fire chief, and police chief, and personnel
director.

(G) Members of boards and cammissions.
(H) Such additional positions as shall be assigned
by ordinance to the unclassified service, with
the consent of the civil service commission. �
Sec. 12.03. 3. Classified Service. The classified
service shall include all other positions in the city
service, including offices hereinafter created and not
excluded therefrom. All classified employees shall en-
joy the benefits and protection and be subject to the
civil service rules and no permanent employee in the
classified service shall be discharged except for cause
, and upon such hearing as the civil service rules or other
law prescribe.

The civil service rules shall include provisions estab-
lishing a formal procedure for . the �review of employee
grievances not cov�red under labor agreements. After
exhausting the orma grievance proce ure, t e complain-
� ing employee may petition the civil service commission
for a hearing and the commission shall, within a reason-
, able time, conduct a hearing at wh�ich all parties to the
grievance or thei:r representatives may be heard. Follow-
ing the hearing, the �commission shall promptly rule on
the grieva.nce petition. Its decision shall have such
binding effect as the civil service rules prescribe.

shall make studies at the request of .the mayor or the
council or the board of education of indep'endent� school
district number 6 5 or on its own motion concerning the
enforcement and effect of this chapter and the observance
of the provisions and the rules established hereunder.

tent with the charter as the council may prescribe by

Sec. 12.04 . 4. Investigations. Any person who believes

of the city in a manner consistent' with the provisions of

Sec. 12. 06. Civil Service Rules and Amendments. At the

on his or her own initiative, the director of personnel
• shall prepare personnel rules for review bp-the-CYCt�-sernree
eex�}es�en and adoption by the council. The rules shall deal
with all matters necessary to the administration of the city
personnel system on a merit basis. The council may by reso-
lution adopt any or aIl of such rules with or without amend-
ment or they may initiate their own proposed rules;. Such
rules or amendments which 'are 'approved b the couricil shall �
be s mitted within five days of the'ir passage to the civil
service commission for t eir approval or re�ectzon. Within
10 business days the civil service co�nission shall either
approve and sign the measure or s all return it to the council
with a communication in writing stat�ng their disapproval and

the reason therefor. If the commission neither signs
nor vetoes the measure within 10 business davs it shall

Sec. 12. 07. Status of Employees and Officers.
Sec. 12. 07.1. Retention of Positions. Every person
holding a probationary or regular appointment to a position
in the classified service��at��the time this charter takes
effect shall retain his� 'or her position until discharged,
promoted, or transferred in acaordance with the provisions
of this charter and the personnel` rules. Probationary
employees shall acquire _�such protection at the completion
of their probationary period in the same manner as if this
_ chartex: had not been adopted.
Sec. 12.07.2. Employees ' Rights and Salaries. Allowances
for vacation, sick leaves, pension and retirement, and other
rights of employees accrued when this charter takes effect,
shall not be affected by the adoption of this charter. No
salary of any �resent current e�rt� employee shall be reduced

Sec. 12. 07. 3. Prot�ection of Employees in Newly Un-
classified Positions. When a positian iri the unclassified
service is created under terms of this charter, an erson
who has served satisfac�torily in the affected position for
at least five eontinuous years prior to the posit�ion change
shall be entitled to retain, for two years or urit�il� 'trans-
ferred into a classified .job, whichever is the �shorter
period, all rights and privileges to which that� pe"rson
wou d ave een entitled in a classi�fied �ob.
Sec. 12. 07.4. No change in job title shall diminish or
otherwise affect the rights granted by this section to
present holders of classi�fied and unclassified pos.itions.
Sec�-12.08. Prohibition of Payment. No disbursing
officer of the city shall pay any comperisation for services
to any person holding a position in the classified service
unless the payroll or account for the compensation bears �
the certificate of . the director of personnel that he or she
� has been appointed or employed and is performing serviae
accordance with the provisions of this charter and the rules
established hereunder.
; Sec. 12.09. Collective Bargaining Agreements. The council
and the board of education� of independent school dist�rict
number 62 s a recognize argaining agents for apprapriate
employee units in accordance with state law and �may, by
resolution, enter into collective bargaining agreements to
the extent not prohibited by law. Such agreements may con-
tain provisions dealing with wages, hours , fringe benefits,
working conditions, gr-ievances, and arbitration of disputes
as the council `or the board of education deems appropriate.

Sec. 12.10. Incapacitated Employees. Any fireman
fighter or police officer injured in actual service and
thereby rendered incapable of performing his duty shall
receive full pay during the period of incapacity not
exceeding 12 months. In the case of disability through
injury or sickness other than as hereinbefore mentioned,
such firetnanfighter or polic.e officer shall notwithstanding
such injury or sickness,� receive his or h�er salary for a
. period not exceeding six months. The c y council may
increase the benefits hereunder by appropriate action
through administrative ordinance.
Employees injured or incapacitated by illness in the line
of duty shall be entitled to reinstatement at any time with-
in five years from the date of injury or incapacity, if
physically capable of resuming their duties.
Sec�-��12 .11. ��e��H�t�eas.- ProNibit�ed Personriel Practices.
Within the framework of the me�rit `systezn, the following
personne practices shal e pro ibited.
Sec. 21.11. 1. Discrimination. No person in the classi-
fied service of the city or seeking admission thereto shall
be appointed, promoted, reduced, removed, or in any way
favored or discriminated against because of his race, color,
creed, �age, sex, religion,� handicap, national origin, or
, po itical opinions or affiliations.
Sec. 12. 11.2. Political Influence. No person in the
� unclassi�ied service shall solicit a contribution or assess-
ment for any political purpose from any person in the classi-
fied service. No person in the service of the city shall
use his or her official authority to influence or coerce
the politic 1 action of any person or body or to interfere
with any nomination or election to any public office, or
during his or her hours of duty engage in any political
activities.

Sec. 12. 11.3. Emplo ee Actions. No person in the
service of the city shall be pena ized, denied a �ob
or job advancement, or otherwise harmed �for:
(A) The lawful disclosure of information wh�ich
such person believes is� a violation �of law,
mismanagement, abuse of authority, or sub-
stantial danger to public health or safety,
and which is not otherwise prohibited by law.
(B) The exercise of any appeal right which� does
not adversely affect the employee 's or a pli-
cant s performance� or the performance of others.
� Sec. 12 .11.4. Personne�l Actions. No personnel action
shall be taken or denied which violates the me=it principles

Sec. 12. 12.2. Duties and Procedures. Each respective
committee shall provide for competitive examinations to
. test the relative fitness of candidates, the grading of
candidates , and the certification to the mayor of the
five best qualified candidates. The examining committee
shall give notice of examinations in the same manner as
required in examinations for filling vacancies in the
classified service. The council shall provide for the
payment of reasonable and necessary expenses of the com-
mittee and for staff help through the personnel director
or otherwise as the mayor s a arrange.
Sec . 12. 12. 3. Appointment. Except as provided in 12. 12. 5,
upon receiving from a qualifications and examining committee
five names , the mayor shall appoint one of said certified
names , subject to the approval of city council. If the council
does not approve the appointment, the mayor shall in turn
appoint each of the remaining candidates , each subject to
council approval . If the council approves none of the candi-
dates, the candidate who has received the highest grading by
, the committee shall be appointed without further action by the
mayor or council . .
Sec. ��:��.-3 .- 12 . 12.4. Tenure of Police Chief, Fire
Chief and Personnel Director. The term of each police
chief, fire chief e€-pE��ee and personnel director shall
commence upon the expiration of the preceding term and
they shall , except as providE.d in this section, serve a
term of six years and until their successors are �s
appointed and qualified. During the first year of �i�s
a term, a �ie police chief, fire chief, or personnel
director may be removed by the mayor upon written nc�tice
and approval by the city council by-��ve-�e�es. They

in any other case when a vacancy occurs, the mayor;-e�

chapter, but the provisions of it shall apply to all
vacancies for the positions of police chief, fire chief,
and personnel director, which shall occur thereafter.
Sec. 12. 12. 5. Notwithstanding .any other provision of Iaw
- to- the contrary, upon expiration of the present terms of
office of the fire chief and police chief, the present incumbent
shall continue as fire chiet and police chief for the next
six years or first six year term autharized in Section 12. 12.4.
This section shall expire December 31 , 1994.
Sec. 12. 13. Reinstatement. The civil service rules
shall provide for the reinstatement of any employee in
the classified service who shall take leave to serve in
�he unclassified service, in a position of equivalent
salary and tenure to that which ke the employee held prior
to such leave, upon termination of �i�s the employee's
service in the unclassified service.
