Christ ' s Household of Faith , Inc . -- Vernon Harms APPEARANCE: Vernon Harms SUBJECT: Request a variance pertaining to basic facilities , to allow continued use of bathroom outside units with a ratio that does not meet code, and request an extension of time to allow lighting violations to be corrected. PROCEEDINGS : Mr. Harms introduced himself stating he lives in the house at 355 Marshall and is one of the administrators of Christ Household of Faith. He stated there are 20 full baths and 6 half baths , one half bath has two showers . Jack Mueller said this building falls under the conditions of a lodging house where the ratio is five persons to each bath. He stated they are making progress and have the intent to upgrade the facility. They have been very cooperative with the city and keep a very clean establishement. Therefore, Jack felt he would have no objection to an ample extension of time for correcting the bathroom violations as well as the lighting. BOARD ACTION: Rudy Sawyer moved to grant a two year extension of time on condition appellant stay in contact with the city and show progress in correcting the violations pertaining to basic facilities . Lucille Collins seconded the motion. MOTION CARRIED. Bill Tilton moved to grant a 60 day extension of time to correct the lighting violations . Lucille Collins seconded the motion. • MOTION CARRIED. Walker (owner) Miranda & Billy Smith (tenants) SUBJECT: Request extension of time to do the repairs listed in the inspector' s report of May 8 , 1984 , as Mr. Walker says he has been unable to gain entrance to the p.roperty . PROCEEDINGS : Mr. Walker stated he has made numerous attempts to gain entrance to this property. The tenant, i�r. Walker says , has been very beligerent and uncooperative. He has retained an attorney and i's in the process of evicting them. Frank Staffenson said the violation items are listed in the May 8 , 1984 letter to Mr. Walker, but there is one additional item of standing sewage in the basement. Frank said this is even more imperative than the 8 items listed in the May 8th letter. Mrs. Smith stated that again on June 4 they have sewage in the basement. They were told not to talk to Mr. Walker by .his attorney, so they contacted his attorney regarding this, both by phone and in a letter. Mr. Walker, Mrs . Smith maintains , had been on the property just this past week , and on six different occasion. Mrs. Smith feels because they asked to have the repairs made, Mr. Walker then asked them a week later to leave the premises and gave them eviction notice. Mr. Smith substantiated by dates of notice that the eviction is a direct attempt to punish them for asking for needed repairs . Ron Glassman stated the board does not �et into eviction notices . we have no control over this . �de have some violations of code, and this is what we are concerned about, Ron said.� He asked Mr. Walker if he was prepared to do the work and he answered in the affirmative. He asked the Smiths if they would give him access to the premises if he called first. They both emphatically said yes . Mr. Walker assured Frank Staffenson that the sewer has now been unplugged and the standing sewage has been taken care of . BOARD ACTION: Rudy Sawyer moved to grant a 30 day extension (7-12-84) to complete` the 'work listed in the inspector' s report. Glenn Gausmin seconded the motion. MOTION CARRIED.
