RESOLVED, That upon petition of Donaldson Company, that section of public
street hereinafter described, be and the same hereby is vacated and discontinued
as public street:
A two-foot strip of land abutting and adjoining the northwesterly
line of Block 5, Kentucky Terrace and the northwesterly line of
Block 5 Palisade Addition to Saint Paul, said strip located between
the northwesterly extension. of the northeasterly line of Lot 2,
Block 5, Kentucky Terrace and a line perpendicular to the north-
westerly line of Lot 10, Block 5, Palisade Addition to St. Paul
said perpendicular line being located three hundred sixty-nine
(369) feet southwesterly of the most northerly corner of Lot 2,
Block 5, Kentucky Terrace when measured _along the northwesterly
lines of said Blocks
Subject expressly to the following conditions and reservations:
l. That the vacation be subject to all the terms and conditions of
Chapter 130 codified March 1, 1981, of the St. Paul Legislative Code,
as amended.
2. That the petitioner pay to the City the sum of $650.00 as.
compensation for the vacation.
3. That this vacation be limited to the existing encroachments,
which upon removal of said encroachments, the vacated area shall revert
to the City immediately and without cost to the City.
4. That the petitioner, its successors or assigns, by acceptance
of this vacation, shall agree that no additional encroachment will be
placed within the vacated areas described herein.
5. That the petitioner, its successors, or assigns, by acceptance
of the terms and conditions of this vacation, agrees to indemnify, defend

and save harmless the City of St. Paul, its officers and employees from all
suits, actions, or claims of any character including, but not limited to,
a claim brought because of any injuries, or damages received or sustained
by any person, persons or property on account of this vacation; or because
of any act or omission, neglect or misconduct of said petitioner; or because
of any claim or liability arising from or based on any violation of any law
or regulation made in accordance with the law, whether by the petitioner or
any of its agents or employees.
