THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORD�.IN:
Section 1
Section 401 . 03 , subd. 2, of the Saint Paul Legislative Code
is hereby amended to read as follows :

bond in the sum of $5, 000, with a duly licensed
surety company as surety thereon, conditioned
that such licensee shall observe the ordinances
of said city in relation to the business to do
which such applicant has applied for a license,
and that such licensee will conduct said business
in conformity therewith and will account for and
deliver to any person legally entitled thereto

The March 13 , 1984, letter from Ms . Br�st to you is correct in that
the state law bonding requirements do supersede our ordinance, but
only as to new and used ve�icle dealers . Our bond requirement still
applies as to parts dealers .
I enclose an ordinance to make the change . In the meantime I would
suggest that you accept evidence of compliance with the state bond
requirements in lieu of the bond required under our ordinance for
new or used motor vehicle dealers .
If a new or used motor vehicle dealer is also a motor vehicle parts
dealer, the ordinance requirement will continue to apply. If the
bond they get for the state ($25 ,000) has all the right language
in it to cover the parts business , I see no reason to require a
separate $5 , 000 bond just for the ordinance parts license.

Dear Mr. Carchedi:
I recently received a copy of the Legislati�e Code, Chapter
401 . 03 titled "application requirements" which requires a
motor vehicle de3ler to file a $5, OOO � bond with the inspector
before they can be licensed by the City of St. Paul,
Minnesota Statutes 168. 27, Subd. 24, requires a motor vehicle
dealer to file a $25 , 000 bond with the Department of Public
Safety before he is granted a dealer license . Subd. 25 pre-
empts and supercedes all bonding requirements imposed by local
government units .
This makes Chapter 401 . 03 in error, and it should be corrected.
We would like to know that you agree , and that a correction will
be made.
