RESOLUID, that the City of Saint Paul reaffirms its position as
� stated in Resolution No. 84-427.
FURTHER RESOLVED, that the City of Sai.nt Paul supports the inclusion
of Energy Park Developnent District in the areas c{ua.lifying for receipt
of the ten licenses, with a maximwn of four licenses to be allocated
to Energy Park; and be it
FTNALLY RESOLUED, tha.t it is the intent of the Council that the �
proceeds of the e�ccise tax authorized. herein be used to assist and
participate in the acquisition and clearance of blighted areas and
structures in areas having concentrations of businesses licensed for
the sale of intoxicating liauor or businesses Customarily near or related
to liauor establishments. In order to facilitate the continued development
and redevelopment of the City of Saint Paul and specifically its neighborhoods,
it is reca�mnended that a Neighborhood Betterment Revolving Loan Fund be set
up from proceed.s from the sale of the ten (10) new liquor licenses and
other funds to be provided by the Housing and Redevelopanent Authority. The
Pdeighborhood Betterment Fund would be used to purcha.se existing lic{uor
businesses in areas outside of downtown and redevelop those properties in
a manner consistent with stabilizing the are�. and revitalizing the surrounding
neighborhood..and to affirmatively assist minorities in the financing of
liquor licenses in the City of St. Paul .

WHEREAS, development occuring now and projected for the immediate future
in St. Paul 's downtown district is expanding the demand for an increase in the
number of licenses to serve intoxicating beverages; and

199 nn-sale licenses for the sale of intoxicating liquor; and
I��HEREAS, licenses in addition to the 199 currently authorized are in demand
or will be in demand in the near future; now, therefore, be it
RESOLVED, That the City of St. Paul shall request the Minnesota State
Legislature to consider the attached draft bill , and passage of which would:
1 . Authorize, but not require, the immediate issuanee of 10 additional
"on-sale" intoxicating liquor licenses within the downtown area
designated in the attached draft bill .
2. Authorize the imposition of an excise tax on the issuanee of the
additional liquor licenses at $75,000 for a term of 10 years;
3. Prohibit the transfer of "on-sale" licenses after January 1 , 1994;
4. Prohibit the transfer of licenses issued pursuant to the Act outside the
designated downtown district; and be it
FURTHER RESOLVED, That the City of St. Paul is opposed to the issuance of any
additional licenses in any neighborhood outside the Downtown Business District, and
is currently in opposition to the repeal of the existing liquor patrol limits, until
such time as the Cityc�n adequately, study the impact of repeal , consider the parking and
distance separation protections, receive adequate public input, and make a future
determination on its desirability, �

A bill for an act
authorizing the City of Saint Paul to issue
on-sale intoxicating liquor licenses in excess
of the statutory limit to the City's downtown
business district; prohibiting transfers of
intoxicating liquor licenses in the City of
Saint Paul beginning on January 1 , 1994; and
prohibiting transfer of licenses issued pursuant
to this Act.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1 . City of Saint Paul ; On-Sale Intoxicating Liquor Licenses in
Downtown Business District. Notwithstanding any contrary provision of law,
charter or ordinance, the governing body of the City of Saint Paul may issue
upon passage of this Act ten "on-sale" intoxicating liquor licenses in excess
of the number authorized by Minnesota Statutes Section 340.11 , subdivision 5a
for use only in the City's downtown business district. For purposes of this
Act, downtown business district shall include all that portion of the City of
Saint Paul lying within and bounded by the following streets: Beginning at the
intersection of Shepard Road vaith Chestnut Street, Chestnut Street to Pleasant
Avenue, Pleasant Avenue to Kellogg Street, Kellogg Street to Summit Avenue,
Summit Avenue to Tenth Street, Tenth Street to Interstate Freeway 94, Interstate
Freeway 94 to Lafayette Bridge, Lafayette Bridge to where the bridge crosses over
Warner Road, Warner Road to Shepard Road, Shepard Road to Chestnut Street. Licenses
issued and renewed pursuant to this Act shall be governed by the provisions of
Minnesota Statutes Section 340.07 to 340.401 , with the exception of Section
340.11 , subd. 5a and those sections dea1ing with license transfers.

Section 2. City of Saint Paul ; Special Issuance Excise Tax.
Notwithstanding any contrary provision of law, charter or ordinance, the
City of Saint Paul shall impose and collect a special excise tax on the
issuance of "on-sale" intoxicating liquor licenses. Such tax shall be
promulgated by ordinance, and shall be $65,000 for each license issued in
years 1984 through 1994. Effective January 1 , 1994, the authority to impose
the tax required hereby shall expire. The term "Issuance" as used in this
section shall not include the renewal of such licenses, nor the transfer of
existing licenses during such period when intoxicating liquor licenses are or
remain transferable.
Section 3. City of Saint Paul ; Transfers of Licenses.
Notwithstandin� any contrary provision of law, charter or ordinance,
"on-sale" intoxicating liquor licenses shall be nontransferable in the City
of Saint Paul from and after January 1 , 1994.
Section 4. Transfer.
No "on-sale" intoxicating liquor license issued pursuant to this Act
may be outside the designated downtown district.
Section 5. Effective Date.
This Act is effective the day after compliance by the governing body
of the City of Saint Paul with Minnesota Statutes Section 645.021 , subdivision 3.
