An ordinance amending Chapter 60 of
the Saint Paul Legislative Code pertaining
to zoning for the City of Saint Paul and
the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462 . 357 and §64. 210
of the Legislative Code, Samaritan Hospital duly petitioned to re-
zone Lots 1-10, 18, 19 & 20 and that portion of vacated Edmund Ave.
adjacent to Lots 1, 18, 19, & 20, Block 2, Hamline Syndicate Add.

parking ramp, the petition having been certified by the Planning
Division on September 1, 1983 as having been consented to by at

and further having been consented to by at least two-thirds of the
owners of the property situated within 100 feet of the total con-
tiguous descriptions of real estate l�ield by the same owner or any

WHEREAS, The current Zoning Committee on October 6, 1983
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 . 03 of the Admini-

mission that the petition be granted; and

Dear Sir:
On October 6, 1983 the Zoning Comnittee of the Planning Commission held a
public hearing on this rezoning. The petitioner was present and explained
their proposal to build a medical office building and parking ramp north of
the existing hospital site. A number of people testified in opposition to
the rezoning. At the close of the public hearing, the Committee voted
4 to 2 to recommend approval of the rezoning. At the same hearing, the
application for a Special Condition Use Permit with modifications necessary
to construct the office building and parking ramp was laid over until
November 17.
On October 7, 1983 the Planning Commission reviewed the Zoning Committee's
recommendation and upheld it on a vote of 11 to 4.
On October 21 , 1983 a letter was received from the City Council requesting
that the Planning Commission take up the matter of the Special Condition
Use Permit prior to the City Council consideration of the rezoning.
Throughout November and December a series of ineetings was held. These
meetings were attended by representatives of Samaritan Hospital ,
District 11 Coalition, immediate neighbors to the hospital , and City staff.
A number of site plans were submitted, discussed, and reviewed by the
Committee.

On January 19, 1984 the Zoning Committee of the Planning Commission again
considered the Special Condition Use Permit. At that time a proposal that
was acceptable to the hospital and that the District 11 Coalition did not
oppose was presented to the Committee. The Committee voted 5 to 0 to
approve the Special Condition Use Permit with modifications.
On January 26, 1984 the Planning Commission upheld the Zoning Comnittee's
recommendation on a vote of 13 to 1.
The rezoning is scheduled to be heard by the City Council on February 23,
1984. Please notify me by February 22 if any member of the City Council
wishes to have slides of the site presented at the public hearing.

i�1s. Jarnes showed slides of the site and reviewed the staff report with a
recommendation for approval of the rezonirig and recammended that the
Special Condition Use Permit be laid over until November 17, 1983.
Sixty-one letters were received in support, of 4�hich 45 ���ere from the
hospital auxiliary. Distirct 11 Coalition submitted a 7etter in opposition
and 23 letters from residents were received in oppos�tion.
Dick Matykiewicz, attorney representing American Health care Management,
owner arid op�rator of Samaritan Hospital, reported �hat American H�alth
care purchased the hospital approximately 1 1/2 years ago from the former
owner Health Services Incorporated. The hospital has been in existence
si n.:e <ab���t 19��, and '�he prop�; fiy �t.hat i s sut je:.�� to tl�� y�e_on i�g f.ad
been owned by the hospital for several years prior to the purchase of �he
hospital by Ame�ican Health care. The tenants that reside in the homes
owned by the hospital have been well aware of the project for many years.
He explained their proposal , stating that the proposed medical offict
building �rill be adjacent to the hospital . The parking ramp wil also be
connected to the medical office building and eventually to the hospital
building. There will be a skyway connecting the medica7 office building
to the existing hospital itself. The hospital intends to build an
approximately 40,000 sq. ft, medicai- building and a 2-1eve1 parking ramp.
The total height of the parking structure above existing grade will be
be about 7 1/2' . The medical office building as indicated will be approx-
imately 39' and basically equal to the existing hospital . Althou�h the
hospital does have 95 parking spaces it is still short of adequate parking
according to code. The parking in the area has had a iong history o�F
congestion and causing problems and neighborhood discontent. The proposal
as presented arauld provide approximately 502 parking spaces, which would be
about 70 in excess of what would be needed to satisfy the code requiremerrts
for the hospital and the medical office building. A 40,000 sq. ft. medical
office building will accommodate somewhere betweeR 35 to 40 doctors. 7heir
proposal , if permitted, would absolutely eradicate any future need for on-
street parking in the area as far as the hospital and medical office

building is concerned. The hospital would be willing to join with the
community in any way they desire to place restrictions on the surrounding
streets with regard to parking in that area. The American Health care
Management Corporation, a Texas for-profit hospital managernent company,
has already invested a great deal of money in the purchase of the property
and in the actual hospital i,tself. They have upgraded the interior of the �
hospital drastically and added a considerable amount of new equipment.
This particular project is projected to be somewhere in the area of 5 _
million dollars and the .investment will be financed totaTly f rom private
sources. It will have a relatively great impact on the tax base �n the
area. The financing is in place, and they are capable of moving ahead witn
it as their plans progress. The hospital is presently licensed for 150
beds; however it has been operating at considerably less than that as
indicated by the statistics presented by staff. It is the sole intention
of �:7erican Health care to bring this hospital up to fully utilize the 150
bed license eand by doing so provide excellent medical care in the
co�rmun;ty. The trend i� to have meci i cal off i ce bu i 1 d i ngs ad j acent to
hospitals so th�at the doctors have tt�e abili�cy to attend tc, their patients
as easily as possible. In order for the hospital to be successful , it has
to have doctors that ar•e willing to admit their patients to that hospital ,
and th::: ability to have their office building close by is a very strong
reason �or where they make their admissions. The hospital, in order to
survive, has to have this improvement or it will not be aab7e to compete in
the marketplace and provide the type of heal�th care trat ane would expect.
Dan Hill , Vice-President of American Health care and current administrator
of the hospital presented a background of the company. He stated that they
do need to place Samaritan in a more competitive posture in the 198�'s and
they feel that the proposed building tivill do that. It wi11 be a 4 7/2
million dollar building, constructed by local contractors and will provide
� jc,bs �4u the cornmunity.
P�1r. Lanegran asked Mr. Hill to comment on the low occupancy rate of the
hospital .
Mr. Hill stated that in looking at the history of Samaritan Hospital , it
was first the old railroac; hospital . After that it was with Share HMO,
whici� Samaritan helped to start by providing the seed money but due to
unfavorable financia1 contractural arrangements, they could na lar�g�r
continue. There was really no aggressive marketing done by the former
owners to attract the private practioner. Relating to the low occupancy, .
this is something that American Care is accustomed to, and that i� the
way they can buy hospitals. Hospitals that are flourising are not for
sale.
Wayne Car•lson, 593 Laurel , spoke in support stating that it appears that �
the hospital could become a viable alternative and compete in the health
care business. As a resident in the area, he is interested in seeing that
happen. It will add some money to the community, it is a very positive
increase in the aesthetics of the neighborhood and will create more jobs.
The technique of traffiic control that would be used in the parking ramp,
the use of patrols and the greater activity would mean a safer

neighbornood. A facility of this magnitude wculd add to the tax rolls and
help level or keep taxes at the same base, keeping the value of property
up.
Thomas Kershling, President of Health Services Incorporated, stated that he
is aware of the conyestion in the area primarily caused by Samaritan
Hospital 's inability to provide adequate parking. As a corrrnercial property
ow��er in the area he would very muci� support the project. _
Gladys Carlson, 1483 Charles, testified in support stating that it would be
a �ronderful addition to the neighborhood. American Nealth care is trying
their very best to work with the neighbors.
Melvin Jacobson, 548 Simpson, stated support because it would decrease
taxes and increase jobs.
4!ill�am Murphy, 582 A.sbury, former ten�nt of Samaritan, reported th�t he
was informed by the hospital that it would be a year to 18 months before
they would have to move.
Judy Lawstram, 1422 Lafond, Executive Directar of the i�iidway Civic &
Commerce Association, read a statement on their position to support the
medical office building and related parking structure. Their main reasor�s
for support were increased jobs, add more tax revenues, growth of business
and improve traffic.
William Newhouse, 559 Asbury, resident of the neighborhood for� 50 years.
testified in support stating that the Midway area is improving, it is a
good location for a hopsital , it will provide more jobs, and wi71 help the -
tax base.
Bob Wicker, 1538 Englewood, stated he was not speaking in support or in
oppasition but felt there was not enough balanced thinking given on the
matter. District 11 should safeguard the welfare of all camponents af the
community. He stated three points that should be considered:
(1) Samaritan Nospital is not a newcomer to the neighborhood and it is not
the first time they have expanded; (2) District 11 has concentrated on7y on
possible negative effects, objections should be quantified; and (3)
citizens often object to large scale projects. He requested that if the�
rezoning is approved, a letter of ag�eement be drawn up between the
hospital and the neighborhood which gives residents the po��ver and ability
to work with the management,
Kevin 0'Shea, 563 Asbury, presented a slide presentatian of the area.
He reported that the estimated property value of the neighborhood is
$10,000,000. Homes have been improved over �he years; the h�rnes Samarita�
owns have become an eyesore. He stated that they submitted a Plan B to t�ne
hospital which recorrmended: (1 ) they save as many homes as possible;
(2) move the house on the corner of Thomas and Simpson to provide mare
surface parking; (3) remove houses on Asbury for additional surface
parking; and (4) use the 2-story Share clinic and existing empty hospital
space. American Health care could also locate the doctors' building on

University and shuttle the patients �o the hospitaT . Ne felt the reason
residents signed the rezoning petitior� was because of the traffic
congestion in the area and they wanted the eyesore, Samaritan-owned houses,
removed.
Merrill Roi�;nson, Vice-Presi,dent of District 11 Coalition, stated the
District's opposition. In the Master Plan for District ll they state the
intention to cooperate with industry and cornrnerce in the neighborhood t�ut , -
they are also seeking as an objective to protect and improve the
residential character of the neighborhood. As to the need for a medical
office building, there is an excess of such facilities within blocks af the
site in question.
Jerry Baldwin, 1190 Thomas, District 11 Coalition, stated that one of the
primary intents of the District Plan is to preserve �he residential
character of the neighborhood. The history of this property has been one
of cc�n�:inued er�croach�nent on re�idential ai•Eas.
Pat Siuta, 563 Asbury, testified in opposition. She stated that if the
project were approved, it a�ould violate the intent and purpose of the �
Zoning Code in the following way: it would adversely affect public health
and safety by increasing the air pollution, traffic and noise in the area.
They could expect anywhere from 1 ,600 to 2,000 additional cars coming into
their residential neighborhood on a daily basis. The partcing lot entrance
would be across from the playground endangering the liv�s of children in
the area. From the very beginning Samaritan was a nonconforming use and
tnroughout the years this nonconformity has been extended. The residents
are very concerned about the continual expanrtion of the nanconforming use.
The hospital has received favorable treatment for many years at the expense
of the residential neighbornood. The proposed project would lessen air
circ�'iaLion compo�n�iny the air poliutior� prUblem, �he bui�diny tv�uid aso
affect the amount of sunlight received by many of the homes, privacy v�ould
be curtailed because occupants of the 3-story building would be looking
down into the yards of the surrounding homes, and eonvenience of access ta
property would be seriously jeopardized because the proposed project would
be constructed over Edmun� Street closing it down. She stated that the
proposed medical building is not incidental to the hospital . With the
hospital occupancy rate of only 24% -i� appears that the office building
would be a primary rather than an incidental use.
Dr. pavid Bredehoft, 616 Asbury, stated opposition for the following
reasons: (1 ) there is an overburdance of inedical and office buildings in
the area; (2) the addition of a parking ramp in an already severely air
polluted area of the City is not conducive to the quality of life that f�e
chaose when he moved into the area; (3) the increase of tax revenues does ,
not mean that property owners will benefit from it; and (4) it is an
encroachment on the neighborhood.
Lynn Purcell , 604 Asbury, reported that a lot of for-sale signs went up
after the hospital 's announcement. The house they are living in is one
owned by Samaritan and they had made tentative plans to buy the house and
thought they had an agreement with the owners. Good residential

neighborhoods are very difficult to find with close proximity to shopping,
transporation and businesses.
Evelyn Olson, 1470 Edmund, testified in opposition. She stated the
hospital has not been very accommodating. As a senior citizen, Medicare
has c�t down on what they will offer, which will have an impact on the
hospit��ls. The hospitals themselves are consolidating, ►��hich would �ndicate -
that they are having patient count problems. American Nealtf� care has not
explored all of the possibilities that are open as far as gaing along with
their present facilities.
Joanne Enos, 149 Exeter Place, stated opposition because the integrity of
�he neighborhood would be diminished. The residents in the neighborhood
have done a lot of wark on this and Plan B would be the compromise p1an.
Joan �cr�niedr, representing .ynnette Sorenson, expressed concern wit{i
safety, decrease in property valu�s, street to street buildings that arill
not blend in with the neighborhood, upkeep, traffic, and the viability of
it being successful .
Gary Zaidenweber, 1519 Sherburne, stated that the staff report makes an
excellent case for denying the request and yet immediately following all
the final arguments, the staff recom»ends approval . He felt this was
inconsistent with the findings of fact.
Valerie H�ix, 1521 Thomas, expressed strong opposition, stating that the
proposed expansion would be totally inappropriate in a residential area.
She was concerned with the safety of her children with such an increase of
traff i c as wel l as the safet,y of the general pedestri an traff i c i n the area.
4�es Kilstrom, 1543 Edmund, testified in opposition for reasons previously
expressed by residents. He questioned what would hap�en if the faciltiy
did not prove profitable.
Flearing no further testimony, Mr. Bryan closed the public hearing portion
of the meeting.
Ms. Surr�ners asked Mr. Hill if he received Plan B from the neighborhood and
if it had been considered. �
Mr. Hill stated that they did receive Plan B but rejected it on the basis
that there was not enough space for the doctors that they intend to attract
to the bui7ding, and aTso it was lacking in parking space.
Mr. Lanegran asked what other configurations for the office building were
considered �other than constructing it 18' from the street.
J. Slader, BWBR Architects, reported that there were several options
considered. One of the main reasons for locating it where they did was the
ability to get as many parking spaces as possible that would take care of
both the parking requirements of the hospital in its anticipated capacity

as well as for the medical office building. Another eonsideratian was

hospital , and it was best located at the point where it is shown.

F. ZONING HISTORY: The original hospital was constructed in 1920. In 1922 the site
was zone "B" Residence, making the use nonconforming. (Hospitals were first
permitted in "C" Residence districts.)
Zoning file #5488: July, 1964. The City Council granted an appeal to extend the
nonconforming use by permitting construction of an addition to the north. The
bed capacity of 150 was not increased. Construction of the addition was begun
prior to the application for appeal .
Zoning File #5529: September, 1964. The City Council approved a permit to
increase the parking lot from 46 to 81 spaces.
Zoning File #6468: May, 1968. An appeal was granted to permit expansion of the
nonconforming use by constructing a new 4-story west wing and a new clinic to the
northeast of the existing hospital . In addition, the required setback alang
Charles for the new wing was relaxed, from 24' required to 11 ' proposed. At that
hearing, the question of whether or not the facility was becoming too large f or
the site was raised. The proposed construction also reduced the off-street
parking to 56 spaces. The hospital representatives expTained that since many of
their patients were from out-of-town, they did not need as much parking as other
hospitals. They promised to provide additional parking as soon as land became
available.
Zoning File #6782: September, 1969. A permit was approved for a 39-car parking
1ot. Concerns were raised regarding the future expansion plans of the hospital .

Expansion toward 5nelling Avenue �to the west was suggested.
In 1975 the site was zoned RM-2 and the parking lot to the north was designa�ed

office building on the same site as is now proposed was submitted and then
withdrawn.
G. FINDINGS:
1 . Th� petitioner proposes rezoning to RM-2 in order to construct a medical
` office building and 2-level parking ramp. The office building will be 3
stories (39' ) high and will have 40,000 sq. ft. of gross floor area. The
parking ramp will provide s�' parking spaces and will be 7 f eet above grade.
Accessory structures must be on the same zoning lot and in the same zoning
district as principal structures.
2. There is a well-establsihed trend of inedical office buildings linked to
hospitals. The applicant states that such a f acility is necessary to the
survival of the hospital . Inability to add the new facilities would result
in undue hardship for the applicant.
3. Samaritan Hospital intends to retain a controlling interest in the office
building and under the precedent established in the Midway Hospital case, the
building would be appropriately considered accessory to the hospital .
4.� Rezoning of the subject property to RM-2 would not result in substantial
disruption of the established zoning patterns. The property adjoins land
presently zoned RM-2 on two sides. Other permitted RM-2 uses; multiple
family residential , corr�nunity residential facility and nursing homes, wouid
not be substantially incompatibTe.
5. If the rezoning petition is approved, petit_ioner will also need to obtain a
Special Condition Use Permit with modifications for the medical office
building and the parking ramp. The conditions to be met include yard
setbacks, a site of at least five acres and access to parking directly from
a major thoroughfare.
6. The site is located at the edge of the Midway mixed use cluster area
designated in the Comprehensive Plan. The plan calls for intensifying uses
in clusters. The Land Use Plan recorr�nends locating institutional uses in
mixed use cluster areas.
7. Land Use Plan policy 4.5-2 states: "The city will work with the district
councils and institutions to resolve land use conflicts arising from the
competing needs of the institutions and their neighbors." Confliets such as
traffic congestion, danger to pedestrians, and parking problems are
mentioned.
8. The District 11 Plan aeknowledges concern over the expansion of Samaritan
Hospital and also proposes using Samaritan Hospital for a health care
delivery system.
9. The YOUniversity Avenue Plan recommends the containment of corr�nercial uses
within the bounds of commercially zoned land and the concentration of
vehicular traffic on major streets and highways.
10. The Metropolitan Health Planning Board estimates that there is an excess of �
over 2,000 hospital beds in the metropolitan area. Ir� the Phase IV report
adopted by the Metropolitan Council in May, 1982, the Council recommends that
beds be reduced through competition in the market place.
11 . P�etropolitan Health Planning Board data show that in 1982 the use rate of all
hospitals in the region dropped 6.3% from 1981. The highest occupancy rate
was 76%; the lowest was Samaritan Hospital with 24q. The data also show that
while admissions were down for Samaritan, the number of days patients stayed
in thE hospital rase; the average length of stay for the patients rose 1 .5
days over 1981.
12. Metropolitan Health Planning Board staff believe that the trend toward lower
hospital usage will continue.

13. Samaritan Hospital is presently legally nonconforming as to location and
setbacks. It has been legally nonconforming in one way or another since
1922, when the first zoning ordinance was enacted.
14. Chapter 62.102 of the Zoning Code states: "It is the intent of this code to
permit legal nonconforming lots, structures or uses existing on the eff ective
date of this c�de. . . to continue until they are removed but not to encourage
their survival ."
� 15. The hospital is an existing use that has been granted numerous permits and
appeals in order to expand at this location.
16. The proposed construction would generate additional property tax revenue for
the city.
H. STAFF ANALYSIS: Samaritan Hospital 's proposed expanszon raises major land use
and pu lic policy issues. While it is presently one of the least used hospitals in
the metropolitan area, its current owners believe that it can become competitive if
the rezoning is granted and the expansion is permitted. The office building will
attract doctors who will attract potential hospital patients. Petitioner states that
the trend toward accessory medical buildings will continue and wi11 be necessary far
hospitals' survival .
There are reasons to den,y the rezoning based on land use considerations and the
history .of zoning-related concerns associated with the site. The addition of an
office building and a parking ramp and the traffic associated with these wi11
make the hospital less, not more compatible with the surrounding residential land
use. The zoning ordinance provision,that access must be f rom a major arterial , a
provision which cannot be met in this case, is a reasonable consideration for the
protection of the residential environment.
Apparent excess hospital capacity in the area raises a question about the
advisabili�y of zoning action to increase l.and area devoted to this use. The
excess capacity and the low occupancy rate for this particular haspital do
increase the importance of considsering reuse potential f or the site under both
present zoning and rezoning conditions. If some other use of this site had to be
considered in the future, it would appear that reuse compatible with the
surrounding residential area would be more difficult to achieve with the office
building and parking ramp erected on the site than without these additions.
The case for approval of the rezoning is supported by the appropriateness of
zoning accommodations to support continued economic viability of an existing
institution, the potential positive impact of an improved f acility, the shart
distance which separates the site from a major arterial , and the reasonable
nature of the actual rezoning required.
The applicant is requesting the rezoning in order to add components necessary f or
continued successful operation of the hospital . If this occurs, the prospect is
for a substantially upgraded facility albeit, with some attendent increased
congestion for the residential area. .
The apparent greater intrusion of less compatible land use in tMe residential
area has to be balanced with consideration of the positive impact that can be
expected from reinvestment in the area and upgrading of the site with new
construction. The parking ramp has a low profile and the office building
proposed is in scale with the present hospital building which sesems ta have been
reasonably well accommodated in the neighborhood. If the rezoning is denied, the
prospects would appear to include eventual closure of the hospital and eventual
redevelopment of the site. The scenario could include a significant period of
deterioration with vacant, boarded structures.
The site is just one block east of Snelling Avenue, a major arterial and the
proposed office building and parking ramp are on the north end of the site
adjacent to Thomas Avenue, a collector street. _
The rezoning which has been requested, P-1 and R-3 to RM-2, is not an
unreasonable or drastic rezoning considering the presence of RM-2 area on two
sides of the subject property.

On Thursday, October 6, the Zoning Committee will consider a request to
rezone a block in the Midway occupied by Samaritan Hospital. The Midway
District 11 Coalition opposes the change for several reasons:
l. The District Council is eager to work with community businesses. The
Council has pursued reaching agreements with hospital management to protect
xg � ; the neighbors as well as the hospital business. This effort has resulted
-,.; only in vague statements of intent. We have reached no satisfactory

- agreemerits.
� ,- � * 2. A report from the Metropolitan Council indicates that the future of
� � ' the hospital industry is questionable. Before the District can support the
�� -' expansion of a business with a questionable future, ws want the business to
explore less drastic alternatives. An alternative building arrangement
could add surface parking rather than a ramp, add to the existinq structure
and preserve housing.
� �� 3. The request is to do spot zoning in our district and is therefore
� .v inconsistent with the district plan and the City Zoning Code which both
strive to create harmony between residents and businesses in the City.

� WHEREAS, Pursuant to Minnesota Statutes §462 .357 and §64.210
�2S of the Legislative Code, Samaritan. Hospital duly petitioned to re-
zone Lots 1-10, 18, 19 & 20 and that portion of vacated Edmund Ave.
� adjacent to Lots 1, 18, 19, & 20, Block 2, Hamline Syndicate Add.
��3 , located on the West side of Simpson between Thomas and Edmund,
from P-1 and R-4 to RM-2 to permit construction of a two-level
parking ramp, the petition having been certified by the Planning �
Division on September 1, 1983 as having been consented to by at
least 67% of the owners of the area of the property to be rezoned,
and further having been consented to by at least two-thirds of the
owners of the property situated withi.n 100 feet of the total con-
tiguous descriptions of real estate l�ield by the same owner or any
party purchasing any such contiguous property within one year pre-
ceding the date of the petition; and
WHEREAS, The current Zoning Committee on October 6, 1983
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 . 03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on October 7,. 1983 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the of�icial
