An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, R. J. and Florence Schovanec duly petitioned to rezone the
southwesterly 15 feet of Lot 26, and all of Lots 24 and 25, Block 2, Scheffer's
Addition located at 1069 West Seventh Street from RM-1 to B-2 for the purpose
of establishing a showroom for retail sales the petition having been certified
by the Planning Division on November 4, 1985, as having been consented to by at
least 67% of the owners of the area of the property to be rezoned, and further
having been consented to by at least two-thirds of the owners of the property
situated within 100 feet of the total contiguous property within one year
preceding the date of the petition; and
WHEREAS, The Zoning Committee on November 21 , 1985, conducted a public
hearing for the purpose of considering the rezoning petition, and pursuant to
Section 107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on November 22, 1985, and recommended that the City Council approve
the petition; and
WHEREAS, Notices of a public hearing before the City Council on the said
rezoning petition were duly mailed to each owner of affected property and
property situated wholly or partly within 350 feet of the property sought to be
rezoned; and

WHEREAS, A public hearing before the City Council , having been conducted on
December 12, 1985, where all interested persons were heard, and the Council
having considered all the facts and recommendations concerning the petition;
now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 27, as
incorporated by reference in Section 60.301 of the Saint Paul Legislative Code, as
amended, is hereby further amended as follows:
That property located on the northwest side of
Seventh Street between Randolph and Armstrong (1069
West Seventh Street) being more particularly
described as southwesterly 15 feet of Lost 26, and
all of Lots 24 and 25, Block 2, Scheffer's Addition
be and is hereby rezoned f rom RM-1 to B-2.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from and
after its passage, approval and publication.

Dear Sir:
On November 21, 1985, the Zoniny Committee of the Planning Commission held a
public hearing on this rezoning. The petitioner testified. At the close of
the public hearing, the Committee voted 6 to U to approve the rezoning based
on staff findinys.
On November 22, 1985, the Planning Commission upheld the Zoning Committee' s
recommendation on a unanimous voice vote.
This rezoniny is scheduled to be heard by the City Council on December 12 ,
1985. Please notify me by December 10, 1985, if any member of the City

On November 21, 1985, the Zoniny Cor,nnittee of the Planning Commission held a
public hearing on this rezoning. The petitioner testified. At the close of
the public hearing, the Committee voted 6 to U to approve the rezoning based
on staff findinys.
On November 22, 1985, the Planning Commission upheld the Zoning Committee' s
recommendation on a unanimous voice vote.
This rezoniny is scheduled to be heard by the City Council on December 12,

WHEREAS, R. J. and Florence Schovanec, Zoning File #9825 has petitioned to
rezone 1069 West 7th Street situated on the northeast side between Randolph
and Armstrong, from RM-1 to B-2,for the purpose of establishing a showroom for
retail sales of perfumes, cosmetics and health and beauty aids; and
WHEREAS, the Zoning Comnittee of the Planning Commission, on November 21,
1985, held a public hearing at which all persons present were given an
- opportunity to be heard pursuant to said petition in accordance with the
requirements of Section b4.400 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence
presented to the Zoning Committee at the public hearing as substantially
reflected in the minutes, made the following findings of fact:
1. Prior to 1915, applicant states that the building was used as both a
personal residence and a comnercial/service establishment
(barber/tailor/drycleaners},
2. Applicant intends to establish a showroom for retail sales of
perfumes, cosmetics, and health and beauty aids.
3. Principal uses permitted in a RM-1 dist�ict include all principal uses
allowable in the R-1 through R-4 and RT-1 residential districts,
townhouses and multiple-family dwellings. Section 60.422 (1-3) .
Rezoning would be required.
4. It is the intent of the B-2 district to "serve the needs of a consumer
population larger than served by the 'Local Business District' and is
generally characteriied by a cluster of establishments generating
large volumes of vehicular and pedestrian traffic." Section 60.531.
• 5. Principal uses permitted in a B-2 district includes "all retail
business, service establishments or processing uses as follows: (a)
any retail business whose principal activity is the sale of
merchandise in an enclosed building; (b) any service establishment of
an office, showroom or workshop nature..." Section 60.532(2).

6. Applicant's parcel is located on West 1th Street, a minor arterial B.
To the southeast and the southwest are found both residential and
commercial uses in a B-2 zone.
7. Rezoning the property would be a reasonable expansion of the adjoining
B-2 zone.
� 8. The code requires one parking space for every 150 square feet of
' usable floor area. 62.103(6)(3M) .
9. Applicant's attorney states that the total area of the showroom will
be 400 square feet; the required number of parking spaces would be
three. A sketch plan provided by the applicant indicates room for
five parking spaces with residential parking accommodated in a garage.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Comnission that the
petition of R. J. and Florence Schovanec to rezone property at 1069 West 7th
Street more particularly described as southwesterly 15 feet of Lot 26, and all
of Lots 24 and 25, Block 2, Scheffer's Addition from a RM-1 zoning
classification to a B-2 zoning classification is consistent with the
Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby
recommend to the Council of the City of Saint Paul that property located at
1069 West 7th Street be rezoned from RM-1 to B-2 in accordance with the
petition for rezoning on file with the Saint Paul Planning Division.

PRESENT: Mmes. Morton, Summers, Tracy and Zieman; Messrs. Levy and Pangal of
the Zoning Committee; Ms. Lane of the Division of Housing and
Building Code Enforcement; Ms. Datsko, Ms. Synstegaard, and Mr.
McGuire of the Planniny Division Staff.
ABSENT: Messrs. Galles and Lanegran.
The meeting was chaired by Gladys Morton, Vice-Chairperson.

The applicant was present. There was no opposition present at the hearing. '
Donna Datsko showed slides of the site and reviewed the staff report with a
recommendation for approval .
Clark Isaac, 1420 Conwed Tower, applicant's attorney, stated that the store
will be limited in nature. The parking is now adequate and more will be added
if needed. Although it is not a requirement of the staff, his client wishes
to rehabilitate the outside of the building next spring to reflect with the
Fort Road development guidelines. The store will be selling brand name items
only. The shipments coming into the store will be handled by U.S. mail or
UPS, not a larger carrier.
Hearing no further testimony, Ms. Morton closed the public hearing portion of
the meeting.
Mr. Pangal moved approval based on findings 1 through 9. Mr. Levy seconded
the motion, which passed on a roll call vote of 6 to 0.
