now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 12, as incorporated
by reference in Section 60.301 of the Saint Paul Legislative Code, as amended,
is hereby further amended as follows:

� WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, Thomas Lunzer duly petitioned to rezone Lot 9, Block 2, Lewis
Addition located at 123 Manitoba from RT-1 to P-1 for the purpose of develaping
a cornrnunity use parking lot, the petition having been certified by the Planning
Division on October 8, 1985, as having been consented to by at least 67� of the
owners of the area of the property to be rezoned, and further having been
consented to by at least two-thirds of the owners of the property situated
within 100 feet of the total contiguous property within one year preceding the
date of the petition; and
WHEREAS, The Zoning Committee on November 7, 1985, conducted a public
hearing for the purpose of considering the rezoning petition, and pursuant to
Section 107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on November 8, 1985, and recommended that the City Council approve

WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the officia2 newspaper of the City an

Dear Sir:
On November 7, 1985, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The petitioner testified. At the close of
the public hearing, the Committee voted 7 to 0 to approve the rezoning based
on staff findings.
On November 8, 1985, the Planning Commission upheld the Zoning Committee' s
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on December 5,
1985. Please notify me by December 3, 1985, if any member of the City Council
wishes to have slides of the site presented at the public hearing.

WHEREAS, Thomas Lunzer, File #�9816 has petitioned to rezone 1� Manitoba
situated on the north side of Manitoba between Rice Street an Park Avenue
from RT-1 to P-1 for the purpose of developing a cortmunity use parking lot;
and
WHEREAS, the Zoning Cor�nittee of the Planning Cortunission, on November 7,
1985 held a public hearing at which all persons present were given an
opportunity to be heard pursuant to said petition in accordance with the
requirements of Section 64.400 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence
presented to the Zoning Committee at the public hearing as substantially
reflected in the minutes, made the following findings of fact:
1. The building adjoining to the west is undergoing rehabilitation and
will become a doctors clinic. The parking will be accessory to the
clinic.
2. This part of the Rice Street corrmercial area developed without
sufficient off-st�eet parking. The Land Use Plan (Policy 4.2-7)
states "the city...through...zoning...will encourage businesses
to...reduce traffic and parking problems". The parking lot will
reduce parking problems.
3. The proposed site plan does not meet Section 62.104 (a) (c) which
requires entrance and exits to be at least 25 feet from the
adjoining property in the RT-1 district. Section 60.723 (7)
pe�mits the Planning Commission to modify Section 62.104 on
findings that... "the modification is consistent with the intent of
the code and with the reasonable enjoyment of adjacent property.
The proposed entrance and exit will be the existing alley and is 22 -
feet from adjoining RT-1 property. It can not be moved 3 feet
farther because an existing building is in the way. Continuing to
use the existing alley as the entrance and exit to the parking will
be consistent with the code and reasonable enjoyment of adjacent
property.

� 4. Section 62.105 (e) requires a front yard setback in the P-1 district
equai to the front yard setback in the adjoining RT-1 district which
is 19 feet. The proposed site plan shows a front yard setback of 4
feet. A 4 foot front setback would be permitted if the Board of
- Zoning Appeals grants a variance from the strict application of the
setback provisions. A 4 foot 6 inch screen fence will be required
along the east and south line of the proposed parking facility.
5. The traffic engineer states that the alley must be vacated.
Planning staff also recommends vacation. The only purpose of the
alley is to serve the parking lot and adjacent building. The
alley's maintenance and liability should be the responsibility of
the owner of the parking lot and building.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Comnission that
the petition of Thomas Lunzer to rezone property at 123 Manitoba more
particularly described as Lot 9, Block 2, Lewis Addition, from a RT-1
zoning classification to a P-1 zoning classification is consistent with the
Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby
recommend to the Council of the City of Saint Paul that property located at
123 Manitoba be rezoned from RT-1 to P-1 in accordance with the petition
for rezoning on file with the Saint Paul Planning Division.

The applicant was present. There was opposition present at the hearing.
Royer Ryan showed slides of the site and reviewed the staff report with a
recorrnnendation fo� approval . �
Thomas Lunzer stated that the residents of Rice Street are trying to
�ehabilitate it and improve it. This is only the fi�st of many times that
they will be coming before the Zoniny Comnittee askiny for their approval .
Mike Temali, N.E.A.R., stated again that the residents of Rice Street are
trying to rehabilitate it and improve it and hoped the Zoniny Cortxnittee
will approve the request for rezoning.
Sharon Voyda, District 6 Community Oryanizer, stated that District 6
approves the rezoning for 123 Manitoba.
Lee Jacobs, 121 Manitoba, stated that the residents were promised to see
the plans for the rezoning and have not received any. He feels there is no
need fo� additional parking in that particular a�ea.
Hearing no further testimony, Mr. Pangal closed the public hearing portion
of the meetiny.
Ms. Morton moved approval based on findings 1 throuyh 5 provided that -(1) a
19 foot front yard along Manitoba be established or a variance be granted
by the BZA for a 4 foot yard, (2) the alley be vacated; a�d (3) the site is
developed in accordance with a site plan approved by the Planning
Commission. Mr. Levy seconded the motion, which passed a roll call vote of
7 to 0.
