An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, Bernard Mersch duly petitioned to rezone Lot 6, Block 1,
Davern's Rearrangement located at 1210 Randolph Avenue from B-2 to RM-2 for the
purpose of converting two basement offices into two residential apartments the
petition having been certified by the Planning Division on October 15, 1985, as
having been consented to by at least 67% of the owners of the area of the
property to be rezoned, and further having been consented to by at least two-
thirds of the owners of the property situated within 100 feet of the total
contiguous property within one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on November 7, 1985, conducted a public
hearing for the purpose of considering the rezoning petition, and pursuant to
Section 107.03 of the Administrative Code, submitted its recorrr�nnendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on November 8, 1985, and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
November 16, 1985, and notices were duly mailed to each owner of affected
property and property situated wholly or partly within 350 feet of the property
sought to be rezoned; and

having considered all the facts and recorr�nendations concerning the petition;
now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 27, as incorporated
by reference in Section 60.301 of the Saint Paul Legislative Code, as amended,
is hereby further amended as follows:

Dear Sir:
On November 7, 1985, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The petitioner testified. At the close of
the public hearing, the Committee voted 6 to 1 to approve the rezoning based
on staff findings.
On November 8, 1985, the Planning Commission upheld the Zoning Committee' s
� recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on December 5,
1985. Please notify me by December 3, 1985, if any member of the City Council

WHEREAS, Bernard Mersch File �9198 has petitioned to rezone 1210 Randolph
Avenue, situated on south side of Randolph between Edgecumbe Road and Griggs, �
from B-2 to RM-2 for the purpose of converting a mixed-use building to an all
residential use building by refurbishing 2 basement offices to apartments; and
WHEREAS, the Zoning Committee of the Planning Commission, on November 7, 1985
- held"a public hearing at,which all persons present were given an oaportunity
to be heard pursuant to said petition in accordance with the requirements of
Section 64.400 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence
presented to the Zoning Committee at the public hearing as substantially
reflected in the minutes, made the following findings of fact:
1. The City's Comprehensive Plan states:
a) A major housing challenge for the 1980s is that "we don't have
enough housing units to meet the demand."
b) "Through its land use policies, controls and incentives, the city
will promote the clustering of compatible land uses...to meet land
use demand in the 1980s". Policy 3.2-1.
c) "Medium density housing consisting of townhouses, walk-up
condominiums and rental apartments should be developed on sites
adjacent to neighborhood commercial areas, traffic corridors and
on large vacant or underutilized sites with both built-up and
developing city neighborhoods". Policy 1.56.
d) It will "ensure that a major po�tion of rental units constructed
are affordable to moderate income households" (defined as monthly
rental of $350-$479) Affordable Housing Obj . 2.

3. To the east of applicant's property are two single family homes.
4. Applicant will create two apartments, one renting for E300/month and
one renting for �400/month.
5. The applicant's lot area is 5,356 square feet. Minimum lot size
- required is 10,000 square feet. The total number of zoning rooms
permitted in an RM-2� zone of this size is 9. After convrrsion, the
building would contain 17 rooms. Variances must be obtained from the
Board of Zoning Appeals in order to proceed with this conversion.
6. The applicant be required to receive a variance for density from the
Board of Zoning Appeals and that the Board of Zoning Appeals makes
sure the requirement of 6 parking spaces is met.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of Bernard Mersch to rezone property at 1210 Randolph Avenue more
particularly described as Lot 6, Block 1, Davern's Rearrangement from a RM-2
zoning classification to a 6-2 zoning classification is consistent with the
Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby �
recommend to the Council of the City of Saint Paul that property located at
1210 Randolph Avenue be rezoned from RM-2 to B-2 in accordance with the
petition for rezoning on file with the Saint Paul Planning Division.

PRESENT: Ntnes. Morton, Summers, Tracy and Zieman; Messrs. Galles, Levy and -
Pangal of the Zoning Comnittee; Mr. Segal , Assistant City �
Attorney; Ms. Lane of the Division of Housing and Building Code
Enforcement; Ms. Synstegaard, Mr. Ryan, Ms. Datsko and
Mr. McGuire of the Planning Division Staff.
ABSENT: Mr. Lanegran
The meeting was chaired by Joseph Pangal , Chairman.
The applicant was not present. There was opposition present at the
hearing.
BERNARD MERSCH (#9798) : Rezoning for property located at 1210 Randolph
Avenue to convert a mixed-use building to an all residential use building
refurbishing 2 basement offices to apartments.
Donna Datsko showed slides of the site and reviewed the staff report with a
recommendation for approval . She also stated that the zoniny history was
that the property was zoned commercial and that the former owner was going
to put up 5 unit apartment building. The applicant withdrew his petition
so the case never went through.
Larry Lendway, 94U Rogers Street, applicant's representative, stated that
Mr. Mersch would like to convert the offices into apartments so they would
be easier to rent. He stated that Mr. Fink (the former owner) had a hard
time getting renters for office space.
Rosella Peterson, 1211 Juno, stated that she lives directly across the
alley from the building. She does not believe there will be enough parking
if the offices are converted into apartments as there is already a serious
parking problem now.
John Truestill , 1211 Juno Avenue, stated that the biggest problem in the
area is parking. When there is a snow storm it is a d.isaster. There is
one gentlemen who parks in front of his home everyday and that there is -
also a new business coming into the area.
Mike McQuillan, 1199 Juno Avenue, stated that he is concerned with the
traffic and extra cars belonging to tenants in the area if the offices are
converted into apartments. He stated that Mr. Mersch has not submitted a
site plan to the area residents. He asked the Committee how they come to a
decision as to how to zone an area. Mr. Pangal stated that they look at
each site very carefully before deciding.
It was asked what could go into the building according to what it is zoned
now. Mr. McGuire answered that an eating and drinking establishment,
workshop, etc. could yo in for that particular zone.

The Committee discussed what would be better for the area: apartments or
cortmercial use going into the basement of the building, the space available
in the basement, parking spaces, parking restrictions on the street, and
that Randolph is a snow emergency route.
Hearing no fu�ther testimony, Mr. Pangal closed the public hearing portion
of the meeting.
Mr. Levy moved approval based on findings 1 through 5 on the condition that
the applicant appear before the Board of Zoning Appeals to request a
density variance and that the Board of Zoning Appeals make sure the
requirement of 6 parking spaces is met. Ms. Morton seconded the motion,
which passed on a roll call vote of 6 to 1 (Summers).

e�ressing �� feelings in a letter. Because of phqaical disabilities
it xould be very difficult to attend the hearing.
I recall sigaing a petition about 23 years ago when the bu?ld-
ing at I2I0 Randolph was being built. The complex was not to have
more apartments than they had off the street� parking f�r. A permit
for four (4) apart�ments was granted .
Why now when the parking a►�d tr�ffic is a far greater problem,
should a permit for two (2) more apar-tments be gra�ted2 I do n�t�
approve.
r:ost working couples have 2 cars, so 2 more apartments could
generate 4 more c�rs. I count� 28 car•s belonging to r•esi�ents i� the
bloc'a now. r�t least when the space in question t�as us�a for offices,
tr:�r=� w�.s only sp�,smodic parki!�g on the street , during the d=�.y.
Parkin3 on Randolph is a real problem. It is a rare occasion
wh�n my daughter can fi�d a sp�ce in front of our home. There �ave
re�n times krhen visitors of ours, have had to park on Juno. And
ther-e is not much space on Juno either.
Randolph is a snow emergency route, so we do get plotaed out fast.
But even so ti•:tth parking on roth sides of the street , there ar-e times
w'�en vehiclAS travding in opposite directions ca!�not pass one
another, one waits.
The alley too becomes a zoo. The alley bears a lot of traffic,
m�ny trucks, store customers, dental staff and patients, trash

An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, Gerald and Sally Elert duly petitioned to rezone Lot 11, Block
17, Summit Park Addition located at 844 Grand Avenue from RM-2 to B-1 for the
purpose of operating an antiques store the petition having been certified by the
Planning Division on September 3, 1985, as having been consented to by at least
67% of the owners of the area of the property to be rezoned, and further having
been consented to by at least two-thirds of the owners of the property situated
within 100 feet of the total contiguous property within one year preceding the
date of the petition; and
WHEREAS, The Zoning Committee on September 19, 1985, conducted a public
hearing for the purpose o� �onsidering the rezoning petition, and pursuant to
Section 107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be denied; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on September 27, 1985, and recommended that the City Council
deny the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
October 5, 1985, and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought to
be rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
October 17, 1985, where all interested persons were heard, and the Council
having considered all the facts and recommendations concerning the petition;
now, therefore,

Section 1.
