The meeting was called to order at 2:00 p.m.
STAFF PRESENT: Corinne Asuncion, License, Inspecrion, Environmentai Protection (LIEP).
Gerry Sirathman stated this is a continuation of a legislative heazing that was commenced on
October 2, 2000 to heaz objecfions to a license for Fred Sande, doing business as Cosmic
Chazlie's, 189 Snelling Avenue North. At that time, testimony was offered by Glen Leder, 1589'/�
Selby Avenue North, and testimony was taken by the owner, Fred Sande. At the conclusion of
that hearing, Mr. Strathman recommended continuing the hearing for one month so Mr. Sande
and neighbors could get together to reach an accommodation that wouid work for both the
business and neighbors.
Corinne Asuncion reported that no new ob}ections to the license ha�e been reported.
Fred Sande, owner, appeared and stated he has established contact with the neighbors who had
objections to the license. Mr. Sande discussed with neighbors that they can contact lum directly
with any questions or concerns they may have regarding Cosmic Charlie's. Mr. Sande also feels a
good rapport with the neighbors has been established.
Mr. Strathman asked Mr. Sande if he feels the neighbors no longer object to issuance of a cabazet
license. Mr. Sande responded he does not think so, and if there were any problems Cosmic
Charlie's would discontinue the license. Mr. Strathman stated any new objections received within
the next two weeks will be reported to the Ciry Council along with this report.
Mr. Strathman recommended approval of this license.

Lairy Zangs, LIEP.
Gerry Strathman stated this meeting is being held to heaz objections to a license for Fred Sande,
doing business as Cosmic Charlie's, 189 Snelling Avenue North.
Christine Rozek reported this appiicant is applying for a Cabaret License in addition to a
Cigazette and Limited Restaurant License. There are no conditions placed on licenses currently
held and no pending adverse acrion. A11 zoning requirements have been met. Ms. Rozek
recommends approval.
Gwen Leder, 1589'/2 Selby Avenue North, Apartment 12, appeared and stated that she has been a
tenant for five years in the complex that faces Cosmic Charlie's outdoor patio (located behind the
establishment). The music coming from this establishment has been very loud until early
morning hours and the smell of marijuana is present. The Police Department has been called
numerous times by tenants. This has been a constant battle for the past five years with the
previous owner. Tenants are extremely frusirated and fear the addition of musicians will increase
noise levels. Ms. Leder has spoken with the Merriam Park Community Council and the Snelling
Selby Business Association about the high no3se levels and nothing has been done to address the
issue.
Mr. Strathman stated he has received a letter supporting tlus applicarion by Merriam Park
Community Council. Ms. Leder responded she is awaze of this and understands that they would
like to have a place for people to "hang out." Residents do not haue a problem with this, but
being awakened at 2 a.m. by loud music is not a pleasant situation.
Mr. Strathman stated he received the foilowing correspondence: Gwen Leder, 1589%s Selby
Avenue #12, wrote about loud noise in the early morning; Paul Given, Merriam Park Community
Council, 1573 Selby Avenue, Suite 311, wrote the business is building relationships with both
resident and business neighbors; Mike O'Rourke, representing property owners at 175-181 North
Snelling, wrote tenants have continuing problems with clientele at Cosmic Chazlie's, theft and
vandalism has increased, and there is inadequate pazking; Jennifer White, 1583 '/z 5elby Avenue,
wrote this is a residential area and there has been an increase in late night noise, loitering, fights,
disorderly conduct and being awakened in the middle of night; Mrs. Copper Harding, 1583 %z
Seiby Avenue #9, wrote about late night noise, police calls, inadequate parking, and feels this

license will e�sperate the problem and increase the number of police calls; Renee Obrecht-
Como, 1583 Selby Avenue #10, wrote about numerous compiaints by tenants, police calls, after
hours noise, swearing and yelling during eazly morning hours; David and Jennifer Patrick, 1589'/z
Selby Avenue #I5, wrote about noise, inability to sleep, and fighting; Anonymous tenant, 1589'/z
Selby Avenue, wrote about juke box playing at all hours of the night even after closing time,
increased trafi"ic, and tenants moving out of the compiex because of the noise caused by Cosmic
Charlie's.
Fred Sande appeared and presented letters he sent out to surrounding residences and businesses.
Mr. Sande stated he was aware Cosmic Chazlie's was a nuisance prior to his tTking over the
business. His goal is to make ties with the community, which he did with the Business
Association, Merriam Park Community Council, and surrounding businesses. Mr. Sande denies
any knowledge of complaints from residents in the surrounding area.
Fred Sande Junior appeazed and stated they have expressed their willingness to accommodate any
complaints neighbors may have.
Fred Sande stated he is hoping to meet with the neighbors to discuss any problems or concerns
they may have. He is willing to be reached by cell phone, pager, or home phone to personally
respond to any complaints. He is in agreement with the complaints. Loud music at night is
unacceptable. The Juke box has been turned down internally so the patrons at Cosmic Charlie's
cannot adjust the volume. Mr. Sande states the first change he made to Cosmic Chaziie's was to
encourage patrons to move from the front of the buiiding to the inside or to the back patio. Mr.
Sande acknowledges they apparently moved the problem from the front of the building to the back.
He has proposed shutting down the patio to pacify neighbor complaints and decrease noise levels.
Mr. Strathman asked Mr. Sande what his intentions are with the license and what kind of insurance
can he give that the Cabaret License will not cause further disturbances. Mr. Sande responded he
was reluctant to pursue the license until he noticed the large crowd at Dunn Bros. when musicians
and entertainment were provided. He stated lus intention is to promote business. He would like
input from neighbors and would like to go ahead with the license.
Mr. Strathman proposes continuing the heazing for one month so Mr. Sande and neighbors can get
together to reach an accommodation that works for both the business and neighbors. If objections
still exist after one month when the hearing reconvenes, they will be addressed. If there are no
objections, recommendation of approval could possibly be given.
Larry Zangs reported the zoning ordinance covering parking for cabaret vs. restaurants is the same.
The zoning adininistrator has to deternune if there has been a change in use requiring additionai
parking. There is no additional parking required because the former use was a chiropractic clinic.
The change in use from the chiropracfic cluuc to Cosmic Chazlie's, with a Cabaret Licence, is an
increase of five off street parking spaces. The code reads a business does not have to provide any
additional parking spaces for an increase of five or fewer.

Fred Sande Junior stated Coswic Charlie's is open until midnight. Saturday and Sunday they aze
open until 1:00 a.m. They are wondering if it is unlawful to park on that block currently designated

department.
Gerry Strathman recommended continuing the hearing on Monday, November 6, 2000 at 2:00 p.m.

previous owner. Tenants are extremely frusirated and fear the addition of musicians will increase
noise levels. Ms. Leder has spoken with the Merriam Park Community Council and the Snelling
Selby Business Association about the high no3se levels and nothing has been done to address the
issue.
Mr. Strathman stated he has received a letter supporting tlus applicarion by Merriam Park
Community Council. Ms. Leder responded she is awaze of this and understands that they would
like to have a place for people to "hang out." Residents do not haue a problem with this, but
being awakened at 2 a.m. by loud music is not a pleasant situation.
Mr. Strathman stated he received the foilowing correspondence: Gwen Leder, 1589%s Selby
Avenue #12, wrote about loud noise in the early morning; Paul Given, Merriam Park Community
Council, 1573 Selby Avenue, Suite 311, wrote the business is building relationships with both
resident and business neighbors; Mike O'Rourke, representing property owners at 175-181 North
Snelling, wrote tenants have continuing problems with clientele at Cosmic Chazlie's, theft and
vandalism has increased, and there is inadequate pazking; Jennifer White, 1583 '/z 5elby Avenue,
wrote this is a residential area and there has been an increase in late night noise, loitering, fights,
disorderly conduct and being awakened in the middle of night; Mrs. Copper Harding, 1583 %z
Seiby Avenue #9, wrote about late night noise, police calls, inadequate parking, and feels this

license will e�sperate the problem and increase the number of police calls; Renee Obrecht-
Como, 1583 Selby Avenue #10, wrote about numerous compiaints by tenants, police calls, after
hours noise, swearing and yelling during eazly morning hours; David and Jennifer Patrick, 1589'/z
Selby Avenue #I5, wrote about noise, inability to sleep, and fighting; Anonymous tenant, 1589'/z
Selby Avenue, wrote about juke box playing at all hours of the night even after closing time,
increased trafi"ic, and tenants moving out of the compiex because of the noise caused by Cosmic
Charlie's.
Fred Sande appeared and presented letters he sent out to surrounding residences and businesses.
Mr. Sande stated he was aware Cosmic Chazlie's was a nuisance prior to his tTking over the
business. His goal is to make ties with the community, which he did with the Business
Association, Merriam Park Community Council, and surrounding businesses. Mr. Sande denies
any knowledge of complaints from residents in the surrounding area.
Fred Sande Junior appeazed and stated they have expressed their willingness to accommodate any
complaints neighbors may have.
Fred Sande stated he is hoping to meet with the neighbors to discuss any problems or concerns
they may have. He is willing to be reached by cell phone, pager, or home phone to personally
respond to any complaints. He is in agreement with the complaints. Loud music at night is
unacceptable. The Juke box has been turned down internally so the patrons at Cosmic Charlie's
cannot adjust the volume. Mr. Sande states the first change he made to Cosmic Chaziie's was to
encourage patrons to move from the front of the buiiding to the inside or to the back patio. Mr.
Sande acknowledges they apparently moved the problem from the front of the building to the back.
He has proposed shutting down the patio to pacify neighbor complaints and decrease noise levels.
Mr. Strathman asked Mr. Sande what his intentions are with the license and what kind of insurance
can he give that the Cabaret License will not cause further disturbances. Mr. Sande responded he
was reluctant to pursue the license until he noticed the large crowd at Dunn Bros. when musicians
and entertainment were provided. He stated lus intention is to promote business. He would like
input from neighbors and would like to go ahead with the license.
Mr. Strathman proposes continuing the heazing for one month so Mr. Sande and neighbors can get
together to reach an accommodation that works for both the business and neighbors. If objections
still exist after one month when the hearing reconvenes, they will be addressed. If there are no
objections, recommendation of approval could possibly be given.
Larry Zangs reported the zoning ordinance covering parking for cabaret vs. restaurants is the same.
The zoning adininistrator has to deternune if there has been a change in use requiring additionai
parking. There is no additional parking required because the former use was a chiropractic clinic.
The change in use from the chiropracfic cluuc to Cosmic Chazlie's, with a Cabaret Licence, is an
increase of five off street parking spaces. The code reads a business does not have to provide any
additional parking spaces for an increase of five or fewer.

Fred Sande Junior stated Coswic Charlie's is open until midnight. Saturday and Sunday they aze
open until 1:00 a.m. They are wondering if it is unlawful to park on that block currently designated
as fifteen minute pazking after 9:00 p.m. Mr. Stratlimau suggested contacting the Police
department.
Gerry Strathman recommended continuing the hearing on Monday, November 6, 2000 at 2:00 p.m.
The meeting was adjourned at 223 p.m.
