Mosley 438 Main Street, #404 Saint Paul, MN 55101 RE: Application for Taxicab Driver's License Deaz Mr. Mosley: The Office of License, Inspections and Environmental Protection has recommend denial of your appiication for a Taaticab Driver's License. The basis for the denial is as follows: Your license application fee of $66.00 was paid for by check, which was drawn on the account of Lachanda Mosley, and which was returned by the bank for non-sufficient funds. You currently owe $81.00 in fees and charges for your license application. If you do not dispute the above facts, you may withdraw your application at this time. Alternatively, if you do not dispute the above facts, but wish to have a hearing in front of the Saint Paul City Council to dispute the recommended denial of your license application, you will need to send me a letter admitting the violation and requesting a public hearing. The matter will then be scheduled for a pubiic hearing before the City Council to determine the disposition of your license application. You will have an opportunity to appear and speak on your own behaif, or to have someone appeaz there for you. On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary hearing before an Administrative Law Judge (t1LJ). If you wish to have such a hearin„ you wiil need to send me a letter stating that you are contesting the facts. You will then be sent a"Notice of Hearing" with the date, time and place for the hearing, the name of the administrative law jud�e, and an explanation of the procedures. Effecrive March 15, 1991, no person shall drive a taxicab, nor shall any owner or lessee of a taxicab allow any other person !o dtive a taxicab, wiihin the Ciry of Saint Paul untess tha[ person has fust obtained and displayed a taxicab drivec`s license under the provisions of this Code. (b) Drivers from other cities. Any driver ]icensed to operate a faxicab in another city may carry passen�ers from that ciry to any place within the City of Saini Paul and may freely enter and a�avel upon the streets for tiiat purpose. In that case, it shall not be deemed necessary for the taxicab driver to obiain a Saint Paui license but the drivec shall not be permitted to accept or offer any passenger for hire in the City of Saint Paul, ot othernise operate a taxicab within the city without first obtaining a license undzr the prol�isions of this Code. tiVhile �vithin the city the taxicab driver shall be iequ'ued to observe all of the applicable regulaaons and condiiions of this section and shall have in possession and display to any person upon detnand the license certificate for the taxicab. (c} License application. Every applicant for a taxicab drivei s license shall file an application with the license division. The application shall be made on a form provided by said division, containing such informafion as the license inspector may require, ifictudin„ but not liznited to, a complete employment history, to verify that the terau and conditions ofthis chaptzr have been met. The app[ication shall bz signed and swom to by the applicant. Prior to the issuance of the license, every licensee shall bz photo�raphed. The chief of police or his representarive shall investi�ate each applicant and shall fonvard the results of the application to the license inspector. Any false statement on the application shall be grounds for denial, refusal to renew or revocation of a licease. To rzceive a taxicab driver's license by March 15, 199 Z, the applicant must, in addition io meetin� the other requirements of 1aw, fiie the application with the diyision by Novembzr 1 S, 1990, for drivers whose last names begin with the [etters A througE� and including F; Decembzr I5, 1990, for drivers whose (ast names begin with the letters G through and including L; January 15, 1991, for drivers whose last names be�in with the ]etters M throu�h and including R; February 15, 1991, for drivers whose last names begin with the letter S through and inctudin� the letter Z. (d) License fee. Each appiicant for a taxicab driver's Iicense shall, at the initial time of filing his or her application, pay a non-refundable license fee of sixty-six dollars ($66.00). • (e) PrerequisiYes to license. Eligibility to be liceased to operate a taxicab shall be as fotlows: (I) Possess a valid Minnesota driver's license; {2) Be at least eighteen (18) years old; (3) Be a citizea of the United States, or an alien admitted Forpermanent residence, or who has othenvise obtained work authorizatioiL from the U.S. Immigration and Naturalizatioa Service; (4) Shall have no felony convictions in the last five (5) years; shall have no nontraffic gross misdemeanor or misdemeanor conviction= in the last three {3) years involving the use or threat of use of force, possession or sale of a controiled substance, prostitution o� indecent conduct. The license inspector enay grant, pursuant to state statute, an exception to the above provisions upon evidence tha the offense is not retated to the occupation of taxicab driver; (5) Shall have a driving record meeting the followin� standards: a. No convictions in the last five (5) years for any of the follo�ving offenses involvin� injury or death; no conviction in the ta� three (3j years for any of the following affenses nat invoiving injury or death: I. Leaving the scene of an accident; 2. Driving under the influence of an alcoholic beverage or drug; 3. Reckless or careless driving; or 4. Refusal to take a breathatyzer test. b. For ori�inal licensure: No more than fouc (4) moving violations within the last tluee (3) years, and no more than nvo (— moving violations in the last year. For renewal: no more than four {4) moving violations within the last three (3) years and � more than tluee (3) movin� violations in the last year. Each taxicab driver s license shall have upon it a number by which the license sha11 be designated, a photog p3 of the licensee, and s¢ch other infoccnation as the license inspector may require. 7he license inspector may issue licenses for a tean of less Ihan one (1) year for a prorated initial fee in order to evenly dismbute license expuation dates throughout the year. (h) Requirement of valid Minnesota drivers license. Any time that a]icensee's Minnesota driver's license is suspended, revoked or canceled, his or her tasica6 driver s license shall likewise be immediately saspended, revoked or canceIed. No person shall operate a taxicab without a valid Minnesota driver s license. (i) Renewa[s. A taxicab driver s license shall be issued annually. The license inspector may cause tfie renewal of a taxicab driver's license from year to year by appropriate endorsement upon the application for renewai and payment of an annual fee of twenty dollars (�20,00). The driver shall make such renewal application upon z foizn to be furnished by the Iicense division. The renewal form shall be fillzd out �vith the full name and address of the applicant, togetHer with the date and number of the ori�inal license. If a driver has not been licensed in the pre��ious license yeat, he or she shall be considered a new app�icant, � (j) Suspension, revocation and nonrenewal. A taxicab drivers license may be revoked, suspended or not renewed by the license inspector at any time for cause pursuant to the provisions of this chapter and Chapcer 3I0 of the Legislative Code. When a taxicab drivei s license has been revoked or suspended, it sha]] immediately be retumed to the license division. If ihe city council stipulates that a licensee whose tacicab driver's license has been revoked may reapply after a specific period of time has elapsed, that period of time shall not commence until the taxicab driver's ]icense has been retumed to the license division. • (k) Revocation of Minnesota driver's license; timited licenses; alcohol-related drivin� conviction: (1) Any person holding a taxicab driver's Iicense whose Minnesota driver's license is suspended, canceled or revoked for any reason shall tmmediately surrender his ar her taxicab driver's license to the license division. The taxicab driver's ]icense shall be retumed to the licensee upon reinstatement ofthe Minnesota driver's license or issuance of a limited license authotiztn� operation ofa taxicab; providzd, however, that suspension, cancellation or revocation of a Minnesota driver's license due to refusal to submit to a le�al(y required blood aicohol test under the state implied consent statute sha11 be grounds for thz rzcocatioq nonissuance or nonrenewal of the taxicab driver's license. (2) Any licensed taxicab driver whose iblinnesota driver's license has been revoked and who has been issued a timited [icense aathorizing the operation of a taxicab shall immediately notify the license division of tke same. At that time, the licensee shail furnish to the license inspector a copy of the limited license and a written statement containing a schedule of the days and hours of each day durin� which he or she will be driving a taxicab durin� the term of the limited license, no deviation from the schedule shall be permitted. In addition, the licensee shall personally fumish to the ]icense inspectorcopies ofall hip sheets for aIl shifts worked during tfie tecm of the limited license. (3) Any person holdino a taxicab driver's license shal] notify the Office ofLicense, Inspections and Environmental Protection (LIEP) immediately whenever he or she is con�icted of an alcohol-related driving offense, whetfter or not it involves the operatiott of a taxicab. Eligibility to be liceased to operate a taxicab shall be as fotlows: (I) Possess a valid Minnesota driver's license; {2) Be at least eighteen (18) years old; (3) Be a citizea of the United States, or an alien admitted Forpermanent residence, or who has othenvise obtained work authorizatioiL from the U.S. Immigration and Naturalizatioa Service; (4) Shall have no felony convictions in the last five (5) years; shall have no nontraffic gross misdemeanor or misdemeanor conviction= in the last three {3) years involving the use or threat of use of force, possession or sale of a controiled substance, prostitution o� indecent conduct. The license inspector enay grant, pursuant to state statute, an exception to the above provisions upon evidence tha the offense is not retated to the occupation of taxicab driver; (5) Shall have a driving record meeting the followin� standards: a. No convictions in the last five (5) years for any of the follo�ving offenses involvin� injury or death; no conviction in the ta� three (3j years for any of the following affenses nat invoiving injury or death: I. Leaving the scene of an accident; 2. Driving under the influence of an alcoholic beverage or drug; 3. Reckless or careless driving; or 4. Refusal to take a breathatyzer test. b. For ori�inal licensure: No more than fouc (4) moving violations within the last tluee (3) years, and no more than nvo (— moving violations in the last year. For renewal: no more than four {4) moving violations within the last three (3) years and � more than tluee (3) movin� violations in the last year. Every new applicant shall have at least one (1) year s drivin� experience as a licen;ed driver. (6) Have a demonsnated knowled�e of the provisions of the taxicab ordinance relatin� to the conduct of tazicab drivers and � operation of a taxicab. � (7) Failure to appty for renewa( of any taxicab operators licease within thirty (30) days afczr expaation shall be dzemed abandonmeat of the licensee's ri�ht to such renewal. 'V (1 � � C� (g) Issuance of license. Each taxicab driver s license shall have upon it a number by which the license sha11 be designated, a photog p3 of the licensee, and s¢ch other infoccnation as the license inspector may require. 7he license inspector may issue licenses for a tean of less Ihan one (1) year for a prorated initial fee in order to evenly dismbute license expuation dates throughout the year. (h) Requirement of valid Minnesota drivers license. Any time that a]icensee's Minnesota driver's license is suspended, revoked or canceled, his or her tasica6 driver s license shall likewise be immediately saspended, revoked or canceIed. No person shall operate a taxicab without a valid Minnesota driver s license. (i) Renewa[s. A taxicab driver s license shall be issued annually. The license inspector may cause tfie renewal of a taxicab driver's license from year to year by appropriate endorsement upon the application for renewai and payment of an annual fee of twenty dollars (�20,00). The driver shall make such renewal application upon z foizn to be furnished by the Iicense division. The renewal form shall be fillzd out �vith the full name and address of the applicant, togetHer with the date and number of the ori�inal license. If a driver has not been licensed in the pre��ious license yeat, he or she shall be considered a new app�icant, � (j) Suspension, revocation and nonrenewal. A taxicab drivers license may be revoked, suspended or not renewed by the license inspector at any time for cause pursuant to the provisions of this chapter and Chapcer 3I0 of the Legislative Code. When a taxicab drivei s license has been revoked or suspended, it sha]] immediately be retumed to the license division. If ihe city council stipulates that a licensee whose tacicab driver's license has been revoked may reapply after a specific period of time has elapsed, that period of time shall not commence until the taxicab driver's ]icense has been retumed to the license division. • (k) Revocation of Minnesota driver's license; timited licenses; alcohol-related drivin� conviction: (1) Any person holding a taxicab driver's Iicense whose Minnesota driver's license is suspended, canceled or revoked for any reason shall tmmediately surrender his ar her taxicab driver's license to the license division. The taxicab driver's ]icense shall be retumed to the licensee upon reinstatement ofthe Minnesota driver's license or issuance of a limited license authotiztn� operation ofa taxicab; providzd, however, that suspension, cancellation or revocation of a Minnesota driver's license due to refusal to submit to a le�al(y required blood aicohol test under the state implied consent statute sha11 be grounds for thz rzcocatioq nonissuance or nonrenewal of the taxicab driver's license. (2) Any licensed taxicab driver whose iblinnesota driver's license has been revoked and who has been issued a timited [icense aathorizing the operation of a taxicab shall immediately notify the license division of tke same. At that time, the licensee shail furnish to the license inspector a copy of the limited license and a written statement containing a schedule of the days and hours of each day durin� which he or she will be driving a taxicab durin� the term of the limited license, no deviation from the schedule shall be permitted. In addition, the licensee shall personally fumish to the ]icense inspectorcopies ofall hip sheets for aIl shifts worked during tfie tecm of the limited license. (3) Any person holdino a taxicab driver's license shal] notify the Office ofLicense, Inspections and Environmental Protection (LIEP) immediately whenever he or she is con�icted of an alcohol-related driving offense, whetfter or not it involves the operatiott of a taxicab. Effecrive March 15, 1991, no person shall drive a taxicab, nor shall any owner or lessee of a taxicab allow any other person !o dtive a taxicab, wiihin the Ciry of Saint Paul untess tha[ person has fust obtained and displayed a taxicab drivec`s license under the provisions of this Code. (b) Drivers from other cities. Any driver ]icensed to operate a faxicab in another city may carry passen�ers from that ciry to any place within the City of Saini Paul and may freely enter and a�avel upon the streets for tiiat purpose. In that case, it shall not be deemed necessary for the taxicab driver to obiain a Saint Paui license but the drivec shall not be permitted to accept or offer any passenger for hire in the City of Saint Paul, ot othernise operate a taxicab within the city without first obtaining a license undzr the prol�isions of this Code. tiVhile �vithin the city the taxicab driver shall be iequ'ued to observe all of the applicable regulaaons and condiiions of this section and shall have in possession and display to any person upon detnand the license certificate for the taxicab. (c} License application. Every applicant for a taxicab drivei s license shall file an application with the license division. The application shall be made on a form provided by said division, containing such informafion as the license inspector may require, ifictudin„ but not liznited to, a complete employment history, to verify that the terau and conditions ofthis chaptzr have been met. The app[ication shall bz signed and swom to by the applicant. Prior to the issuance of the license, every licensee shall bz photo�raphed. The chief of police or his representarive shall investi�ate each applicant and shall fonvard the results of the application to the license inspector. Any false statement on the application shall be grounds for denial, refusal to renew or revocation of a licease. To rzceive a taxicab driver's license by March 15, 199 Z, the applicant must, in addition io meetin� the other requirements of 1aw, fiie the application with the diyision by Novembzr 1 S, 1990, for drivers whose last names begin with the [etters A througE� and including F; Decembzr I5, 1990, for drivers whose (ast names begin with the letters G through and including L; January 15, 1991, for drivers whose last names be�in with the ]etters M throu�h and including R; February 15, 1991, for drivers whose last names begin with the letter S through and inctudin� the letter Z. (d) License fee. Each appiicant for a taxicab driver's Iicense shall, at the initial time of filing his or her application, pay a non-refundable license fee of sixty-six dollars ($66.00). • (e) PrerequisiYes to license. Eligibility to be liceased to operate a taxicab shall be as fotlows: (I) Possess a valid Minnesota driver's license; {2) Be at least eighteen (18) years old; (3) Be a citizea of the United States, or an alien admitted Forpermanent residence, or who has othenvise obtained work authorizatioiL from the U.S. Immigration and Naturalizatioa Service; (4) Shall have no felony convictions in the last five (5) years; shall have no nontraffic gross misdemeanor or misdemeanor conviction= in the last three {3) years involving the use or threat of use of force, possession or sale of a controiled substance, prostitution o� indecent conduct. The license inspector enay grant, pursuant to state statute, an exception to the above provisions upon evidence tha the offense is not retated to the occupation of taxicab driver; (5) Shall have a driving record meeting the followin� standards: a. No convictions in the last five (5) years for any of the follo�ving offenses involvin� injury or death; no conviction in the ta� three (3j years for any of the following affenses nat invoiving injury or death: I. Leaving the scene of an accident; 2. Driving under the influence of an alcoholic beverage or drug; 3. Reckless or careless driving; or 4. Refusal to take a breathatyzer test. b. For ori�inal licensure: No more than fouc (4) moving violations within the last tluee (3) years, and no more than nvo (— moving violations in the last year. For renewal: no more than four {4) moving violations within the last three (3) years and � more than tluee (3) movin� violations in the last year. (� Duty ro e.ehibEt iicense. Effective Macch 15,199I, every tasicab driver while on duty shall display thz $ont ofhis or her taxicab driv— ticense on the dasfiboard of the vehicle in a location readily visible co passengers, which licznse displays the dri��er's photograph = license number on the front in a manner approved by the license inspector. 'V (1 � � C� (g) Issuance of license. Each taxicab driver s license shall have upon it a number by which the license sha11 be designated, a photog p3 of the licensee, and s¢ch other infoccnation as the license inspector may require. 7he license inspector may issue licenses for a tean of less Ihan one (1) year for a prorated initial fee in order to evenly dismbute license expuation dates throughout the year. (h) Requirement of valid Minnesota drivers license. Any time that a]icensee's Minnesota driver's license is suspended, revoked or canceled, his or her tasica6 driver s license shall likewise be immediately saspended, revoked or canceIed. No person shall operate a taxicab without a valid Minnesota driver s license. (i) Renewa[s. A taxicab driver s license shall be issued annually. The license inspector may cause tfie renewal of a taxicab driver's license from year to year by appropriate endorsement upon the application for renewai and payment of an annual fee of twenty dollars (�20,00). The driver shall make such renewal application upon z foizn to be furnished by the Iicense division. The renewal form shall be fillzd out �vith the full name and address of the applicant, togetHer with the date and number of the ori�inal license. If a driver has not been licensed in the pre��ious license yeat, he or she shall be considered a new app�icant, � (j) Suspension, revocation and nonrenewal. A taxicab drivers license may be revoked, suspended or not renewed by the license inspector at any time for cause pursuant to the provisions of this chapter and Chapcer 3I0 of the Legislative Code. When a taxicab drivei s license has been revoked or suspended, it sha]] immediately be retumed to the license division. If ihe city council stipulates that a licensee whose tacicab driver's license has been revoked may reapply after a specific period of time has elapsed, that period of time shall not commence until the taxicab driver's ]icense has been retumed to the license division. • (k) Revocation of Minnesota driver's license; timited licenses; alcohol-related drivin� conviction: (1) Any person holding a taxicab driver's Iicense whose Minnesota driver's license is suspended, canceled or revoked for any reason shall tmmediately surrender his ar her taxicab driver's license to the license division. The taxicab driver's ]icense shall be retumed to the licensee upon reinstatement ofthe Minnesota driver's license or issuance of a limited license authotiztn� operation ofa taxicab; providzd, however, that suspension, cancellation or revocation of a Minnesota driver's license due to refusal to submit to a le�al(y required blood aicohol test under the state implied consent statute sha11 be grounds for thz rzcocatioq nonissuance or nonrenewal of the taxicab driver's license. (2) Any licensed taxicab driver whose iblinnesota driver's license has been revoked and who has been issued a timited [icense aathorizing the operation of a taxicab shall immediately notify the license division of tke same. At that time, the licensee shail furnish to the license inspector a copy of the limited license and a written statement containing a schedule of the days and hours of each day durin� which he or she will be driving a taxicab durin� the term of the limited license, no deviation from the schedule shall be permitted. In addition, the licensee shall personally fumish to the ]icense inspectorcopies ofall hip sheets for aIl shifts worked during tfie tecm of the limited license. (3) Any person holdino a taxicab driver's license shal] notify the Office ofLicense, Inspections and Environmental Protection (LIEP) immediately whenever he or she is con�icted of an alcohol-related driving offense, whetfter or not it involves the operatiott of a taxicab. (4) Refusal to take and/or failure to pass a standard breathalyzer test administered pursuant to Minn. Stat. § 169.123 while on duty shali be grounds for revocation of a taxicab drivecs license.
