This exception shall not apply to establishments li- censed by the City for the sale of non-intoxicating malt beverages , non-intoxicating malt beverages and wine, and non-intoxicating malt �everages and wine as menu items only. Notwithstanding other provisions of this Legislative Code to the contrary, the Council may permit an on- sale licensee to permit the holding of a single event , such as a banque� , that includes the sale of raffle tickets as a part of the event activity, provided that such events are separate from the public areas of the licensed establishment, not open to the general public and the raffle conducted by a charitable organization licensed by the State of Minnesota. Section 3 . That Chapter 409 of the Legislative Code be and is hereby amended so as to add the following new section thereto : 409. 21 . Pull-tabs and tipboards in bars . On-sale licensees may request permission of the City Council to permit qualified charitable organizations to conduct lawful gambling in the form of pull-tabs and tip- boards only on the licensed premises. Application for permission shall be made to the license inspector and payment of the specified fee. If the application is granted the license shall contain an endorsement speci- 2. • . �/_- �'J`�- /�o G� . / �,?a2 � fying this approval and the gambling endorsement may be considered for renewal at the same time as the Council may consider renewal of the on-sale license. Gambling endorsements on on-sale licenses shall be subject to the following regulations which shall be deemed as a part of the license , and failure of compliance may constitute grounds for adverse action as prescribed in the Legislative Code : 1 ) Only charitable non-profit organizations whose primary function is the support of athletic activities and serving a majority of the youth from the City of Saint Paul or contributes a majority of its revenues on Saint Paul youth may be allowed to sell pull- tabs and tipboards on the premises. 2) Use of the licensed premises shall be by means of a written lease agreement between the licensee and the charitable organization. The lease shall be for a term of at least one year; a copy shall be filed with the license inspector, and also a copy must be kept on the premises and available for public inspection upon request. Leases shall be governed by the following: a) Maximum rent that may be charged is is $100. 00 per week. b) Rental payments may not be based on a percentage of profits from gambling. c ) The charitable organization may not reimburse the licensee for any license fees or other gambling related expenses incurred by the licensee. d) The only form of gambling that shall be permitted on the licensed premises shall be pull-tabs and tipboards approved by the license inspector. 3. . �F �,i� �'� ����i e) Pull-tabs and tipboards shall only be sold from a booth used solely by the charitable organization, and pull-tabs and tipboards shall neither be sold by employees of the licensee nor sold from the bar service area. f) The construction and maintenance of the booth used by the charitable organization shall be the sole responsibility of the charitable organization. g) The lease shall contain a provision per- mitting the licensee to terminate the lease if the charitable organization is found guilty of any violation of state or local gambling statutes , ordinances or rules and regulations . 3) Only one charitable organization shall be permitted to sell pull-tabs and tipboards on the licensed premises of a class A establishment, no more than two organizations at separate times in a class B establishment, and no more than two charitable organizations shall be permitted to sell pull-tabs or tipboards on the licensed premises of a class C establishment, provided they are located in totally separate areas. 4) The licensee may not be reimbursed by the charitable organization for any license or permit fees , and the only compensation which the licensee may obtain from the charitable organization is the rent fixed in the lease agreement. 5) The licensee must commit to a minimum of 20 hours of sales of pull-tabs and tipboards for the charitable organization. 6) As a qualification for removal of the per- mission to allow the sale of pull-tabs and tipboards on the licensed premises , the licensee must demon- strate to the license inspector that at least $1 ,000 in gross gambling revenues weekly are generated in a class A establishment, $2 , 000 in a class B estab- 4. - �. : ��=��'�=-��a�' . j�:�,�� ment, and $2, 000 per charity in a class C establishment, based on a 20 hour per week operation. 7) The licensee shall be responsible for the charitable organization' s conduct of selling pull-tabs and tipboards . The City Council may suspend the licensee ' s permission to allow gambling on the premises for a period up to 60 days for any violation of state or local gambling laws or regulations that occur on the premises by anyone, including the licensee or the charitable organization. A second violation within a 12 month suspension, and any additional violations within a 12 month period shall result in the revocation of the gambling permission, and may also be considered by the Council as grounds for suspension or revocation of the on-sale liquor license. Section 4. That Chapter 409 of the Legislative Code be and is hereby amended so as to add the following new section thereto: 409. 22. Charitable gambling regulations. The sale of pull-tabs and tipboards in on-sale licensed premises shall be conducted only by qualified and state licensed charitable organizations. In addition to satis- fying the qualifications set forth in Minnesota Statutes , Chapter 349, the following regulations and qualifications must be complied with by all such charitable organizations : a) Must be a non-profit charitable volunteer organization whose primary function is the sunport of athletic activities , incl�.xding the following activities : Acquatics , base- ball , basketball , boxing, football , gymnastics , golf, hockey, skiing, soccer, softball , speed and figure skating, tennis , volleyball and wrestling. The Council rnay, at its discretion, include non-profit charitable volunteer organi- zations whose primary function is the support of youth activities other than athletics after an initial six month period, provided such S. ' � �� �✓�`/�n� ' / � ��% organizations meet all other requirements of the charitable gambling ordinance. b) Must be a local charity serving youth, a majority of which are from St. Paul and/or spends a majority of its revenues on St. Paul youth. c) Must have been in existence for three years. d) May not be supported by a school athletic program, either public or private. e) Must file with the license inspector annually a list containing the names and addresses of all current members. f) Must use gambling proceeds only for youth athletic activities. If the organization generates funds for other uses , it must keep separate and accurate accounting records of all gambling receipts and disbursements . g) Must file financial reports weekly with the license inspector. h) May not have a gambling license in more than two class A establishments and no more than one class B or class C establishment in the City of St. Paul . i ) Must exhibit and sell pull-tabs and tipboards in a method as required by the license inspector. j ) May be required to demonstrate to the City Council that the majority of their total in- come is given to youth athletic activities . k) Workers or managers may not divulge the number of or the dollar amount of the winners at any time. 1 ) Shall not co-mingle game cards . 6 . � � � -� �,�` - /(o��' �73-?I m) Shall pay employees a minimum wage of $3.35 - per hour (federal minimum .wage) and no more than $5.00 per hour. n) Shall comply with all the provisions of • Minn. There is hereby established a special fund for the administration and distribution of the proceeds contrib- uted by charitable gambling in on-sale Iiquor establish- ments as specified in this Chapter. Monies in this fund 7. � � ���'�'-o� o� � ���3:�i may be expended only for such lawful purposes as set forth in Minnesota Statutes , Chapter 349 , and shall be expended to assist youth athletic organizations which are not selling pull-tabs and tipboards in licensed establishments . The City Council shall appoint a city-wide charitable organization and youth or adult representatives from each of the City' s recreation districts to advise the City on the disbursement of these funds . The Council , with the advice of the appointed city-wide charitable organization and representatives , shall by resolution adopt rules and regulations governing the administration of the fund, eligible applicants , and appropriate uses for the funds. These rules shall include the following: 1 ) Applicants for funding must be incorporated, nonprofit organizations formed for the pur- pose of supporting youth sports and athletic programs. Booster clubs organized for a recreation center or a specific sport may be eligible , but organized school teams whether public or private will not be eligible. 2) Applicants shall provide information setting forth its stated purpose , number of partici- pants served, area served and reasons why the funds are needed. 3) Funds may not be used for capital expenses , nor for salaries or travel expenses , but may be expended for an individual or team repre- senting the city or state in a state or national championship tournament. 4) No organization operating charitable gambling in the State of Minnesota will be eligible to receive funds. 5) Funds will be awarded on a matching basis only. 6) Organizations receiving funds shall file with the City financial reports showing how the funds were expended and for what purpose. No additional grants will be made until the organization has filed such reports of previous expenditures . 8 . � : �. ���--��D�' , � �:�� � Section 6. That Chapter 409 of the Saint Paul Legislative Code be and is hereby amended so as to add the following new section thereto: 409.24. Gambling managers . No person shall be a manager of any charitable organi- zation selling pull-tabs and tipboards in on-sale liquor establishments unless licensed by the City as provided herein and compliance with the following requirements. Application for gambling manager license shall be made at the office of license inspector on forms provided by said office. The annual license fee is $100.00. Gambling managers shall meet all the requirements of Minnesota Statutes , Chapter 349, and must file proof that a $10 , 000 fidelity bond has been pro- vided. An individual may not manage any charitable organization' s gambling operation for more than three consecutive years . Gambling managers may not receive more than $50.00 per week for compensation for services as a gambling manager. All gambling managers must successfully complete a training program established by the City, which training program shall include state charitable gambling laws , city charitable gambling ordi- nances , accounting procedures , record keeping and reporting procedures and methods . 9 . WILSON MARK VOERDING Councilman Legislative Aide T0: Members of the City CoLUic'1 FROM: Councilman Wilson / RE: Charitable Gambling Amendments DATE: December 24, 1985 Because of the questions raised by Councilmember Sonnen about the use of the term " payback " when refering to prizes awarded to players, I have researched various state and local bodies to identify language that more clearly stated the purpose. 1�ie State Gambling Board confirmed that the general language " payback " is a corrunon and correct use. However, language in a proposed ordinance for the City of Bloomington appears to be closer to wha.t we are trying to co�nunicate. Specifically, the proposed ordinance states that the organization ". . shall not use a tipboard, pull-tab or jar ticket which does not return to the players a minimLUn of 80%, which percentage s�a.11 include free plays awarded." I recorrnnend that we adopt a range of 75% to 80% return to players as a part of our ordinance. This would offer a wide variety of games, while still keeping uniformity throughout the city. The language would read as follows: Page 7 s) The charitable organization shall not use a pull-tab or tipboard which does not return to the players a minimwn percentage o 75%, nor a maximwn ercenta e o 800, which percentage shall include ree plavs awarded. I would also reco�nend that we amend the effective date of the ordinance to 60 days after passage, ratlier than 30 days. This should then give the city adequate time to train managers from the organizations, and also provide an overall period to settle any other issues that may arise. If the application is granted the license shal contain an endorsement specifying this approval an the gambling endorsement may be considered for renewa at the same time as the Council may con- sider rene al of the on-sale license. 2 . . ' , ' ' � c�� �'✓ /� t�� Gambling endorsements on on-sale licenses sh ll be subject to the following regulations which all be deemed as a part of the license , and fa' ure of compliance may constitute grounds for adv se action as prescribed in the Legislative Code : 1 ) Only charitable non-profit orga zations whose primary function is the suppo t of athletic activities and serving a ajority of the youth from the City of Sai t Paul or contributes a majority of its re enues on Saint Paul youth may be allowed o sell pull- tabs on the premises . 2) Use of the licensed premi es shall be by means of a written lease agr ement between the licensee and the charitable organization. The lease shall be for a term f at least one year; a copy shall be filed wit the license inspector, and also a copy must be pt on the premises and available for public ins ection upon request. Leases shall be governe by the following: a) Maximum rent t at may be charged is $100.00 per week. b) Rental payme ts may not be based on a percentage of profits from gambling. c) The charit ble organization may not reimburse the licensee for any license fees or othe gambling related expenses incurred by he licensee. d) The on y form of gambling that shall be permitt d on the licensed premises shall be pull-tabs. 3 . ., " �i� �'f'_��-1�O�� e) Pull-tabs shall only be sold from a booth used solely by the charitable organization, and pull-tabs shall nei her be sold by employees of the licensee nor sold from the bar service area. f) The construction and maintena e of the booth used by the charitable orga ization shall be the sole responsibility of the licensee. g) The lease shall contain a rovision permitting the licensee to te minate the lease if the charitable orga ization is found guilty of any violati n of state or local gambling statutes, or inances or rules and regulations . 3) Only one charitable org ization shall be permitted to sell pull-tabs on the licensed premises . 4) The licensee may not e reimbursed by the charitable organization or any license or permit fees , and the only comp nsation which the licensee may obtain from the ch itable organization is the rent fixed in the leas agreement. 5) The licensee mus commit to a minimum of 20 hours of sales of pull-tab per week for the charitable organization. 6) As a qualifica ion for removal of the permission to allow the sale of pull-tabs on the licensed prem- ises, the licens e must demonstrate to the license inspector that t e charitable organization is capable of generating a least $2, 500 in gross gambling revenues weekly based on a 20 hour per week operation. 4. � , � (;,�- �.�_ i� ��' 7) The licensee shall be responsible r the charitable organization' s conduct of elling pull-tabs. The City Council may sus end the licensee ' s permission to allow gamb 'ng on the premises for a period up to 60 days for any violation of state or local gambli g laws or regulations that occur on the pre ises by any- one, including the licensee or t e charitable organization. A second violati within a 12 month period shall cause an au matic 12 month suspension, and any additional violations with- in a 12 month period shall re ult in the revo- cation of the gambling permi sion, and may also be considered by the Council as grounds for suspension or revocation of the on-sale liquor license. Monies in this fund may be expended only for such lawful purposes as set forth in Minnesota Statutes , Chapter 349 and shall be expended • to assist youth athletic organizations which are not selling pull-tabs in licensed establi.shments. The City Council shall appoint a city-wide charitable organization and youth or adult representatives from each of the City' s recreation districts to advise the City on the disbursement of these funds. The Council , with the advice of the appointed city-wide charitable organization and representatives , shall by resolution adopt rules and regulations governing the administration ;� of the fund, eligible applicants , and appropriate uses for the funds. These rules shall include the following: ' 7. . . , �- �s��o�' : 1) Applicants for funding must be incorpo- rated, nonprofit organizations formed for the purpose of supporting youth sports and athletic programs . Booster clubs organized for a recre- ation center or a specific sport may be eligible , but organized school teams whether public or private will not be eligible. 2) Applicants shall provide information setting forth its stated purpose, number of participants served, area served and reasons why the funds are needed. 3) Funds may not be used for capital expenses , nor for salaries or travel e�enses, but may be ' expended for an individual or team representing the city or state in a state or national champion- ship tournament. 4) No organization operating charitable gambling in the State of Minnesota will be - eligible to receive funds. 5) Funds will be awarded on a matching basis only. . 6) Organizations receiving funds shall file � with the City financial reports showing how the funds were expended and for what purpose. No additional grants will be made until the organi- zation has filed such reports of previous ex- penditures. Section 6. The annual license fee is $50.00. Gambling managers shall meet all the requirements of Minnesota Statutes , Chapter 349 , and must file proof that a $10 , 000 fidelity bond has been provided. An individual may not manage any charitable organi- ation' s gambling operation for more than three consec- utive years. Gambling managers may not receive more than $50.00 per week for compensation for services as a gambling manager. All gambling managers must successfully complete a _ training prvgram established by the City, which training program shall include state charitable gambling laws , city charitable gambling ordinances , accounting procedures , record keeping and reporting procedures and methods. The attached draft should be submitted as an amendment to the pending ordinance by substituting a new page 7 together with additional pages 8 and 9. You will note that I have added one additional provision to the original section 4 of the ordinance. This is found at the top of page 7 under subclause "o" which would establish a maximum compensation for gambling managers of $50 per week. This would tie in with the new proposed Section 6, which also contains the provision for the maximum compensation for gambling managers . Notwithstanding other provisions of this Legislative Code'�to the contrar , the Council ma ermit an on- � sale licensee to permit the ho lding of a single event, such as a banquet, that includes the sale of � raffle tickets as a part of the event activity, provided that such events are separate from the public areas of the licensed establishment, not open to the general public ancl the raffle conducted by a charitable organization licensed by the State of . Minnesota. Section 3. : � - Tha'� � Chapter� 409 of the Legislative Code be and is hereby amended so as to add the following new section thereto: 409.21 . Pull-Tabs in Bars. - On-sale licensees may request permission of the City . Council to permit qualified charitable organizations to conduct lawful gambling in the form of pull-tabs only on the licensed premises. Application for permission shall be made to the license inspector and payment of , the specified fee. If the application is granted the � license shall contain an endorsement specifying this approval and the gambling endorsement may be� considered for renewal at the same time as the Council may con- sider renewal of the on-sale license. 2 . ' ' . . � � �-- �S-/lo a Gambling endorsements on on-sale licenses shall be subject to the following regulations vrhich shall • be deemed as a part of the license, and failure of compliance may constitute grounds for adverse action as prescribed in the Legislative Code : � � 1 ). Only charitable non-profit organizations � whose primary function is the support of athletic activities and serving a majority of the youth from the City of Saint Paul or contributes a majority of its revenues on ' Saint Paul youth may be allowed to sell pull- tabs on the premises. 2) Use of the licensed .premises shall be by means of a written lease agreement between the � licensee and the charitable organization. The • lease shall be for a term of at least one year; a copy shall be filed with the license inspector, and also a copy must be kept on the premises and ava.ilable for public inspection upon request. � Leases shall be governed by the following: a) Maximum rent that may be charged is $100.00 per week. b) Rental payments may not be based on a percentage of profits from gambling. c) The charitable organization may not reimburse the licensee for any license . fees or other gambling related expenses . . incurred by the licensee. d) The only form of gambling that shall be permitted on the licensed premises • shall be pull-tabs. 3 . . t � . � � -� .��'�=E�a �' e) Pull-tabs shall only be sold from a booth used solely by the ch.aritable organization, and pull-tab's• shall neither be sold by employees of the licensee nor �� sold from the bar service area. f) The construction and maintenance of the booth used by the charitable organization shall be the sole responsibility of the licensee. �� g) The lease shall contain a provision permitting the licensee �to terminate the lease if the charitable organization is found guilty of any violation of state or local gambling statutes , ordinances or rules and regulations. 3) Only one charitable organization shall be . . permitted to sell pull-tabs on the licensed premises. � � 4) • The�•1 i.censee .may �not be reimbursed by the � ' �' �haritable� organization for any license or permit � fees, and the only compensation which the licensee .. � may obtain from the charitable organization is the rent fixed in the lease agreement. 5) The licensee must commit to a minimum of 20 hours of sales of pull-tabs per week for the charitable � organization. 6) AS a qualification for removal of the permission to. allow the sale of pull-tabs on the licensed prem- � � ises, the licensee must demonstrate to the license inspector that the charitable organization is capable � . of generating at least $2 , 500 �in gross gambling revenues weekly based on a 20 hour per week operation. s . � 4 . ` . . ,�a�' � � � � �� 7) The licensee shall be responsible for the charitable organization' s conduct of selling • pull-tabs . The City Council may suspend the � licensee ' s permission to allow gambling on the premises for a period up to 60 days for any� violation of state or local gambling laws or regulations that occur ori the premises by any- one, including the licensee or the charitable organization. A second violation within a 12 month period shall cause an automatic 12 month , suspension, and any additional violations with- ° in a 12 month period shall result in the revo- cation of the gambling permission, and may also be considered by the Council as grounds for suspension or revocation of the on-sale liquor license. Section 4. That Chapter 409 of the Legislative Code be and is hereby , amended so as to add the following new section thereto: ' 409.22. Charitable. Gambling Regulations. . The sale of pull-tabs in on-sale licensed premises shall be conducted only by qualified and state licensed charitable organizations. In addition to satisfying the qualifications set forth in Minnesota Statutes, Chapter 349, the following regulations and qualifications must be complied with by all such charitable organi- zations: a) Must be' a non-profit charitable volunteer organization whose primary function is the support of athletic activities , including the following activities: Aquatics, baseball , . basketball , boxing, football , gymnastics, golf, hockey, skiing, soccer�,� softball , speed and s . figure..skat�ng and tennis . . � b) Must be a local charity serving youth, a majority of which are".from St. Paul and/or spends a majority of its revenues on St. Paul youth. . . � 5 . � � � ����a � � - � • � - .� . � �'� c) Must have been in existence for three years. d) May not be supported by a school athletic � . program� either public or private. e) Must file with the license inspector annually a list containing the names and addresses of all current members. f) Must use gambling proceeds only for youth athletic activities. If tYie organization gener- ates funds for other uses , it must keep separate and accurate accounting records of all gambling � receipts and disbursements . g) Must file financial reports weekly with the license inspector. h) May not have a gambling license in more than one on-sale liquor establishment in the City of Saint Paul . � - - � �i ) Must e�hibit ar�d sell pull-tabs in a method as required by the license inspector. � j ) May be required to demonstrate to the City ' � Council that the majority of their total income is given to youth athletic activities. k) Workers or managers may not divulge the number of or the dollar amount of the winners at any time. 1 ) � Shall not co-mingle game cards. m) Shall pay employees a minimum wage of $3. 35 per hour (federal minimum wage) and no more than $5.On per hour. ., � : � n) Shall comply with all the provisions of Minn. Fund Established; Administration There is hereby established a special fund for the administration and distribution of the proceeds contrib- ited by charitable gambling in on-sale liquor establish- ments as specified in this Chapter. Monies in this fund may be expended only for such lawful purposes as set forth in Minnesota Statutes , Chapter 349 and shall be expended to assist youth athletic organizations which are not selling pull-tabs in licensed establishments . The City Council shall appoint a city-wide charitable organization and youth or adult representatives from each of the City' s recreation districts to advise the City on the disbursement of these funds. The Council , with the advice of the appointed city-wide charitable organization and representatives , shall by resolution adopt rules and regulations governing the administration of the fund, eligible applicants , and appropriate uses for the funds. The annual license fee is $50.00. Gambling managers shall meet all the requirements of Minnesota Statutes , Chapter 349 , and must file proof that a $10, 000 fidelity bond has been provided. An individual may not manage any charitable organi- ation' s gambling operation for more than three consec- utive years . Gambling managers may not receive more than $50.00 per week for compensation for services as a gambling manager. Al1 gambling managers must successfully complete a training program established by the City, which training program shall include state charitable gambling laws , city charitable gambling ordinances , accounting procedures , record keeping and reporting procedures and methods. Section 7. This ordinance shall take effect and be in force thirty days from and after its passage , approval and publication. 9.
