RESOLVED, that upon execution and delivery of a release in
full to the City of Saint Paul, the proper City officers are hereby
authorized and directed to pay out of the Tort Liability Fund
09070-511-000 to Ronald L. Benson the sum of $900 . 00 in full
settlement of his claim for damages sustained approximately
June 18, 1980, as a result of a fall at Sackett Playground
Gymnasium in St. Paul. Said $900 . 00 settlement is to be made
as follows: $700. 00 payable to Ronald L. Benson and his attorney,
Dennis G. Atchison and $200 . 00 payable to Ronald L. Benson and
Minnesota Department of Public Welfare.

RE: Claim against the City of Saint Paul
by Ronald L. Benson
Ronald L. Benson has commenced suit against the City of Saint
Paul for injuries he sustained on approximately June 18, 1980
at the Sackett Playground Gymnasium. Mr. Benson claims that
he was engaged in a qame of basketball when he tripped and
sprained his ankle. He claims that cracks in the floor surface
caused his injury.
Mr. Benson was originally seen at St. Paul Ramsey Hospital where
it was determined that he suffered a Grade III sprain to his left
ankle. The attending physician opined that he suffered a 5� per-
manent partial disability to his ankle. Later, Mr. Benson sought
chriopractic treatment because of continuing complaints. That
doctor opined that Mr. Benson suffered a 10$ permanent partial
disability to his ankle. Mr. Benson' s total specials are approxi-
mately $2 , 000, including a $600 hospital lien by the Minnesota
Department of Public Welfare.
This office has researched a settlement with Mr. Benson in the
total amount of $900 . We recommend approval of the settlement.
