At the close of the public hearing, the Committee voted 3 to 3 to deny the variance. On September 13, 1985, the Planning Commission voted 8 to 4 to deny the variance. On October 1, 1985, the applicant duly filed an appeal of the decision of the Planning Commission. The reasons for the appeal are set forth in the attached application and letter. PURPOSE: To increase the permitted display area of business signs from 2,553 square feet to 5,100 square feet and to convert an existiny pylon sign into an electronic message center sign. B. PARCEL SIZE: 22 acres - the parcel has lU0' of frontage on McKnight Road, 681 ' on Pederson, and 1 ,652' on I-94. C. EXISTING LAND USE: A shopping center containing retail , service and office uses. � E. SURROUNDING LAND USE: North: A bank, an apartment building, and a water tower East: Commercial South: Highway I-94; further south across I-94, one and two family residential and commercial West: Commercial and apartment buildings E. ZONING HISTORY: The parcel was rezoned to commercial for a shopping center in 1955. A new site plan was approved in June 1985. F. ZONING CODE CITATION: , Section 66.201(11) states: "All signs may be illuminated. Illumination of signs shall not be of a flashing, moving, or intermittant type; however, signs giving public information such as time, temperature, stock averages and the like are permitted. Except for Districts B-4 and B-5, artificial light shall be maintained stationary and constant in intensity and color at all times when in use." The Zoning Administrator has determined that the electric message center sign is not permitted in a B-2 zone without a variance. Section 66.205(1)(1) states: "The sum of the gross surface display area in square feet of all business signs on a lot shall not exceed two times the lineal feet of lot frontage or 75 square feet, whichever is greater." The permitted display area is 2,553 feet; the requested display area of 5,100 exceeds this by lU0%. G. FINDINGS: 1. In order to grant the variances, the Planning Commission must determine that there are unusual conditions pertaining to the sign needs for the subject site. With respect to varying Section 66.201(11) : 2. The electronic message center is not unique nor are the sign needs associated with the building or lot unusual . 3. The electronic message center sign, having moving and intermittant illumination, would be within 300 feet of residential property across Highway 94. 4. A sign with a changiny message can be distracting and dangerous to highway drivers, particularly since there are two interchanges within approximately 1/4 mile of the sign. � 5. Grantiny the variance would double the display area permitted in B-2 Commercial Business Districts. 7. When the City adopted sign regulations, shopping centers, which are setback from roads, as well as strip developed commercial areas were considered in determining the appropriate maximum sign display area. 9. There are no unusual conditions pertaining to sign needs for the shopping center. 10. Granting the variance would be contrary to the intent of the sign o�dinance. H. Showing elevation drawings, Thomas Ruvelson the consultant to Kraus Anderson, stated that they were told by their architect to reduce the tenant signs and that they were now requesting a variance to allow 3,754 square feet of business signs. Mr. Pangal asked what the current square footage was, and the Consultant stated 6,293 which did not include vacancies. Committee members asked questions of Mr. Ruvelson and discussed renovating the pylon signs, the proposed sign system, heights of signs, the message content of the electronic sign. Mr. Pangal asked if the occupants did not remove their signs if Kraus Anderson would remove them at their own expense. It was stated by the representative of Kraus Anderson that if occupants did not remove their signs that Kraus Anderson would remove them at their own expense. • Ms. Toni Baker, Community Organizer of the District 1 Community Council , spoke in support of the variance, stating that the district had hoped for and asked for renovation of the Sun Ray Shopping Center. She stated that it was difficult for Council members to visualize what the impact will be, and that the new uniform sign system will compensate for the larger size. She stated that the message center will help community comnunication and for unity. Ms. Tracy seconded the motion, which passed unanimously on a voice vote. Mr. Galles moved approval of the the variance of the sign display area based on the fact that the 'L' shaped building is unusual , the existing square footage of signs will be reduced, a uniform sign system will replace clutter, and the proposed signs do not appear to be objectionable to adjacent property or adversely affect the surrounding area, or create hazards, violate state statutes, or produce excess glare and lighting. Ms. Tracy seconded the motion which passed on a roll call vote of 6 to 0. Mr. Segal stated that the Code allows signs for public information and that the request is to permit business messages of Shoppin9 Center tenants. The addition of an electronic message center on each side of the existing Sun Ray pylon sign. � Recently, a f our million dollar renovation was started , with a projected fall completion date. Prior to starting construction, the Community One Council reviewed the project and they gave it a 100$ approval. The remodeliny phase will include new tenant store fronts, canopy, tenant signs and a f ascia treatment to cover the existing parapet. New landscaping far the project is also planned. A major expansion is occurring at the west end of the Center to include the addition of several major tenant s. Incorporated into the new canopy fascia is a proposed sign area which will be designated f or use by smal].er tenants. ' The sign band, which will be 30" high can accommodate up to 20 " letters for tenant graphics. Featured above the sign band will be the major tenant signing. Each major ter.ant would be authorized to use an area 5 ' high by 50 ' or 250 square f eet. All major tenant signs will be restricted to individual sign letters only, and will be contained totally within the area designated by the landlord. The major tenants will consist of T.J. Maxx, two signs, True Value Hardware, Country Store Foods, J.C. Penny, Snyder Brotkier Drugs, Rainbow Foods anc3 one lazge vacant space. The existing pylon signs total 1,924 square feet. In addition to the main sign which is 1,700 square feet, three tenant identification signs are in place. Consideration is also being given for a 100 square f oot pylon f or tenants in the northwest corner of the center. � The developer plans to retain the existing Sun Ray pylon sign but update the colors, omit the copy, . The signs, as proposed would not be contrary to the general intent of the sign code. The distance from the shopping center to Hwy. 94 is ,�.� feet. Major tenants require larger signs so they can be easily read from that distance. Without those large sians, the major tenants will not allow the developer to remove the existing signs under the terms of their leases. 2 . The signs, including the message center will not create a hazard. On the contrary, the signs will be easier to read than the existing signs due to their unif ormity. 3 . The signs will not violate Minnesota State Statutes, and will meet or exceed State, U.L. and Federal codes. 4 . The signs will improve the overall appearance of the center anc� will not negatively affect adjacent property owners. In £act, the re- modeled center should add to the value of their property. 5 . The signs will compliment the project and will not ac�versely affect resiclential property. 6 . The signs will be in keeping with the architectural flavor of the remodeled center and will enhance the project as a whole. The requested variance is a very vital part of the total renovation project. The community has long been disenchanted with the appearance of Sun Ray. The renovation project under way and this eff'ort at creating uniform signage is welcomed. It was difficult for the Council to visualize what the impact will ultimately be. Hopefully the uniformity will compensate for the additional signage Kraus-Anderson is requesting on behalf of its tenants. � There was some concern expressed by a board member who lives over a mile away about the message board. Her concerns were allayed by a visual inspection that evening after the meeting (and vote) . Another board member who lives within 350 feet, directly across I-94 from the sign proposed for renovation, made the motion to approve.
