WHEREAS, Rudolph A. Kunz has submitted the attached proposed lot split for
City Council approval ; and
WHEREAS, the Departments of Planning and Economic Development and Public Works
have reviewed the proposed lot split at 1640 Middleton Avenue as described on
the attached survey; and
WHEREAS, the proposed lot split meets the requirements of Sections 76.304 and
67.406 of the Zoning Code, except for minimum lot area; and
WHEREAS, the City Council on November 21, 1985 held a public hearing to
determine the advisability and necessity for the granting of variances from the
strict application of the provisions of Sections 67.304 and 67.406 of the
Zoning Code at which hearing all persons present were given an opportunity to
testify; and
WHEREAS, following said public hearing, the City Council made the following
findings of fact:
� 1. The property in question cannot be put to a reasonable use under the
strict provisions of the code;
2. The plight of the landowner seeking to divide the property is due to
circumstances unique to his property, and these circumstances were not
created by the landowner; and
3. The variance requested is in keeping with the spirit and intent of the
code, and is consistent with the health, safety, comfort, morals and
welfare of the inhabitants of the City of Saint Paul ; and

4. Granting the requested variance will not impair an adequate supply of
light and air to adjacent property, nor will it alter the essential
character of the surrounding area or unreasonably diminish established
property values within the surrounding area; and
5. The variance, if granted will not permit any use of the land that is
inconsistent with the provision of the Zoning Code; and
6. The owners request for this variance is not based primarily on a desire to
increase the value or income potential of the parcels of land.
NOW, THEREFORE BE IT RESOLVED, that the City Council accepts and approves this
lot split for property situated at 1640 Middleton Avenue, legally described as

A. PURPOSE: To consider a subdivision 'of three lots into two tracts. A variance of
mi mum lot area is required.
B. SITE & AREA CONDITIONS: The lots are bounded by one residential house and three
streets. The houses in the area are mainly one story, single f amily homes.
Tract A: is flat and vacant. There is one existing large tree with a few
smaller trees and bushes.
Tract B is flat with an existing house and detached garage. There are some
mature trees and bushes.
C. MINIMUM LOT REQUIREMENTS: The R-4 district requires a lot width of 40' and a lot
area of 5, 00 sq. ft.
D. CURRENT WIDTH & AREA: The current area is 9,678.52 sq. ft. 117.06' of frontage
on Middleton, 6 ' frontage on Vista, and 125.53' frontage on Alaska.
E. PROPOSED WIDTH & AREA: Tract A will have an area of 4,836.6 sq. ft. , 39.02' of
frontage on Middleton, 60.00' of frontage on Vista, and 71.21' on Alaska.
Tract B will have an area of 4,839.8 sq. ft. , 50.65' frontage on Middleton and
54.32' on Alaska.
F. FINDINGS:
1. The existing and proposed lots have frontage on existing improved streets
and access to municipal services.
2. The lot to be divided is previously platted land.
3. The division of the lot shall result in two tracts which do not meet the
minimum standards of the R-4 zoning district. Section 67.703 of the Zoning
Code allows the City Council to grant variance to the subdivision regulations
when compliance would create an unusual hardship based on the existing
conditions of the property.
4. The subdivisions appears to meet the intent of the Zoning Code by:
preserving and incorporating the sites existing natural features; allowing
the building site to be used safely without endangering the residence by
peril from floods, erosion, severe soil condition on other menance; and
allowing the property to be economically served by public facilities.
5. Granting the variance will not impair the reasonable use or enjoyment of
adjacent properties.
6. The request for variance is based on the size and irregular shape of the
existing lots which is compounded by the irregular intersection of three
streets adjacent to the property. The existing parcel is nearly twice the
minimum requirement for a single f amily dwelling in the R-4 zone. These
circumstances were not incurred by the property owner.
7. Granting the variance will allow the applicant the same rights commonly
enjoyed by others in the area who have substandard lots.
E. STAFF RECOMMENDATION: Based on the above findings, staff recommends that the
su iv�sion e approved with the f ollowing variance: Tract A: Reduce minimum
required lot area from 5,000 sq. ft. to 4,838.6 sq. ft. ; Tract B: Reduce minimum
required lot area from 5,000 sq. ft. to 4,839.8 sq. ft.
