RESOLVED, that the proper City officials are hereby authorized
and directed to execute a use agreement with Dunbar Motors,
Incorporated, 301 University Avenue , St. Paul , Minnesota 55103;
said agreement to provide for the City' s Police Department
use of a motor vehicle subject to the terms and conditions
of said agreement, a copy of which is to be kept on file and
of record in the Department of Finance and Management Services.

' THIS AGREEMENT, Made and entered into this day of .
1985, by and between Mr. James Dunbar, President, Dunbar Motors, incorporated,
301 University Avenue, St. Paul , MN 55103, hereinafter referred to as "Supplier"
and the City of St. Paul , hereinafter referred to as "City".
WH�REAS, Supplier is the owner of a 1967 Cadillac Nerse, V.I.P1. Z7298665;
and
Wt�EREAS, Supplier has customized the vehicle in a manner de:�:�ned to pro-

mote the St. Paul Police Dungeon of Horrors; and
WhEREAS, Supplier wishes to assist the St. Paul Rolice Depar•:;ment in its
continuing efforts to promote good police community relations; and

WH�REAS, Supplier wishes to formalize a relationship whereby the Police
Department may utilize the vehicle; ,
N�1W TNEREFORE,� it is mutually agreed by and between the Supplier and the

l . That, in consideration of the use of Supplier's vehicle,
the City agrees to pay the Supplier the sum of One �c11ar ($1�.
2. That the City shall provide to Supplier a police "rE�d lignt" to
be permanently affixed to the roof of the �•ehicle c��.tr�ii�g the
term of the lease, said "red light" to be r�meved f►�om the vehicle
and returned to the City upon the expiration of thi�; Agreement.
Any repair necessitated by the removal of the "r2d �ight" to
be the sole�responsibility of Supplier.
3. That the Supplier shall refrain from any personal use of this
vehicle during the period in which this Agr�emPnt i.� in effect
except that the City agrees to allow the Supplier -t�� enter and
display the vehicle in local area car shows.

4. That upon 24 hours notice, the Supplier shall make the vehicie
available to the City Police Qepartrnent's Dungeon of Horrors
coordinator and allow use of the vehicle for events that are
designed and deemed appropriate to promoting good will between
the Police Department and the community.
5. That the City agrees to save and hold Supplier harmless from
any and all claims arising out of the City's use of vehicles
= hereundew and shall , additionally, r�c�air at its own expense any
� ` dam'age sustained by the veF�icles during the course of City's
use, normal wear and tear excepted.
6. That the City shall be responsible for supplying each vehicle
rented hereunder with such amounts of gasoline and oil as is
needed to make the vehicle operational , but no other maintenancE
obligations shall be the responsibility of the City.
7. That this Agreement shall be for a period of one (1 ) year and
shaii automaticaliy be exLendea ror an aaaitional period of
one (1) year, providing no written notice is submitted by either
party of an intent to terminate this Agreement at least thirty
(30) days prior to the expiration of the first year.

Purpose of Vehicle. To promote goodwill between the St. Paul. �olice Depart-

Use and Care of Vehicle will be used only with prior knowledge and con-

coordinator and in his absence, a sworn police
officer designated by him.
B. Vehicle not to be used by any organization within
the Police Department nat related to the St. Paul -
Police Dungeon of Horrors.

week prior to scheduled event.
D. Vehicle is permitted.to have a city, red police

events, and static display.

F. A vehicle mileage log will be maintained by the
Dungeon of Horrors coordinator and be kept with
the vehicle. This log will list event, date,
time out, starting mileage, time in, and endirg
mileage. This log will be subject to periodic revie�
by the Chief or persons designated by him upan request.
G. Vehicle will be stored privately until such ti�ne
adequate enclosed, city storage can be obtai�►ed.
H. Vehicle will be maintained by the lessor except as
provided in lease agreement (attached) .
I. Vehicles interior and exterior will be maintainEd by
� the Dungeon of Horrors coardinator. Vehicles exterior
will not be washed or waxed except under directed
supervision of Dungeon of Harrors coordinator.
J. The City of St. Paul Police Department will provide
gas and ail for the vehicle, as specified in lease
agreement. Such purchases will be noted in vehicles
log book in addition to the gas slip. Vehicle will
be assigned a squad vehicle number for recording
such purchases.
