WHEREAS, the Council of the City of Saint Paul, by resolutions C. F.# 12213 approved August 16, 1916 and
C. F. # 280253 approved May 3, 1983 did vacate certain lands described as follows:
a All that part of Hamline Avenue, seventy feet in width, below elevation 260.33 city datum, that lies
s north of a line 30 feet north of and parallel to the northerly line of the Great Northern (now Burlington
e Northern - Santa Fe) Railway Company's right-of-way in Section 27, Town 29 North, Range 23 West,
� and south of an east and west line which intersects the center line of said Section 27, 128.17 feet south of
s the center of said SecUon; said center being marked by a stone monument and located in the standard
9 survey of Hamline Avenue as at Station 26 plus 29.78 recorded on the standard map of the Department

purposes was retained in said Council Files and,
WHEREAS, the Port Authority wishes a release of said easement and,
WHEREAS, the Port Authority will grant to the City an easement for public walkway purposes in an alternate
location and,
z6 WHEREAS, based upon a utility easement Certificate of Intended Non-Use filed voluntarily on behalf of the
z� Department of Public Works, and made a part hereof by this reference and filed in the office of the City Clerk of
zs Saint Paul, the City for itself and on behalf of the Department of Public Works, waives the right to the public
za walkway easement in the area described as follows:

z and on behalf of the City of Saint Paul and those persons for whom the City has reserved easements, the Council
s of the City of Saint Paul does hereby waive and release the retained public walkway easement as described
a above.
BE TT F'CTRTHER RESOLVED, that upon passage of this resolution the CiTy Clerk is hereby authorized and
directed to record a copy of this resolution in the office of the Registrar of Deeds, Ramsey County, and that the
City Clerk shall maintain a copy of all Certificates of Intended Non-Use referenced in this resolution on file in
the office of Citizen Services.
