brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not ]imited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.

resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution

175 Fort, LLC, a lnnited liability company under the laws of the State of Minnesota, constituting
the owner of all of the abutting properties, does hereby petirion the Council of the City of St.
Paul to vacate its interests in the property legally described as follows ("Property"):
That part of West 7�' Street as platted and dedicated in Fort Road Addition,
according to the recorded plat thereof, Ramsey County, Minnesota, described as
beginning at the most easterly comer of Lot 2, Block 1, said Fort Road Addition;
thence South 56 degrees 16 minutes 30 seconds East, assumed bearing, along the

There is currentiy attached to 175 Fort's property at 175 West 7`�' Street in St.
Paul a concrete deck that is located partially on 175 Fort's property and partially
on the dedicated portion of West 7'�' Street as platted in Fort Road Addition
according to the recorded plat thereof, Ramsey County, Minnesota, as shown on
the Survey of Sunde Land Surveying, LLC dated July 22, 1999 and revised as of
August 9, 2000, a copy of which is attached hereto ("Survey"). 175 Fort would
like to build an addition onto its current building by opening a portion of the
current building onto the deck and enclosing a portion of the concrete deck so that
it might be used yeaz-round for a restaurant.
We have attached six copies of the Survey which shall act as the site plans for the intended
development of the Property which shows the approximate location of the intended construction
on the Property to be vacated. The area intended for construction of the restaurant is mazked in
red on the Surveys.

The Department of Public Works has completed a review of the above reference vacation proposa] and
has no objections subject to the following.
1. That the vacation shall be to the front face of the existing wall only. We do not want any further
encroachment into the right-of-way than currently exists. The petitioner's surveyor should change the
survey accordingly.
2. A triangular piece on the easterly end of the azea to be vacated shall be retained as right-of-way -
meaning it shall be excluded from the vacation. See attached drawing. The petitioner's surveyor shall
change the survey of the vacation area to exclade this portion.
3. That the petitioner shall dedicate a triangular portion on the westem end of their property as street
right-of-way to accommodate the existing public sidewalk which runs across this area. See attached
drawing. The peritioner's surveyor shall note this on their drawing and describe the azea to be dedicated.
4. That this vacation shali be for the life of the encroaching structure only, and upon demolition or
removal of the encroachment, the vacated area shall automatically revert back to the City of St. Paul as
street right-of-way at no cost to the City.

Council Resolution. The purpose of the resolution is to vacate a portion of West Seventh
Street.in order to conect an existing encroachment. I have enclosed photocopies of the
Green Sheet, the Council Resolution and a map of the area to be vacated. Please let me

175 Fort, LLC, a lnnited liability company under the laws of the State of Minnesota, constituting
the owner of all of the abutting properties, does hereby petirion the Council of the City of St.
Paul to vacate its interests in the property legally described as follows ("Property"):
That part of West 7�' Street as platted and dedicated in Fort Road Addition,
according to the recorded plat thereof, Ramsey County, Minnesota, described as
beginning at the most easterly comer of Lot 2, Block 1, said Fort Road Addition;
thence South 56 degrees 16 minutes 30 seconds East, assumed bearing, along the
southeasterly extension of the northeasterly line of said Lot 2, a distance of 7.86
feet; thence Soutl: 28 degrees 27 minutes 27 seconds West a distance of 203.57
feet to the southeasterly extension of the southwesterly line of said Lot 2; thence
North 51 degrees 27 minutes 45 seconds West, a distance of 1236 feet, to the
most southerly corner of said Lot 2; thence northwesterly along the southeasterly
line of said Lot 2 a distance of 20235 feet to the point of beginning.
175 Fort, LLC requests the vacation of the Property far the following reason.
There is currentiy attached to 175 Fort's property at 175 West 7`�' Street in St.
Paul a concrete deck that is located partially on 175 Fort's property and partially
on the dedicated portion of West 7'�' Street as platted in Fort Road Addition
according to the recorded plat thereof, Ramsey County, Minnesota, as shown on
the Survey of Sunde Land Surveying, LLC dated July 22, 1999 and revised as of
August 9, 2000, a copy of which is attached hereto ("Survey"). 175 Fort would
like to build an addition onto its current building by opening a portion of the
current building onto the deck and enclosing a portion of the concrete deck so that
it might be used yeaz-round for a restaurant.
We have attached six copies of the Survey which shall act as the site plans for the intended
development of the Property which shows the approximate location of the intended construction
on the Property to be vacated. The area intended for construction of the restaurant is mazked in
red on the Surveys.

The Department of Public Works has completed a review of the above reference vacation proposa] and
has no objections subject to the following.
1. That the vacation shall be to the front face of the existing wall only. We do not want any further
encroachment into the right-of-way than currently exists. The petitioner's surveyor should change the
survey accordingly.
2. A triangular piece on the easterly end of the azea to be vacated shall be retained as right-of-way -
meaning it shall be excluded from the vacation. See attached drawing. The petitioner's surveyor shall
change the survey of the vacation area to exclade this portion.
3. That the petitioner shall dedicate a triangular portion on the westem end of their property as street
right-of-way to accommodate the existing public sidewalk which runs across this area. See attached
drawing. The peritioner's surveyor shall note this on their drawing and describe the azea to be dedicated.
4. That this vacation shali be for the life of the encroaching structure only, and upon demolition or
removal of the encroachment, the vacated area shall automatically revert back to the City of St. Paul as
street right-of-way at no cost to the City.

10 recorded plat thereof, Ramsey County, Minnesota, described as beginning at the most easterly
11 corner of Lot 2, Block 1, said Fort Road Addition; thence south 11 degrees 16 minutes 30
12 seconds East, the northeasterly line of said I.ot 2 has an assumed bearing of South 56 degrees 16

and Irvine's Addition to Saint Paul, according to the recorded plat thereof, Ramsey
County, Minnesota, lying easterly of a line drawn from a point on the northeasterIy line of

PETITION TO VACATE CITY INTEREST
175 Fort, LLC, a lnnited liability company under the laws of the State of Minnesota, constituting
the owner of all of the abutting properties, does hereby petirion the Council of the City of St.
Paul to vacate its interests in the property legally described as follows ("Property"):
That part of West 7�' Street as platted and dedicated in Fort Road Addition,
according to the recorded plat thereof, Ramsey County, Minnesota, described as
beginning at the most easterly comer of Lot 2, Block 1, said Fort Road Addition;
thence South 56 degrees 16 minutes 30 seconds East, assumed bearing, along the
southeasterly extension of the northeasterly line of said Lot 2, a distance of 7.86
feet; thence Soutl: 28 degrees 27 minutes 27 seconds West a distance of 203.57
feet to the southeasterly extension of the southwesterly line of said Lot 2; thence
North 51 degrees 27 minutes 45 seconds West, a distance of 1236 feet, to the
most southerly corner of said Lot 2; thence northwesterly along the southeasterly
line of said Lot 2 a distance of 20235 feet to the point of beginning.
175 Fort, LLC requests the vacation of the Property far the following reason.
There is currentiy attached to 175 Fort's property at 175 West 7`�' Street in St.
Paul a concrete deck that is located partially on 175 Fort's property and partially
on the dedicated portion of West 7'�' Street as platted in Fort Road Addition
according to the recorded plat thereof, Ramsey County, Minnesota, as shown on
the Survey of Sunde Land Surveying, LLC dated July 22, 1999 and revised as of
August 9, 2000, a copy of which is attached hereto ("Survey"). 175 Fort would
like to build an addition onto its current building by opening a portion of the
current building onto the deck and enclosing a portion of the concrete deck so that
it might be used yeaz-round for a restaurant.
We have attached six copies of the Survey which shall act as the site plans for the intended
development of the Property which shows the approximate location of the intended construction
on the Property to be vacated. The area intended for construction of the restaurant is mazked in
red on the Surveys.

The Department of Public Works has completed a review of the above reference vacation proposa] and
has no objections subject to the following.
1. That the vacation shall be to the front face of the existing wall only. We do not want any further
encroachment into the right-of-way than currently exists. The petitioner's surveyor should change the
survey accordingly.
2. A triangular piece on the easterly end of the azea to be vacated shall be retained as right-of-way -
meaning it shall be excluded from the vacation. See attached drawing. The petitioner's surveyor shall
change the survey of the vacation area to exclade this portion.
3. That the petitioner shall dedicate a triangular portion on the westem end of their property as street
right-of-way to accommodate the existing public sidewalk which runs across this area. See attached
drawing. The peritioner's surveyor shall note this on their drawing and describe the azea to be dedicated.
4. That this vacation shali be for the life of the encroaching structure only, and upon demolition or
removal of the encroachment, the vacated area shall automatically revert back to the City of St. Paul as
street right-of-way at no cost to the City.

For your records, in reviewing the design prints received from your o�ce, it has been determined
that MCIWorldCom does haue facilities within your construction azea and a conflict may exist.
In order to avoid this conflict, it will be nesessary for your construction to maintain a minunum
of twenty-four (24) inches vertical cleazance when crossing MCIWorldCom cable and sixty {60)
inches horizontal clearance when your running line is parallel to our facilities.
