An Ordinance amending Chapter 60 of the Saint Paul '
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, Peter DeMaio duly petitioned to rezone 1373-1379 Rice Street
located at the southwest corner of Cottage and Rice Streets from B-3 to I-1 for
the purpose of establishing a rental storage facility the petition having been
certified by the Planning Division on September 17, 1985, as having been consented
to by at least 67% of the owners of the area of the property to be rezoned, and
further having been consented to by at least two-thirds of the owners of the
property situated within 100 feet of the total contiguous property within one year
preceding the date of the petition; and
WHEREAS, The Zoning Committee on October 3, 1985, conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recomnendation to the Planning
Corr�nission that the petition be granted; and
WHEREAS, The Planning Cona�nission considered the rezoning petition at its
meeting held on October 11, 1985, and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
October 19, 1985, and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought to
be rezoned; and

considered all the facts and recommendations concerning the petition; now,
therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 4, as incorporated by
reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows:
That property located on the at the southwest corner
of Cottage and Rice Streets being more particularly
described as Lots 22-30, Block 13, Hager's
Subdivision, including 1/2 of vacated alley be and
is hereby rezoned from B-3 to I-1.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from and
after its passage, approval and publication.

Dear Sir:
On October 3, 1985, the Zoning Corr�nittee of the Planning Comnission held a
public hearing to consider a petition to rezone property situated on the
southwest corner of Rice and Cottage for the purpose of constructing a
rental storage facility.
The petitioner was present and no one spoke for or against the petition.
The committee discussed access to the site and expanding I-1 zoning
across Rice Street. At the close of the public hearing, the committee
voted 3 to 2 to approve the rezoning.
On October 11, 1985, the Planning Commission upheld the committies
recommendation on a vote of 15 to 2.
The matter is scheduled to be heard by the City Council on October 31,
1985. Please notify me by October 30, 1985, if any member of the City
Council wishes to have slides of the site presented at the public
hearing.

WHEREAS, Peter DeMaio (#9799) has applied for a rezoning under the provisions
of Section 60.610 of the Saint Paul Legislative Code for the purpose of
constructing rental storage buildings on site for property located at 1373-79
Rice Street (southwest corner of Rice and Cottage); and
WHEREAS, the Zoning Committee of the Planning Comnission on October 3, 1985,
held a public hearing at which all persons present were given an opportunity to
be heard pursuant to said application in accordance with the requirements of
Section 64.400 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on evidence presented to its
Zoning Comnittee at the public hearing as substantially �eflected in the
minutes, made the following findings of fact:
1. The applicant wishes to construct three rental storage buildings on the
parcel . The buildings are similar to garages. The existing building and
uses would remain.
2. The District 6 Plan's Proposed Land Use recommends residential use for this
parcel and the block to the north. The plan recommends corr�nercial use for
the east side of Rice Street.
3. On Rice Street, the parcel is bordered by railroad tracks, an auto body
shop (although the auto body shop parcel is approximately 30 feet below
Rice Street) , a rental equipment store where construction equipment is
displayed, and a paint store. It is extremely unlikely that the parcel
could be used for residential .
4. Rezoning the parcel I-1 would be a reasonable extension of the I-1 zoning
across Rice Street.
5. Rice Street, a minor arterial , provides adequate access to the site.
NOW, THEREFORE, BE IT RESOLVED, that the Saint Paul Planning Corrnnission
recommend to the City Council that the rezoning be granted in accordance with
the application on file with the Saint Paul Planning Division.

PRESENT: Mmes. Morton, Summers, Tracy and Zieman; and Mr. Pangal of
the Zoning Committee; Mr. Segal , Assistant City Attorney; Ms.
Lane of the Division of Housing and Building Code Enforcement;
Ms. Kelley, Mr. Ryan and Mr. McGuire of the Planning Division Staff.
ABSENT: Messrs. Galles, Lanegran, and Levy
The meeting was chaired by Joseph Pangal , Chairman.
PETER DeMAIO (#9799): Rezone property from B-3 to I-1 to construct
renta storage buildings for property located at 1373-79 Rice Street.
The applicant was present. There was no opposition present at the
hearing.
Roger Ryan showed slides of the site and reviewed the staff report with
a recommendation for approval .
Peter DeMaio, 330 E. Wheelock Parkway, stated that he would be happy to
answer any yuestions.
Ms. Zieman asked where the parking lot would be and where people would
enter. Mr. DeMaio stated on the Cottage side of the property.
Mr. McGuire stated that there are considerable grade changes on the
property, there is no possible access on Rice Street, and that access
would have to come in on Cottage.
Hearing no further testimony, Mr. Pangal closed the public hearing
portion of the meeting.
Ms. Zieman stated she had a problem with I-1 crossing over Rice and
because other industries, such as body shops, would be able to go into
that zone.
Ms. Morton moved approval of the rezoning from B-3 to I-1 based on
findings 1, 3, 4 and 5 of the staff report. Ms. Tracy seconded the
motion, which passed on a roll call vote of 3 to 2.
