WHEREAS, unsuccessful District 5 City Council candidate
Hugo Masanz has filed in the office of the City Clerk a formal
request for a recount of the November 5, 1985 District S votes
for City Council member; and
WHEREAS, Minn. Stat. Sec. 204C.36 provides that a candidate
whose margin of loss is greater than one percent must pay the
costs of a recount as determined by the governing body of the
jurisdiction; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul, upon
recommendation of the City Clerk and City Elections Officer,
hereby sets the amount of $100.00 as the cost for a recount
of the votes cast in the District S Council contest.

Upon receipt of a request made pursuant to this section, the county auditor -
shall recount the votes for a county office at the expense of the county and the
goveming body of the municipality shall recount the votes for a munictipal office
at the expense of the municipality. �
A losing candidate for nomination or election to a county or municipal office � .
may request a recount in the manner provided in this section at the candidate's ��
own expense when the vote difference is greater than the difference required by ,;: _
clauses (a) to (e). 'fhe votes shall be recounted as provided in this section if the 1J
requesting candidate files with the county auditor or municipal clerk a bond, cash �
or surety in an amount set by the goveming body of the jurisdiction for the
payment of the recount expenses.

204C361 RULES FOR RECOUNTS.
The secretary of state shall adopt rules according to the Administrative
Procedures Act establishing uniform recount procedures. All recounts provided
for by sections 204C35 and 204C.36 shall be conducted in accordance wrth these
rules.

204C37 COUNTY CANVASS; RETURN OF REPORTS TO SECRETARY _
� OF STATE.
Two copies of the reports required by sections 204C.32, subdivision 1 and '
204C.33, subdivision 1 shall be certified under the official seal of the county
auditor. Each copy shall be enclosed in an envelope addressed to the secretary of
state, with the county auditor's name and official address and the words "Election
Returns"endorsed on the envelope. The copies shall be mailed or delivered to the
secretary of sta.te and, if mailed, shali be forwarded by different mails. If neither
copy is received by the secretary of state within ten days following the applicable
elect�on, the secreta.ry of state shall immediately notify the county aud�tor, who
shall deliver another copy to the secretary of state by special messenger.

204C38 CORRECTION OF OBVIOUS ERRORS; WHEN CANDIDATES
AGREE. —
Subdivision 1. Enors of election judges. If the candidates for an office 4+�. ,
unanimously agree in writing that the election judges in any precinct have made �
an obvious error m the counting or recording of the votes for that office, they sha11 '��
deliver the agreement to the county auditor of that county who shall reconvene the `�_.� ---
county canvassing board, if necessary, and present the agreement to it. The
county canvassing board shall conect the enor as specified in the agreement. ; �r
Subd. 2. Errors of county canvassing board. If the candidates for an office �i`' :� :
unanimously agree in writing that the county canvassing board has made an

RESOLVED, that the Council of the City of Saint Paul hereby approves and
ratifies the attached Memoranda of Agreement which amend the 1984-1985 Collective
Bargaining Agreements between the City of Saint Paul and AFSCME Local 1842 and
AFSCME Local 2508.

Rationale) :
This resolution amends the Agreements between AFSCME Local 1842, AFSCME Local 2508 and the
City of St. Paul. The change involves the employer's contribution for early retirees. The
employe+� 's contribution for single coverage increases from $87.06 to $138.20 per month. The
employer's contribution for dependent coverage is decreased from $193.26 per month to $177.80
per month. These changes are for 1985 only. The maxir�um contributions revert back to $87.06
and $193.26 on December 31 , 1985.
COST/BENEFIT, BUDGETARY AND PERSONNEL IMPACTS ANTICIPATED:
$1500 to $2000. The cost is dependent upon the number of 1985 early retirees who have .

MEMORANDUM OF AGREEMENT
This Memorandum of Agreement is by and between the City of Saint Paul and Local
` Union 1842, District Council 14 of the AFSCME. In full settlement of the Grievances
filed by AFSCME, Local 1842 dated 12-14-84.
1. Except as herein modified, the Agreements between the parties, entered into
May 6, 1985, shall be the basis of this Memorandum of Agreement.
2. Effective upon the execution of this Memorandum, Article 10.2 of said Agreement
shall be replaced with Article 10.2 which is attached hereto and made a part
hereof.
It is understood that the above settlement shall be recommended by the City
Negotiator, but is subject to approval by the City Administration and adoptio�
by the City Council.

10.2 The Employer will for the period of this AGREEMENT provide for employees
who retire after the time of execution of this AGREEMENT and until such
employees reach sixty-five (65) years of age such healt'h insurance
benefits and life insurance benefits as are provided by the Employer for
such employees.
Effective January 1, 1985, for each employee who retires after January 1,
1985 and is eligible for early retiree benefits under the terms set forth
in this article and who selects Blue Cross employee insurance coverage,
the Employer agrees to contribute the cost of such coverage or �138.20
per month, whichever is less. In addition for each eligible early
retiree who selects Blue Cross dependent'e insurance coverage, The
Employer will contribute the cost of such dependent's coverage or �177.80
per month, whichever is less. I
Effective December 31, 1985, the Employer's contribution toward early
retirees Biae Cross employee coverage shall be adjusted back to and
limited to the cost of such employee's coverage or ;87.06 per month,
whichever ie less. Any increase in the insurance premiums after
December 31, 1985 for employee coverage shall be paid by the employee.
